NEW LAW A new section of law to be codified13 in the Oklahoma Statutes as Section 520 of Title 12, unless there is14 created a duplication in numbering, reads as follows:15 A. As used in this act:16 1. “Guest” means a person other than the renter whose stay at a17 property is included in an agreement through a short-term rental18 platform for a short-term rental between the owner and the renter;19 2. “Owner” means any person whose ownership interest appears on20 the most recently filed deed or instrument recorded with the county21 clerk in the county where the property is located, or any property22 manager or other person designated by the owner to manage or oversee23 a short-term rental property;24ENGR. S. B. NO. 1769 Page 11 3. “Renter” means any person who has entered into an agreement2 through a short-term rental platform for a short-term rental;3 4. “Short-term rental” means any lease, license, or agreement4 allowing occupancy of a residential property, or a portion of a5 residential property, for less than thirty (30) consecutive days in6 exchange for compensation; and7 5. “Short-term rental platform” means any online marketplace,8 website, application, digital service, or other similar platform9 that advertises, lists, brokers, or facilitates bookings of short-10 term rentals.11 B. 1. Any owner who utilizes his or her property as a short-12 term rental property in this state may, after the agreement for a13 short-term rental has been completed between the renter and such14 owner, require the submission of a photograph or other digital15 representation of the identification of such renter and any16 associated guests, provided that the owner informs the renter of17 such requirement prior to the agreement being completed.18 2. An owner who finds a discrepancy between the information19 submitted by a renter in the agreement for a short-term rental and20 the identification provided by such renter shall have the right to21 cancel such agreement without penalty.22 C. Any short-term rental platform operating in this state shall23 allow the option for owners to request identification, as provided24 for in paragraph 1 of subsection B of this section, and to cancelENGR. S. B. NO. 1769 Page 21 agreements without penalty, as provided for in paragraph 2 of2 subsection B of this section.3 SECTION 2.
