López5678910 AN ACT11 RELATING TO PROPERTY; EXEMPTING JETTY JACKS FROM THE PROVISIONS12 OF THE CULTURAL PROPERTIES ACT AND THE CULTURAL PROPERTIES13 PROTECTION ACT.1415 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:16 SECTION 1. Section 18-6-3 NMSA 1978 (being Laws 1969,[bracketed material] = delete17 Chapter 223, Section 3, as amended) is amended to read:underscored material = new18 "18-6-3. DEFINITIONS.--As used in the Cultural Properties19 Act:20 A. "committee" means the cultural properties review21 committee;22 B. "cultural property" means a structure, place,23 site or object having historic, archaeological, scientific,24 architectural or other cultural significance and does not25 include a jetty jack;.232460.11 C. "jetty jack" means a jack made of steel and2 heavy wire installed by the United States bureau of reclamation3 and United States army corps of engineers for river bank4 maintenance;5 [C.] D. "registered cultural property" means a6 cultural property that has been placed on the official register7 on either a permanent or temporary basis by the committee;8 [D.] E. "official register" means the New Mexico9 register of cultural properties maintained by the committee for10 the purpose of recording cultural properties deemed worthy of11 preservation; and12 [E.] F. "state land" means property owned,13 controlled or operated by a department, agency, institution or14 political subdivision of the state."15 SECTION 2. Section 18-6A-2 NMSA 1978 (being Laws 1993,16 Chapter 176, Section 2, as amended) is amended to read:[bracketed material] = delete17 "18-6A-2. "jetty jack" means a jack made of steel and9 heavy wire installed by the United States bureau of reclamation10 and United States army corps of engineers for river bank11 maintenance;12 [F.] G. "officer" means the state historic13 preservation officer;14 [G.] H. "preservation" means sustaining the15 existing form, integrity and material of a cultural property or16 the existing form and vegetative cover of a cultural property[bracketed material] = delete17 and may include protective maintenance or stabilization whereunderscored material = new18 necessary in the case of archaeological sites;19 [H.] I. "professional survey" means an20 archaeological or architectural survey;21 [I.] J. "protection" means safeguarding the22 physical condition or environment of a cultural property from23 deterioration or damage caused by weather or other natural,24 animal or human intrusions;25 [J.] K.
