7 Statement of purpose of bill as introduced: This bill proposes to approve
8 amendments to the charter of the Town of Bennington to establish first priority
9 for municipal liens resulting from fines.
10    An act relating to approval of amendments to the charter of the Town of
11    Bennington concerning municipal liens
12 It is hereby enacted by the General Assembly of the State of Vermont:
13 Sec. 1. CHARTER AMENDMENT APPROVAL
14    The General Assembly approves the amendments to the charter of the Town
15 of Bennington as set forth in this act. The voters approved the proposal of
16 amendment on March 4, 2025.
17 Sec. 2. 24 App. V.S.A. chapter 103 is amended to read:

1 § 807. PRIORITY OF MUNICIPAL LIENS
2    The filing of a notice of lien resulting from a judgment by a court of
3 competent jurisdiction for fines in an enforcement proceeding under the
4 Town’s Land Use Regulations; Property Maintenance Ordinance; or Housing,
5 Building, and Life Safety Ordinance shall have priority in law over any other
6 lien having priority in time. The underlying enforcement lien shall remain a
7 valid and subsisting lien upon the real property until the fines are fully paid or
8 otherwise discharged, but not longer than eight years from the date of the
9 judgment, unless it shall have been renewed pursuant to State law.
10 Sec. 3. EFFECTIVE DATE
11    This act shall take effect on passage
