The Counties Code is amended by changing5Section 5-1069 as follows:6 (55 ILCS 5/5-1069)7 Sec. 5-1069. Group life, health, accident, hospital, and8medical insurance.9 (a) The county board of any county may arrange to provide,10for the benefit of employees of the county, group life,11health, accident, hospital, and medical insurance, or any one12or any combination of those types of insurance, or the county13board may self-insure, for the benefit of its employees, all14or a portion of the employees' group life, health, accident,15hospital, and medical insurance, or any one or any combination16of those types of insurance, including a combination of17self-insurance and other types of insurance authorized by this18Section, provided that the county board complies with all19other requirements of this Section. The insurance may include20provision for employees who rely on treatment by prayer or21spiritual means alone for healing in accordance with the22tenets and practice of a well recognized religious23denomination. The county board may provide for payment by theSB2770 Enrolled - 2 - LRB104 16719 RTM 30125 b1county of a portion or all of the premium or charge for the2insurance with the employee paying the balance of the premium3or charge, if any. If the county board undertakes a plan under4which the county pays only a portion of the premium or charge,5the county board shall provide for withholding and deducting6from the compensation of those employees who consent to join7the plan the balance of the premium or charge for the8insurance.9 (b) If the county board does not provide for10self-insurance or for a plan under which the county pays a11portion or all of the premium or charge for a group insurance12plan, the county board may provide for withholding and13deducting from the compensation of those employees who consent14thereto the total premium or charge for any group life,15health, accident, hospital, and medical insurance.16 (c) The county board may exercise the powers granted in17this Section only if it provides for self-insurance or, where18it makes arrangements to provide group insurance through an19insurance carrier, if the kinds of group insurance are20obtained from an insurance company authorized to do business21in the State of Illinois. The county board may enact an22ordinance prescribing the method of operation of the insurance23program.24 (d) If a county, including a home rule county, is a25self-insurer for purposes of providing health insurance26coverage for its employees, the insurance coverage shallSB2770 Enrolled - 3 - LRB104 16719 RTM 30125 b1include screening by low-dose mammography for all patients 352years of age or older for the presence of occult breast cancer3unless the county elects to provide mammograms itself under4Section 5-1069.1. The coverage shall be as follows:5 (1) A baseline mammogram for patients 35 to 39 years6 of age.7 (2) An annual mammogram for patients 40 years of age8 or older.9 (3) A mammogram at the age and intervals considered10 medically necessary by the patient's health care provider11 for patients under 40 years of age and having a family12 history of breast cancer, prior personal history of breast13 cancer, positive genetic testing, or other risk factors.14 (4) For a group policy of accident and health15 insurance that is amended, delivered, issued, or renewed16 on or after January 1, 2020 (the effective date of Public17 Act 101-580), a comprehensive ultrasound screening of an18 entire breast or breasts if a mammogram demonstrates19 heterogeneous or dense breast tissue or when medically20 necessary as determined by a physician licensed to21 practice medicine in all of its branches, advanced22 practice registered nurse, or physician assistant.23 (4.5) For a group policy of accident and health24 insurance that is amended, delivered, issued, or renewed25 on or after January 1, 2026 (the effective date of Public26 Act 103-808), molecular breast imaging (MBI) and magneticSB2770 Enrolled - 4 - LRB104 16719 RTM 30125 b1 resonance imaging of an entire breast or breasts if a2 mammogram demonstrates heterogeneous or dense breast3 tissue or when medically necessary as determined by a4 physician licensed to practice medicine in all of its5 branches, advanced practice registered nurse, or physician6 assistant.7 (5) For a group policy of accident and health8 insurance that is amended, delivered, issued, or renewed9 on or after January 1, 2020 (the effective date of Public10 Act 101-580), a diagnostic mammogram when medically11 necessary, as determined by a physician licensed to12 practice medicine in all its branches, advanced practice13 registered nurse, or physician assistant.14 A policy subject to this subsection shall not impose a15deductible, coinsurance, copayment, or any other cost-sharing16requirement on the coverage provided; except that this17sentence does not apply to coverage of diagnostic mammograms18to the extent such coverage would disqualify a high-deductible19health plan from eligibility for a health savings account20pursuant to Section 223 of the Internal Revenue Code (2621U.S.C. 223).22 For purposes of this subsection:23 "Diagnostic mammogram" means a mammogram obtained using24diagnostic mammography.25 "Diagnostic mammography" means a method of screening that26is designed to evaluate an abnormality in a breast, includingSB2770 Enrolled - 5 - LRB104 16719 RTM 30125 b1an abnormality seen or suspected on a screening mammogram or a2subjective or objective abnormality otherwise detected in the3breast.4 "Low-dose mammography" means the x-ray examination of the5breast using equipment dedicated specifically for mammography,6including the x-ray tube, filter, compression device, and7image receptor, with an average radiation exposure delivery of8less than one rad per breast for 2 views of an average size9breast. The term also includes digital mammography.10 (d-5) Coverage as described by subsection (d) shall be11provided at no cost to the insured and shall not be applied to12an annual or lifetime maximum benefit.13 (d-10) When health care services are available through14contracted providers and a person does not comply with plan15provisions specific to the use of contracted providers, the16requirements of subsection (d-5) are not applicable. When a17person does not comply with plan provisions specific to the18use of contracted providers, plan provisions specific to the19use of non-contracted providers must be applied without20distinction for coverage required by this Section and shall be21at least as favorable as for other radiological examinations22covered by the policy or contract.23 (d-15) If a county, including a home rule county, is a24self-insurer for purposes of providing health insurance25coverage for its employees, the insurance coverage shall26include mastectomy coverage, which includes coverage forSB2770 Enrolled - 6 - LRB104 16719 RTM 30125 b1prosthetic devices or reconstructive surgery incident to the2mastectomy. Coverage for breast reconstruction in connection3with a mastectomy shall include:4 (1) reconstruction of the breast upon which the5 mastectomy has been performed;6 (2) surgery and reconstruction of the other breast to7 produce a symmetrical appearance; and8 (3) prostheses and treatment for physical9 complications at all stages of mastectomy, including10 lymphedemas.11Care shall be determined in consultation with the attending12physician and the patient. The offered coverage for prosthetic13devices and reconstructive surgery shall be subject to the14deductible and coinsurance conditions applied to the15mastectomy, and all other terms and conditions applicable to16other benefits. When a mastectomy is performed and there is no17evidence of malignancy then the offered coverage may be18limited to the provision of prosthetic devices and19reconstructive surgery to within 2 years after the date of the20mastectomy. As used in this Section, "mastectomy" means the21removal of all or part of the breast for medically necessary22reasons, as determined by a licensed physician.23 A county, including a home rule county, that is a24self-insurer for purposes of providing health insurance25coverage for its employees, may not penalize or reduce or26limit the reimbursement of an attending provider or provideSB2770 Enrolled - 7 - LRB104 16719 RTM 30125 b1incentives (monetary or otherwise) to an attending provider to2induce the provider to provide care to an insured in a manner3inconsistent with this Section.4 (d-20) The requirement that mammograms be included in5health insurance coverage as provided in subsections (d)6through (d-15) is an exclusive power and function of the State7and is a denial and limitation under Article VII, Section 6,8subsection (h) of the Illinois Constitution of home rule9county powers. A home rule county to which subsections (d)10through (d-15) apply must comply with every provision of those11subsections.12 (d-25) If a county, including a home rule county, is a13self-insurer for purposes of providing health insurance14coverage, the insurance coverage shall include joint mental15health therapy services for any member of the sheriff's16office, including the sheriff, and any spouse or partner of17the member who resides with the member.18 The joint mental health therapy services provided under19this subsection shall be performed by a physician licensed to20practice medicine in all of its branches, a licensed clinical21psychologist, a licensed clinical social worker, a licensed22clinical professional counselor, a licensed marriage and23family therapist, a licensed social worker, or a licensed24professional counselor.25 This subsection is a limitation under subsection (i) of26Section 6 of Article VII of the Illinois Constitution on theSB2770 Enrolled - 8 - LRB104 16719 RTM 30125 b1concurrent exercise by home rule units of powers and functions2exercised by the State.3 (e) The term "employees" as used in this Section includes4elected or appointed officials but does not include temporary5employees.6 (f) The county board may, by ordinance, arrange to provide7group life, health, accident, hospital, and medical insurance,8or any one or a combination of those types of insurance, under9this Section to retired former employees and retired former10elected or appointed officials of the county.11 (g) Rulemaking authority to implement this amendatory Act12of the 95th General Assembly, if any, is conditioned on the13rules being adopted in accordance with all provisions of the14Illinois Administrative Procedure Act and all rules and15procedures of the Joint Committee on Administrative Rules; any16purported rule not so adopted, for whatever reason, is17unauthorized.18 (h) If a county, including a home rule county, is a19self-insurer for purposes of providing health insurance20coverage for its employees, the insurance coverage shall21include, on and after June 1, 2025, mental health counseling22for any county employee who is a first responder without23imposing a deductible, coinsurance, copayment, or any other24cost-sharing requirement on the coverage provided, except that25this subsection does not apply to the extent such coverage26would disqualify a high-deductible health plan fromSB2770 Enrolled - 9 - LRB104 16719 RTM 30125 b1eligibility for a health savings account pursuant to Section2223 of the Internal Revenue Code.3 The requirement that mental health counseling be included4in health insurance coverage as provided in this subsection is5an exclusive power and function of the State and is a denial6and limitation under Article VII, Section 6, subsection (h) of7the Illinois Constitution of home rule county powers.8 As used in this subsection:9 "First responders" means police and corrections officers; [,]10deputy sheriffs; [,] firefighters; [,] emergency medical services11personnel, as that term is defined in Section 3.5 of the12Emergency Medical Services (EMS) Systems Act, dispatched13pursuant to a 9-1-1 call; [,] emergency medical dispatchers, as14that term is defined in Section 3.70 of the Emergency Medical15Services (EMS) Systems Act; [,] public safety telecommunicators,16as that term is defined in Section 2 of the Emergency Telephone17System Act, and mental health professionals employed and18dispatched by any unit of local government in response to19emergency crisis calls received on public emergency service20lines instead of or in conjunction with law enforcement;21county medical examiners or coroners; and deputy county22medical examiners or deputy coroners.23 "Mental health counseling" means counseling therapy24sessions provided by a clinical social worker, professional25counselor, or licensed psychologist.26(Source: P.A. 103-808, eff. 1-1-26; 103-818, eff. 1-1-25;SB2770 Enrolled - 10 - LRB104 16719 RTM 30125 b1103-1011, eff. 1-1-25; 104-417, eff. 8-15-25.)2 Section 10. The Illinois Municipal Code is amended by3changing Section 10-4-2.4 as follows:4 (65 ILCS 5/10-4-2.4)5 Sec. 10-4-2.4. Reinserts the provisions of the introduced bill with the following changes. Provides that deputy county medical examiners and deputy coroners (in addition to county medical examiners and coroners) are first responders for the purposes of provisions requiring a county to provide health insurance coverage for its employees who are first responders without imposing a deductible, coinsurance, copayment, or any other cost-sharing requirement.
