hb5450/engrossed.txtHOUSE BILL NO. 5450A bill to amend 2000 PA 92, entitled"Food law,"by amending section 3113 (MCL 289.3113), as amended by2016 PA 188.the people of the state of michigan enact:Sec. 3113. (1) Acounty, city, village, or township shall not regulate those aspects of foodservice establishments that are subject to regulation under this act except tothe extent necessary to carry out the responsibility of a local healthdepartment to implement licensing provisions of chapter IV. This chapter section doesnot relieve the an applicantfor a license or a licensee from responsibility for securing a local permit orcomplying with applicable local codes, regulations, or ordinances not in conflictwith this act.(2) A county,city, village, or township shall not adopt a rule, regulation, code, orordinance that imposes or collects a fee, tax, or assessment for the operationof a mobile food establishment.
