4   General Description:
5This bill addresses procurement of landscape maintenance equipment.
6   Highlighted Provisions:

9▸ subject to specified exceptions, requires that when a state entity procures landscape
10   maintenance equipment, the landscape maintenance equipment be electric-powered.

19   Be it enacted by the Legislature of the state of Utah:
20Section 1. Section 63G-6a-111.1 is enacted to read:
2163G-6a-111.1 . Requirements for landscape maintenance equipment.
22   (1) As used in this section:
23(a) "Electric-powered" means operated using electricity as the primary power source.
24(b)(i) "Landscape maintenance" means routine care of outdoor vegetation and
25associated elements, including mulch, gravel, flower beds, and decorative barriers.
26(ii) "Landscape maintenance" includes mowing, edging, trimming, fertilizing, raking,
27and blowing.
28(c) "Landscape maintenance equipment" means any device that is primarily designed for
29the performance of landscape maintenance.

30(d) "State agency" means any unit of state government, including a department, division,
31office, or institution of higher education.
32(e) "State government facility" means a building, structure, or other improvement that is
33constructed on property owned by the state or a state agency.
34(f) "State government grounds" means the real property, whether fenced or unfenced, on
35which a state government facility is located.
36    (2) Subject to Subsection (3), when a procurement unit procures new landscape
37maintenance equipment to replace end-of-life, Ĥ→ two-stroke ←Ĥ gasoline-powered

38equipment to be used primarily on state government grounds, the procurement unit shall
39procure landscape maintenance equipment that is electric-powered if the state
40government grounds:
41(a) are located in a county of the first or second class, as classified under Section
4217-60-104; and
43(b) consist of fewer than 50,000 square feet of property needing landscape maintenance.
44    (3) The director of the Division of Facilities Construction and Management created in
45Section 63A-5b-301 may exempt a procurement unit, or a specific procurement
46transaction, from the requirements of Subsection (2) if:
47(a) using electric-powered landscape maintenance equipment is not practical due to the
48existing slope, erosion, stoniness, or other features of the landscape where the
49equipment is to be used;
50(b) there is an emergency and using electric-powered landscape maintenance equipment
51is impractical to maintaining the safe and operational condition of the property where
52the equipment is to be used; or
53(c) the director, in consultation with the procurement unit, makes a written finding that
54the requirements of Subsection (2) are cost-prohibitive.
55Section 2. Effective Date.
56    This bill takes effect on May 6, 2026.
