7An Act relating to nondisclosure agreements;
           prohibiting municipalities from entering into certain
8agreements; providing certain exceptions; prohibiting
           counties from entering into certain agreements;
9providing certain exceptions; and providing for
           codification.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13      SECTION 1.  NEW LAW  A new section of law to be codified
14 in the Oklahoma Statutes as Section 22-101.4 of Title 11, unless
15 there is created a duplication in numbering, reads as follows:
16      A.   Except as provided in subsection B of this section, no
17 municipality shall enter into any agreement with a person,
18 partnership, limited partnership, limited liability partnership,
19 corporation, limited liability company, trust, or other legal entity
20 that would prohibit the municipality from making disclosure of the
21 terms of any agreement with such entity that would make payment to
22 or confer value upon such entity using an incentive, tax credit,
23 direct or indirect payment, grant, or similar benefit offered to the
24

1  entity if the benefit is provided through the use of municipal
2  taxes.
3B.   The provisions of subsection A of this section shall not
4  require a municipality to disclose information of a proprietary
5  nature with respect to a for-profit business entity if the
6  information has been provided to the municipality by or on behalf of
7  the for-profit business entity.  Such information shall include, but
8  not be limited to, trade secrets, the cost of inputs used or
9  consumed by the for-profit business entity, the labor costs of the
10 for-profit business entity, or information related to profit margins
11 on goods or services sold by the for-profit business entity.
12      SECTION 2.  NEW LAW  A new section of law to be codified
13 in the Oklahoma Statutes as Section 1510 of Title 19, unless there
14 is created a duplication in numbering, reads as follows:
15      A.   Except as provided in subsection B of this section, no
16 county shall enter into any agreement with a person, partnership,
17 limited partnership, limited liability partnership, corporation,
18 limited liability company, trust, or other legal entity that would
19 prohibit the county from making disclosure of the terms of any
20 agreement with such entity that would make payment to or confer
21 value upon such entity using an incentive, tax credit, direct or
22 indirect payment, grant, or similar benefit offered to the entity if
23 the benefit is provided through the use of county taxes.

1B.   The provisions of subsection A of this section shall not
