h696/introduced.txtBILL AS INTRODUCED H.6962026 Page 1 of 21H.6962 Introduced by Representative Greer of Bennington3 Referred to Committee on4 Date:5 Subject: Municipal and county government; municipal charters; Town of6Bennington; amendments7 Statement of purpose of bill as introduced: This bill proposes to approve8 amendments to the charter of the Town of Bennington to establish first priority9 for municipal liens resulting from fines.10 An act relating to approval of amendments to the charter of the Town of11 Bennington concerning municipal liens12 It is hereby enacted by the General Assembly of the State of Vermont:13 Sec. 1. CHARTER AMENDMENT APPROVAL14 The General Assembly approves the amendments to the charter of the Town15 of Bennington as set forth in this act. The voters approved the proposal of16 amendment on March 4, 2025.17 Sec. 2. 24 App. V.S.A. chapter 103 is amended to read:18CHAPTER 103. TOWN OF BENNINGTON19***VT LEG #383310 v.1BILL AS INTRODUCED H.6962026 Page 2 of 21 § 807. PRIORITY OF MUNICIPAL LIENS2 The filing of a notice of lien resulting from a judgment by a court of3 competent jurisdiction for fines in an enforcement proceeding under the4 Town’s Land Use Regulations; Property Maintenance Ordinance; or Housing,5 Building, and Life Safety Ordinance shall have priority in law over any other6 lien having priority in time. The underlying enforcement lien shall remain a7 valid and subsisting lien upon the real property until the fines are fully paid or8 otherwise discharged, but not longer than eight years from the date of the9 judgment, unless it shall have been renewed pursuant to State law.10 Sec. 3. EFFECTIVE DATE11 This act shall take effect on passageVT LEG #383310 v.1
