Stratton23 LONG TITLE4 General Description:5 This bill modifies provisions related to the classification of certain government records.6 Highlighted Provisions:7 This bill:8 ▸ amends the definition of "initial contact report" for purposes of the Government Records9 Access and Management Act;10 ▸ classifies as public any record that documents a governmental entity's receipt or11 expenditure of funds, including:12● a record related to a financial account, budget, voucher, or grant;13● a financial report or general ledger; and14● a record documenting compensation a governmental entity pays to a vendor;15 ▸ if properly classified by the governmental entity, makes private any portion of a record16 that reveals whether a taxpayer receives a specified property tax exemption, deferral,17 abatement, or other relief; and18 ▸ makes technical and conforming changes.19 Money Appropriated in this Bill:20 None21 Other Special Clauses:22 None23 Utah Code Sections Affected:24 AMENDS:25 63G-2-103, as last amended by Laws of Utah 2025, First Special Session, Chapter 1726 63G-2-301, as last amended by Laws of Utah 2025, First Special Session, Chapter 927 63G-2-302, as last amended by Laws of Utah 2025, Chapter 172H.B. 325 Enrolled Copy2829 Be it enacted by the Legislature of the state of Utah:30Section 1. Section 63G-2-103 is amended to read:3163G-2-103 . Definitions.32 As used in this chapter:33 (1) "Audit" means:34(a) a systematic examination of financial, management, program, and related records for35the purpose of determining the fair presentation of financial statements, adequacy of36internal controls, or compliance with laws and regulations; or37(b) a systematic examination of program procedures and operations for the purpose of38determining their effectiveness, economy, efficiency, and compliance with statutes39and regulations.40 (2) "Chief administrative officer" means the chief administrative officer of a governmental41entity who is responsible to fulfill the duties described in Section 63A-12-103.42 (3) "Chronological logs" mean the regular and customary summary records of law43enforcement agencies and other public safety agencies that show:44(a) the time and general nature of police, fire, and paramedic calls made to the agency;45and46(b) any arrests or jail bookings made by the agency.47 (4) "Classification," "classify," and their derivative forms mean determining whether a48record series, record, or information within a record is public, private, controlled,49protected, or exempt from disclosure under Subsection 63G-2-201(3)(b).50 (5)(a) "Computer program" means:51(i) a series of instructions or statements that permit the functioning of a computer52system in a manner designed to provide storage, retrieval, and manipulation of53data from the computer system; and54(ii) any associated documentation and source material that explain how to operate the55computer program.56(b) "Computer program" does not mean:57(i) the original data, including numbers, text, voice, graphics, and images;58(ii) analysis, compilation, and other manipulated forms of the original data produced59by use of the program; or60(iii) the mathematical or statistical formulas, excluding the underlying mathematical61algorithms contained in the program, that would be used if the manipulated forms-2-Enrolled Copy H.B. 32562of the original data were to be produced manually.63 (6)(a) "Contractor" means:64(i) any person who contracts with a governmental entity to provide goods or services65directly to a governmental entity; or66(ii) any private, nonprofit organization that receives funds from a governmental entity.67 (b) "Contractor" does not mean a private provider.68 (7) "Controlled record" means a record containing data on individuals that is controlled as69 provided by Section 63G-2-304.70 (8) "Designation," "designate," and their derivative forms mean indicating, based on a71 governmental entity's familiarity with a record series or based on a governmental entity's72 review of a reasonable sample of a record series, the primary classification that a73 majority of records in a record series would be given if classified and the classification74 that other records typically present in the record series would be given if classified.75 (9) "Elected official" means each person elected to a state office, county office, municipal76 office, school board or school district office, special district office, or special service77 district office, but does not include judges.78 (10) "Explosive" means a chemical compound, device, or mixture:79 (a) commonly used or intended for the purpose of producing an explosion; and80 (b) that contains oxidizing or combustive units or other ingredients in proportions,81quantities, or packing so that:82(i) an ignition by fire, friction, concussion, percussion, or detonator of any part of the83compound or mixture may cause a sudden generation of highly heated gases; and84(ii) the resultant gaseous pressures are capable of:85(A) producing destructive effects on contiguous objects; or86(B) causing death or serious bodily injury.87 (11) "Government audit agency" means any governmental entity that conducts an audit.88 (12)(a) "Governmental entity" means:89(i) executive department agencies of the state, the offices of the governor, lieutenant90governor, state auditor, attorney general, and state treasurer, the Board of Pardons91and Parole, the Board of Examiners, the National Guard, the Career Service92Review Office, the State Board of Education, the Utah Board of Higher93Education, and the State Archives;94(ii) the Office of the Legislative Auditor General, Office of the Legislative Fiscal95Analyst, Office of Legislative Research and General Counsel, the Legislature, and-3-H.B. 325 Enrolled Copy96legislative committees, except any political party, group, caucus, or rules or sifting97committee of the Legislature;98(iii) courts, the Judicial Council, the Administrative Office of the Courts, and similar99administrative units in the judicial branch;100(iv) any state-funded institution of higher education or public education; or101(v) any political subdivision of the state, but, if a political subdivision has adopted an102ordinance or a policy relating to information practices pursuant to Section10363G-2-701, this chapter shall apply to the political subdivision to the extent104specified in Section 63G-2-701 or as specified in any other section of this chapter105that specifically refers to political subdivisions.106(b) "Governmental entity" also means:107(i) every office, agency, board, bureau, committee, department, advisory board, or108commission of an entity listed in Subsection (12)(a) that is funded or established109by the government to carry out the public's business;110(ii) as defined in Section 11-13-103, an interlocal entity or joint or cooperative111undertaking, except for the Water District Water Development Council created112pursuant to Section 11-13-228;113(iii) as defined in Section 11-13a-102, a governmental nonprofit corporation;114(iv) an association as defined in Section 53G-7-1101;115(v) the Utah Independent Redistricting Commission; and116(vi) a law enforcement agency, as defined in Section 53-1-102, that employs one or117more law enforcement officers, as defined in Section 53-13-103.118(c) "Governmental entity" does not include the Utah Educational Savings Plan created in119Section 53H-10-202.120 (13) "Government Records Office" means the same as that term is defined in Section12163A-12-201.122 (14) "Gross compensation" means every form of remuneration payable for a given period to123an individual for services provided including salaries, commissions, vacation pay,124severance pay, bonuses, and any board, rent, housing, lodging, payments in kind, and125any similar benefit received from the individual's employer.126 (15) "Individual" means a human being.127 (16)(a) "Initial contact report" means an initial written or recorded report, however128titled, prepared by peace officers engaged in public patrol or response duties129describing official actions initially taken in response to either a public complaint-4-Enrolled Copy H.B. 325130 about or the discovery of an apparent violation of law, which report may describe:131(i) the date, time, location, and nature of the complaint, the incident, or offense;132[(ii) names of victims;]133[(iii)] (ii) the nature or general scope of the agency's initial actions taken in response134to the incident;135[(iv)] (iii) the general nature of any injuries or estimate of damages sustained in the136incident;137[(v)] (iv) the name, address, and other identifying information about any person138arrested or charged in connection with the incident; or139[(vi)] (v) the identity of the public safety personnel, except undercover personnel, or140prosecuting attorney involved in responding to the initial incident.141 (b) Initial contact reports do not include follow-up or investigative reports prepared after142the initial contact report. However, if the information specified in Subsection (16)(a)143appears in follow-up or investigative reports, it may only be treated confidentially if144it is private, controlled, protected, or exempt from disclosure under Subsection14563G-2-201(3)(b).146 (c) Initial contact reports do not include accident reports, as that term is described in147Title 41, Chapter 6a, Part 4, Accident Responsibilities.148 (17) "Legislative body" means the Legislature.149 (18) "Notice of compliance" means a statement confirming that a governmental entity has150 complied with an order of the director of the Government Records Office.151 (19) "Person" means:152 (a) an individual;153 (b) a nonprofit or profit corporation;154 (c) a partnership;155 (d) a sole proprietorship;156 (e) other type of business organization; or157 (f) any combination acting in concert with one another.158 (20) "Private provider" means any person who contracts with a governmental entity to159 provide services directly to the public.160 (21) "Private record" means a record containing data on individuals that is private as161 provided by Section 63G-2-302.162 (22) "Protected record" means a record that is classified protected as provided by Section163 63G-2-305.-5-H.B. 325 Enrolled Copy164 (23) "Public record" means a record that is not private, controlled, or protected and that is165not exempt from disclosure as provided in Subsection 63G-2-201(3)(b).166 (24) "Reasonable search" means a search that is:167(a) reasonable in scope and intensity; and168(b) not unreasonably burdensome for the government entity.169 (25)(a) "Record" means a book, letter, document, paper, map, plan, photograph, film,170card, tape, recording, electronic data, or other documentary material regardless of171physical form or characteristics:172(i) that is prepared, owned, received, or retained by a governmental entity or political173subdivision; and174(ii) where all of the information in the original is reproducible by photocopy or other175mechanical or electronic means.176(b) "Record" does not include:177(i) a personal note or personal communication prepared or received by an employee178or officer of a governmental entity:179(A) in a capacity other than the employee's or officer's governmental capacity; or180(B) that is unrelated to the conduct of the public's business;181(ii) a temporary draft or similar material prepared for the originator's personal use or182prepared by the originator for the personal use of an individual for whom the183originator is working;184(iii) material that is legally owned by an individual in the individual's private capacity;185(iv) material to which access is limited by the laws of copyright or patent unless the186copyright or patent is owned by a governmental entity or political subdivision;187(v) proprietary software;188(vi) junk mail or a commercial publication received by a governmental entity or an189official or employee of a governmental entity;190(vii) a book that is cataloged, indexed, or inventoried and contained in the collections191of a library open to the public;192(viii) material that is cataloged, indexed, or inventoried and contained in the193collections of a library open to the public, regardless of physical form or194characteristics of the material;195(ix) a daily calendar[ ];196(x) a note prepared by the originator for the originator's own use or for the sole use of197an individual for whom the originator is working;-6-Enrolled Copy H.B. 325198(xi) a computer program that is developed or purchased by or for any governmental199entity for its own use;200(xii) a note or internal memorandum prepared as part of the deliberative process by:201(A) a member of the judiciary;202(B) an administrative law judge;203(C) a member of the Board of Pardons and Parole; or204(D) a member of any other body, other than an association or appeals panel as205defined in Section 53G-7-1101, charged by law with performing a206quasi-judicial function;207(xiii) a telephone number or similar code used to access a mobile communication208device that is used by an employee or officer of a governmental entity, provided209that the employee or officer of the governmental entity has designated at least one210business telephone number that is a public record as provided in Section21163G-2-301;212(xiv) information provided by the Public Employees' Benefit and Insurance Program,213created in Section 49-20-103, to a county to enable the county to calculate the214amount to be paid to a health care provider under Subsection 17-63-706(2)(e)(ii);215(xv) information that an owner of unimproved property provides to a local entity as216provided in Section 11-42-205;217(xvi) a video or audio recording of an interview, or a transcript of the video or audio218recording, that is conducted at a Children's Justice Center established under219Section 67-5b-102;220(xvii) child sexual abuse material, as defined by Section 76-5b-103;221(xviii) before final disposition of an ethics complaint occurs, a video or audio222recording of the closed portion of a meeting or hearing of:223(A) a Senate or House Ethics Committee;224(B) the Independent Legislative Ethics Commission;225(C) the Independent Executive Branch Ethics Commission, created in Section22663A-14-202; or227(D) the Political Subdivisions Ethics Review Commission established in Section22863A-15-201;229(xix) confidential communication described in Section 58-60-102, 58-61-102, or23058-61-702;231(xx) any item described in Subsection (25)(a) that is:-7-H.B. 325 Enrolled Copy232(A) described in Subsection 63G-2-305(17), (18), or (23)(b); and233(B) shared between any of the following entities:234(I) the Division of Risk Management;235(II) the Office of the Attorney General;236(III) the governor's office; or237(IV) the Legislature;238(xxi) the email address that a candidate for elective office provides to a filing officer239under Subsection 20A-9-201(5)(c)(ii) or 20A-9-203(4)(c)(iv); or240(xxii) except as provided in Sections 31A-16-105, 31A-16-107.5, and 27a-3-303, an241investment policy, or information related to an investment policy, provided to the242insurance commissioner as described in Title 31A, Chapter 18, Investments.243 (26) "Record series" means a group of records that may be treated as a unit for purposes of244designation, description, management, or disposition.245 (27) "Records officer" means the individual appointed by the chief administrative officer of246each governmental entity, or the political subdivision to work with state archives in the247care, maintenance, scheduling, designation, classification, disposal, and preservation of248records.249 (28) "Schedule," "scheduling," and their derivative forms mean the process of specifying250the length of time each record series should be retained by a governmental entity for251administrative, legal, fiscal, or historical purposes and when each record series should be252transferred to the state archives or destroyed.253 (29) "Sponsored research" means research, training, and other sponsored activities as254defined by the federal Executive Office of the President, Office of Management and255Budget:256(a) conducted:257(i) by an institution within the state system of higher education described in Section25853H-1-102; and259(ii) through an office responsible for sponsored projects or programs; and260(b) funded or otherwise supported by an external:261(i) person that is not created or controlled by the institution within the state system of262higher education; or263(ii) federal, state, or local governmental entity.264 (30) "State archives" means the Division of Archives and Records Service created in265Section 63A-12-101.-8-Enrolled Copy H.B. 325266 (31) "State archivist" means the director of the state archives.267 (32) "Summary data" means statistical records and compilations that contain data derived268 from private, controlled, or protected information but that do not disclose private,269 controlled, or protected information.270Section 2. Section 63G-2-301 is amended to read:27163G-2-301 . Public records.272 (1) As used in this section:273 (a) "Business address" means a single address of a governmental agency designated for274the public to contact an employee or officer of the governmental agency.275 (b) "Business email address" means a single email address of a governmental agency276designated for the public to contact an employee or officer of the governmental277agency.278 (c) "Business telephone number" means a single telephone number of a governmental279agency designated for the public to contact an employee or officer of the280governmental agency.281 (d) "Correctional facility" means the same as that term is defined in Section 77-16b-102.282 (2) The following records are public except to the extent they contain information expressly283 permitted to be treated confidentially under the provisions of Subsections284 63G-2-201(3)(b) and (6)(a):285 (a) laws;286 (b) the name, gender, gross compensation, job title, job description, business address,287business email address, business telephone number, number of hours worked per pay288period, dates of employment, and relevant education, previous employment, and289similar job qualifications of a current or former employee or officer of the290governmental entity, excluding:291(i) undercover law enforcement personnel; and292(ii) investigative personnel if disclosure could reasonably be expected to impair the293effectiveness of investigations or endanger any individual's safety;294 (c) final opinions, including concurring and dissenting opinions, and orders that are295made by a governmental entity in an administrative, adjudicative, or judicial296proceeding except that if the proceedings were properly closed to the public, the297opinion and order may be withheld to the extent that they contain information that is298private, controlled, or protected;299 (d) final interpretations of statutes or rules by a governmental entity unless classified as-9-H.B. 325 Enrolled Copy300protected as provided in Subsection 63G-2-305(17) or (18);301 (e) information contained in or compiled from a transcript, minutes, or report of the open302portions of a meeting of a governmental entity as provided by Title 52, Chapter 4,303Open and Public Meetings Act, including the records of all votes of each member of304the governmental entity;305 (f) judicial records unless a court orders the records to be restricted under the rules of306civil or criminal procedure or unless the records are private under this chapter;307 (g) unless otherwise classified as private under Section 63G-2-303, records or parts of308records filed with or maintained by county recorders, clerks, treasurers, surveyors,309zoning commissions, the Division of Forestry, Fire, and State Lands, the School and310Institutional Trust Lands Administration, the Division of Oil, Gas, and Mining, the311Division of Water Rights, or other governmental entities that give public notice of:312(i) titles or encumbrances to real property;313(ii) restrictions on the use of real property;314(iii) the capacity of persons to take or convey title to real property; or315(iv) tax status for real and personal property;316 (h) records of the Department of Commerce that evidence incorporations, mergers, name317changes, and uniform commercial code filings;318 (i) data on individuals that would otherwise be private under this chapter if the319individual who is the subject of the record has given the governmental entity written320permission to make the records available to the public;321 [(j) documentation of the compensation that a governmental entity pays to a contractor322or private provider;]323 [(k)] (j) summary data;324 [(l)] (k) voter registration records, including an individual's voting history, except for a325voter registration record or those parts of a voter registration record that are classified326as private under Subsections 63G-2-302(1)(j) through (n) or withheld under327Subsection 20A-2-104(7);328 [(m)] (l) for an elected official, as defined in Section 11-47-102, a telephone number, if329available, and email address, if available, where that elected official may be reached330as required in Title 11, Chapter 47, Access to Elected Officials;331 [(n)] (m) for a school community council member, a telephone number, if available, and332email address, if available, where that elected official may be reached directly as333required in Section 53G-7-1203;- 10 -Enrolled Copy H.B. 325334 [(o)] (n) annual audited financial statements of the Utah Educational Savings Plan335described in Section 53H-10-210; and336 [(p)] (o) an initiative packet, as defined in Section 20A-7-101, and a referendum packet,337as defined in Section 20A-7-101, after the packet is submitted to a county clerk.338 (3) The following records are normally public, but to the extent that a record is expressly339 exempt from disclosure, access may be restricted under Subsection 63G-2-201(3)(b),340 Section 63G-2-302, 63G-2-304, or 63G-2-305:341 (a) administrative staff manuals, instructions to staff, and statements of policy;342 (b) records documenting a contractor's or private provider's compliance with the terms343of a contract with a governmental entity;344 (c) records documenting the services provided by a contractor or a private provider to345the extent the records would be public if prepared by the governmental entity;346 (d) contracts entered into by a governmental entity;347 [(e) any account, voucher, or contract that deals with the receipt or expenditure of funds348by a governmental entity;]349 (e) records that document a governmental entity's receipt or expenditure of funds,350including:351(i) a record related to a financial account, budget, voucher, or grant;352(ii) a financial report or general ledger; and353(iii) a record that documents the compensation a governmental entity pays to a354contractor, vendor, or private provider;355 (f) records relating to government assistance or incentives publicly disclosed, contracted356for, or given by a governmental entity, encouraging a person to expand or relocate a357business in Utah, except as provided in Subsection 63G-2-305(35);358 (g) chronological logs and initial contact reports;359 (h) correspondence by and with a governmental entity in which the governmental entity360determines or states an opinion upon the rights of the state, a political subdivision,361the public, or any person;362 (i) empirical data contained in drafts if:363(i) the empirical data is not reasonably available to the requester elsewhere in similar364form; and365(ii) the governmental entity is given a reasonable opportunity to correct any errors or366make nonsubstantive changes before release;367 (j) drafts that are circulated to anyone other than:- 11 -H.B. 325 Enrolled Copy368(i) a governmental entity;369(ii) a political subdivision;370(iii) a federal agency if the governmental entity and the federal agency are jointly371responsible for implementation of a program or project that has been legislatively372approved;373(iv) a government-managed corporation; or374(v) a contractor or private provider;375 (k) drafts that have never been finalized but were relied upon by the governmental entity376in carrying out action or policy;377 (l) original data in a computer program if the governmental entity chooses not to378disclose the program;379 (m) arrest warrants after issuance, except that, for good cause, a court may order380restricted access to arrest warrants prior to service;381 (n) search warrants after execution and filing of the return, except that a court, for good382cause, may order restricted access to search warrants prior to trial;383 (o) records that would disclose information relating to formal charges or disciplinary384actions against a past or present governmental entity employee if:385(i) the disciplinary action has been completed and all time periods for administrative386appeal have expired; and387(ii) the charges on which the disciplinary action was based were sustained;388 (p) records maintained by the Division of Forestry, Fire, and State Lands, the School and389Institutional Trust Lands Administration, or the Division of Oil, Gas, and Mining that390evidence mineral production on government lands;391 (q) final audit reports;392 (r) occupational and professional licenses;393 (s) business licenses;394 (t) a notice of violation, a notice of agency action under Section 63G-4-201, or similar395records used to initiate proceedings for discipline or sanctions against persons396regulated by a governmental entity, but not including records that initiate employee397discipline; and398 (u)(i) records that disclose a standard, regulation, policy, guideline, or rule regarding399the operation of a correctional facility or the care and control of inmates400committed to the custody of a correctional facility; and401(ii) records that disclose the results of an audit or other inspection assessing a- 12 -Enrolled Copy H.B. 325402correctional facility's compliance with a standard, regulation, policy, guideline, or403rule described in Subsection (3)(u)(i).404 (4) The list of public records in this section is not exhaustive and should not be used to limit405 access to records.406Section 3. Section 63G-2-302 is amended to read:40763G-2-302 . Private records.408 (1) The following records are private:409 (a) records concerning an individual's eligibility for unemployment insurance benefits,410social services, welfare benefits, or the determination of benefit levels;411 (b) records containing data on individuals describing medical history, diagnosis,412condition, treatment, evaluation, or similar medical data;413 (c) records of publicly funded libraries that when examined alone or with other records414identify a patron;415 (d) records received by or generated by or for:416(i) the Independent Legislative Ethics Commission, except for:417(A) the commission's summary data report that is required under legislative rule;418and419(B) any other document that is classified as public under legislative rule; or420(ii) a Senate or House Ethics Committee in relation to the review of ethics421complaints, unless the record is classified as public under legislative rule;422 (e) records received by, or generated by or for, the Independent Executive Branch Ethics423Commission, except as otherwise expressly provided in Title 63A, Chapter 14,424Review of Executive Branch Ethics Complaints;425 (f) records received or generated for a Senate confirmation committee concerning426character, professional competence, or physical or mental health of an individual:427(i) if, prior to the meeting, the chair of the committee determines release of the428records:429(A) reasonably could be expected to interfere with the investigation undertaken by430the committee; or431(B) would create a danger of depriving a person of a right to a fair proceeding or432impartial hearing; and433(ii) after the meeting, if the meeting was closed to the public;434 (g) employment records concerning a current or former employee of, or applicant for435employment with, a governmental entity that would disclose that individual's home- 13 -H.B. 325 Enrolled Copy436address, home telephone number, social security number, insurance coverage, marital437status, or payroll deductions;438 (h) records or parts of records under Section 63G-2-303 that a current or former439employee identifies as private according to the requirements of that section;440 (i) that part of a record indicating a person's social security number or federal employer441identification number if provided under Section 31A-23a-104, 31A-25-202,44231A-26-202, 58-1-301, 58-55-302, 61-1-4, or 61-2f-203;443 (j) that part of a voter registration record identifying a voter's:444(i) driver license or identification card number;445(ii) social security number, or last four digits of the social security number;446(iii) email address;447(iv) date of birth; or448(v) phone number;449 (k) a voter registration record that is classified as a private record by the lieutenant450governor or a county clerk under Subsection 20A-2-101.1(5)(a), 20A-2-104(4)(h), or45120A-2-204(4)(b);452 (l) a voter registration record that is withheld under Subsection 20A-2-104(7);453 (m) a withholding request form described in Subsections 20A-2-104(7) and (8) and any454verification submitted in support of the form;455 (n) a record or information regarding whether a voter returned a ballot with postage456attached;457 (o) a record that:458(i) contains information about an individual;459(ii) is voluntarily provided by the individual; and460(iii) goes into an electronic database that:461(A) is designated by and administered under the authority of the Chief Information462Officer; and463(B) acts as a repository of information about the individual that can be464electronically retrieved and used to facilitate the individual's online interaction465with a state agency;466 (p) information provided to the Commissioner of Insurance under:467(i) Subsection 31A-23a-115(3)(a);468(ii) Subsection 31A-23a-302(4); or469(iii) Subsection 31A-26-210(4);- 14 -Enrolled Copy H.B. 325470 (q) information obtained through a criminal background check under Title 11, Chapter 40,471Criminal Background Checks by Political Subdivisions Operating Water Systems;472 (r) information provided by an offender that is:473(i) required by the registration requirements of Title 53, Chapter 29, Sex, Kidnap, and474Child Abuse Offender Registry; and475(ii) not required to be made available to the public under Subsection 53-29-404(3)(a);476 (s) a statement and any supporting documentation filed with the attorney general in477accordance with Section 34-45-107, if the federal law or action supporting the filing478involves homeland security;479 (t) electronic toll collection customer account information received or collected under480Section 72-6-118 and customer information described in Section 17B-2a-815481received or collected by a public transit district, including contact and payment482information and customer travel data;483 (u) an email address provided by a military or overseas voter under Section 20A-16-501;484 (v) a completed military-overseas ballot that is electronically transmitted under Title48520A, Chapter 16, Uniform Military and Overseas Voters Act;486 (w) records received by or generated by or for the Political Subdivisions Ethics Review487Commission established in Section 63A-15-201, except for:488(i) the commission's summary data report that is required in Section 63A-15-202; and489(ii) any other document that is classified as public in accordance with Title 63A,490Chapter 15, Political Subdivisions Ethics Review Commission;491 (x) a record described in Section 53G-9-604 that verifies that a parent was notified of an492incident or threat;493 (y) a criminal background check or credit history report conducted in accordance with494Section 63A-3-201;495 (z) a record described in Subsection 53-5a-104(7);496 (aa) on a record maintained by a county for the purpose of administering property taxes,497an individual's:498(i) email address;499(ii) phone number; or500(iii) personal financial information related to a person's payment method;501 (bb) a record submitted by a taxpayer to establish the taxpayer's eligibility for an502exemption, deferral, abatement, or relief under:503(i) Title 59, Chapter 2, Part 11, Exemptions; or- 15 -H.B. 325 Enrolled Copy504(ii) Title 59, Chapter 2a, Tax Relief Through Property Tax;505(cc) a record provided by the State Tax Commission in response to a request under506Subsection 59-1-403(4)(y)(iii);507(dd) a record of the Child Welfare Legislative Oversight Panel regarding an individual508child welfare case, as described in Subsection 36-33-103(3);509(ee) a record relating to drug or alcohol testing of a state employee under Section51063A-17-1004;511(ff) a record relating to a request by a state elected official or state employee who has512been threatened to the Division of Technology Services to remove personal513identifying information from the open web under Section 63A-16-109;514(gg) a record including confidential information as that term is defined in Section51567-27-106; and516(hh) a record or notice received or generated under Title 53, Chapter 30, Security517Improvements Act, relating to:518(i) an application for certification described in Section 53-30-201; or519(ii) a security improvement, including a building permit application or building520permit for a security improvement described in Section 53-30-301.521 (2) The following records are private if properly classified by a governmental entity:522(a) records concerning a current or former employee of, or applicant for employment523with a governmental entity, including performance evaluations and personal status524information such as race, religion, or disabilities, but not including records that are525public under Subsection 63G-2-301(2)(b) or 63G-2-301(3)(o) or private under526Subsection (1)(b);527(b) records describing an individual's finances, except that the following are public:528(i) records described in Subsection 63G-2-301(2);529(ii) information provided to the governmental entity for the purpose of complying530with a financial assurance requirement; or531(iii) records that must be disclosed in accordance with another statute;532(c) records of independent state agencies if the disclosure of those records would533conflict with the fiduciary obligations of the agency;534(d) other records containing data on individuals the disclosure of which constitutes a535clearly unwarranted invasion of personal privacy;536(e) records provided by the United States or by a government entity outside the state that537are given with the requirement that the records be managed as private records, if the- 16 -Enrolled Copy H.B. 325538providing entity states in writing that the record would not be subject to public539disclosure if retained by it;540 (f) any portion of a record in the custody of the Division of Aging and Adult Services,541created in Section 26B-6-102, that may disclose, or lead to the discovery of, the542identity of a person who made a report of alleged abuse, neglect, or exploitation of a543vulnerable adult;[ and]544 (g) audio and video recordings created by a body-worn camera, as defined in Section54577-7a-103, that record sound or images inside a home or residence except for546recordings that:547(i) depict the commission of an alleged crime;548(ii) record any encounter between a law enforcement officer and a person that results549in death or bodily injury, or includes an instance when an officer fires a weapon;550(iii) record any encounter that is the subject of a complaint or a legal proceeding551against a law enforcement officer or law enforcement agency;552(iv) contain an officer-involved critical incident as defined in Subsection55376-2-408(1)(f); or554(v) have been requested for reclassification as a public record by a subject or555authorized agent of a subject featured in the recording[.] ; and556 (h) any portion of a record that reveals whether a taxpayer receives an exemption,557deferral, abatement, or relief under:558(i) Section 59-2-1106; or559(ii) Title 59, Chapter 2a, Tax Relief Through Property Tax.560 (3)(a) As used in this Subsection (3), "medical records" means medical reports, records,561 statements, history, diagnosis, condition, treatment, and evaluation.562 (b) Medical records in the possession of the University of Utah Hospital, its clinics,563doctors, or affiliated entities are not private records or controlled records under564Section 63G-2-304 when the records are sought:565(i) in connection with any legal or administrative proceeding in which the patient's566physical, mental, or emotional condition is an element of any claim or defense; or567(ii) after a patient's death, in any legal or administrative proceeding in which any568party relies upon the condition as an element of the claim or defense.569 (c) Medical records are subject to production in a legal or administrative proceeding570according to state or federal statutes or rules of procedure and evidence as if the571medical records were in the possession of a nongovernmental medical care provider.- 17 -H.B. 325 Enrolled Copy572Section 4.
