hb3972/enrolled.txtAn ActENROLLED HOUSEBILL NO. 3972 By: Caldwell (Trey) of theHouseandKern of the SenateAn Act relating to public finance; amending 62 O.S.2021, Section 193, which relates to the Ad ValoremReimbursement Fund; authorizing reimbursement toschool districts of revenue losses related to certainproperty purchases by the state; limitingreimbursement; modifying reimbursement priority undercertain circumstances; and declaring an emergency.SUBJECT: Public financeBE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:SECTION 1. AMENDATORY 62 O.S. 2021, Section 193, isamended to read as follows:Section 193. A. There is hereby created in the State Treasurya revolving fund for the Oklahoma Tax Commission to be designatedthe "Ad Valorem Reimbursement Fund". The fund shall be a continuingfund, not subject to fiscal year limitations. Monies apportioned tothis fund shall be expended:1. To reimburse counties of this state for loss of revenue dueto exemptions of ad valorem taxes for new or expanded manufacturingor research and development facilities;2. Beginning calendar year 2022 and all subsequent years, toreimburse qualified counties of this state for loss of revenue dueto exemptions granted to veterans and their surviving spousespursuant to the provisions of Sections 8D, 8E and 8F of Article X ofthe Oklahoma Constitution. A county is qualified for reimbursementif the number of exemptions granted to veterans and survivingspouses for the most recently concluded calendar year exceeds eight-tenths of one percent (0.8%) of the total county populationaccording to the latest Federal Decennial Census or most recentannual population estimate, whichever is most recent. Thereimbursement provided in this paragraph shall amount to twenty-fivepercent (25%) of the loss of revenue claimed by the qualifiedcounty;3. To reimburse counties of this state for loss of revenue forschool district and county purposes due to exemptions grantedpursuant to the provisions of Section 2890 of Title 68 of theOklahoma Statutes; and4. To reimburse counties of this state for loss of revenue dueto decreased valuation and assessment for buffer strips pursuant toSection 2817.2 of Title 68 of the Oklahoma Statutes; and5. To reimburse counties of this state for loss of revenue forschool district purposes due to a purchase by the state of propertylocated in the county for an amount greater than Three HundredMillion Dollars ($300,000,000.00); provided, such purchase occurredon or after January 1, 2025; further provided, such reimbursement belimited to the first two (2) tax years following such purchase.Provided that it shall be the duty of the Tax Commission toassess the valuation of all property for new or expandedmanufacturing or research and development facilities which areexempt from ad valorem taxes.Monies apportioned to this fund also may be transferred to otherstate funds or otherwise expended as directed by the Legislature bylaw.B. The county commissioners of each county seekingreimbursement for lost revenue from the Ad Valorem ReimbursementFund shall make claims for reimbursement on forms prescribed by theTax Commission prior to April 30 of each year. Claims forreimbursement for loss of revenue based upon the type of exemptionsauthorized pursuant to subsection A of this section. Provided, theassessed valuation of a school district as stated in the claim forreimbursement shall be the same as reported to the State Departmentof Education on the Estimate of Need and shall include the totalvaluation of property exempt from taxation pursuant to Section 2902of Title 68 of the Oklahoma Statutes. The claims shall be eitherapproved or disapproved in whole or in part by the Tax Commission byENR. H. B. NO. 3972 Page 2June 15 of each year. A claim for reimbursement for loss of revenuedue to an exemption of ad valorem taxes for a new or expandedmanufacturing or research and development facility shall bedisapproved if a county or school district has received any paymentin lieu of ad valorem taxes from such facility, to the extent of theamount of such reimbursement. If the Tax Commission determines thatan exemption has been erroneously or unlawfully granted, it shallnotify the appropriate county assessor who shall immediately valueand assess the property and place it on the rolls for ad valoremtaxation. Disbursements from the fund shall be made on warrantsissued by the State Treasurer against claims filed by the TaxCommission with the Office of Management and Enterprise Services forpayment. Such disbursements shall be exempt from all agencyexpenditure ceilings. The county treasurer shall apportion ordisburse such funds for expenditures in the same manner as other advalorem tax collections.C. In the event monies apportioned to the Ad ValoremReimbursement Fund are insufficient to pay all claims forreimbursement made pursuant to subsection B of this section, claimsfor reimbursement for loss of revenue due to exemptions of advalorem taxes for new or expanded manufacturing or research anddevelopment facilities, and claims for reimbursement for loss ofrevenue due to purchases of property by the state shall be paidfirst, and any remaining funds shall be distributed proportionallyamong the counties making claims for reimbursement for loss ofrevenue for school district and county purposes due to exemptionsgranted pursuant to the provisions of Sections 8D, 8E and 8F ofArticle X of the Oklahoma Constitution, if applicable, according tothe amount of the claim made by each county. If any funds remainafter paying all claims for reimbursement for loss of revenue due toexemptions of ad valorem taxation for new or expanded manufacturingor research and development facilities and for reimbursement forloss of revenue for school district and county purposes due toexemptions granted pursuant to the provisions of Sections 8D, 8E and8F of Article X of the Oklahoma Constitution, the remaining fundsshall be distributed proportionally among the counties making claimsfor reimbursement for the exemptions granted pursuant to theprovisions of Section 2890 of Title 68 of the Oklahoma Statutes andfor the loss of revenue for decreased valuation and assessment forbuffer strips pursuant to Section 2817.2 of Title 68 of the OklahomaStatutes.SECTION 2. It being immediately necessary for the preservationof the public peace, health or safety, an emergency is herebyENR. H. B.
