11An Act relating to education; allowing public schools
          to provide annual instruction to students on firearm
12safety; requiring the Council on Law Enforcement
          Education and Training to consult with the Department
13of Education; mandating the development or approval
          of an appropriate program; allowing certain topics to
14be taught to certain grades; prohibiting certain
          viewpoints and live firearm rounds; requiring opt out
15option for districts requiring the instruction;
          allowing schools to begin instruction earlier if
16appropriate; providing an effective date; and
          declaring an emergency.

20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
21      SECTION 1.  NEW LAW  A new section of law to be codified
22 in the Oklahoma Statutes as Section 11-103.6q of Title 70, unless
23 there is created a duplication in numbering, reads as follows:

1A.   Beginning with the 2026-2027 school year, every public
2  school in this state may annually provide students with age-
3  appropriate and grade-appropriate instruction on firearm safety.
4  The Council on Law Enforcement Education and Training (CLEET), in
5  consultation with the Department of Education, shall determine the
6  earliest appropriate age and grade for which firearm safety
7  instruction may be provided.  In determining the earliest
8  appropriate grade for instruction on firearm safety, the Department
9  shall study all relevant data and risk factors, including the
10 earliest age at which incidents of injury involving firearms are
11 reported and the earliest age at which children are susceptible to
12 harm from found firearms.  For purposes of this section, "public
13 schools" shall include charter schools and virtual charter schools.
14      B.   1.    The Council on Law Enforcement Education and Training,
15 in consultation with the Department of Education, shall develop or
16 approve a curriculum or program of instruction on firearm safety.
17 The departments shall not approve curricula or programs of
18 instruction if the curricula, programs of instruction, or any
19 materials used as part of the curricula or programs of instruction
20 bear a brand or organizational affiliation.  Notwithstanding the
21 provisions of this subsection, curricula, programs of instruction,
22 or any of the instructional materials used to educate students on
23 firearm safety in accordance with this section may bear a brand
24

1  issued by the State of Oklahoma or by any state department, agency,
2  or division.
32.   The instruction provided pursuant to subsection A of this
4  section may be provided in a classroom setting, through the viewing
5  of a video, or through the review of online resources or materials,
6  as determined by the Department of Education.
73.   Each school may determine how best to incorporate the
8  instruction provided pursuant to subsection A of this section into
9  the school year.        Instruction by a CLEET-certified school resource
10 officer, or local member of law enforcement currently certified by
11 CLEET, shall be considered best practice.
12      C.   The instruction provided pursuant to subsection A of this
13 section shall be age-appropriate and shall adhere to the following:
14      1.   Kindergarten through fifth grade students shall be taught
15 basic firearm safety including, but not limited to:
16a.     stop,
17b.     do not touch,
18c.     leave the area, and
19d.     tell an adult;
20      2.   Students in grades six through twelve shall be provided
21 instruction on best practices and guidelines for safe handling and
22 storage of a firearm to prevent accidents and ensure safety.       Such
23 instruction shall include, but not be limited to, teaching students:
24a.     safe storage of firearms,

1b.     school safety relating to firearms,
2c.     how to avoid injury if the student finds a firearm,
3d.     to never touch a found firearm, and
4e.     to immediately notify an adult of the location of a
5found firearm;
63.   All instruction shall be viewpoint neutral on political
7  topics such as gun rights and gun violence; and
84.   Instruction shall not include the use or presence of live
9  ammunition, live fire, or live firearms.
10      D.   If a school district decides to require firearm safety
11 instruction to students, each school within said district shall
12 notify parents and legal guardians of the required instruction and
13 include an option with details on how to opt their student out of
14 said instruction.        A school may provide an alternative educational
15 activity to a student whose parent or legal guardian has opted them
16 out of the firearm safety instruction.
17      E.   Each public school may begin firearm instruction at the
18 grade level determined by CLEET in accordance with subsection A of
19 this section.       A public school may elect to begin age-appropriate
20 firearm instruction earlier than the earliest grade level determined
21 by CLEET if appropriate for its school district.
22      SECTION 2.      This act shall become effective July 1, 2026.
23      SECTION 3.      It being immediately necessary for the preservation
24 of the public peace, health or safety, an emergency is hereby

1  declared to exist, by reason whereof this act shall take effect and
2  be in full force from and after its passage and approval.
