Wilson, Dhingra, Hasegawa,Nobles, Pedersen, Saldaña, Stanford, Trudeau, and Valdez)READ FIRST TIME 01/29/26.1 AN ACT Relating to coverage for HIV antiviral drugs; reenacting2 and amending RCW 41.05.017; and adding a new section to chapter 48.433 RCW.4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5 NEW SECTION. Sec. 1. A new section is added to chapter 48.436 RCW to read as follows:7 (1) For health plans issued or renewed on or after January 1,8 2027, except as provided in subsection (2) of this section, a health9 carrier shall provide coverage for all federal food and drug10 administration approved HIV antiviral drugs without prior11 authorization, step therapy, or any other utilization management12 protocols.13 (2) If the United States food and drug administration has14 approved one or more therapeutic equivalents of a drug, device, or15 product for the prevention or treatment of HIV, this section does not16 require a health plan to cover all of the therapeutically equivalent17 versions without prior authorization, step therapy, or any other18 utilization management protocols, if at least one therapeutically19 equivalent version is covered without prior authorization, step20 therapy, or any other utilization management protocols.p. 1 SSB 6183.SL1 Sec. 2.
