11 RELATING TO PROPERTY; EXEMPTING JETTY JACKS FROM THE PROVISIONS
12 OF THE CULTURAL PROPERTIES ACT AND THE CULTURAL PROPERTIES
13 PROTECTION ACT.

15 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
16 SECTION 1. Section 18-6-3 NMSA 1978 (being Laws 1969,

17 Chapter 223, Section 3, as amended) is amended to read:

18 "18-6-3. DEFINITIONS.--As used in the Cultural Properties
19 Act:
20 A. "committee" means the cultural properties review
21 committee;
22 B. "cultural property" means a structure, place,
23 site or object having historic, archaeological, scientific,
24 architectural or other cultural significance and does not
25 include a jetty jack;

1 C. "jetty jack" means a jack made of steel and
2 heavy wire installed by the United States bureau of reclamation
3 and United States army corps of engineers for river bank
4 maintenance;
5 [C.] D. "registered cultural property" means a
6 cultural property that has been placed on the official register
7 on either a permanent or temporary basis by the committee;
8 [D.] E. "official register" means the New Mexico
9 register of cultural properties maintained by the committee for
10 the purpose of recording cultural properties deemed worthy of
11 preservation; and
12 [E.] F. "state land" means property owned,
13 controlled or operated by a department, agency, institution or
14 political subdivision of the state."
15 SECTION 2. Section 18-6A-2 NMSA 1978 (being Laws 1993,
16 Chapter 176, Section 2, as amended) is amended to read:

8 F. "jetty jack" means a jack made of steel and
9 heavy wire installed by the United States bureau of reclamation
10 and United States army corps of engineers for river bank
11 maintenance;
12 [F.] G. "officer" means the state historic
13 preservation officer;
14 [G.] H. "preservation" means sustaining the
15 existing form, integrity and material of a cultural property or
16 the existing form and vegetative cover of a cultural property

17 and may include protective maintenance or stabilization where

18 necessary in the case of archaeological sites;
19 [H.] I. "professional survey" means an
20 archaeological or architectural survey;
21 [I.] J. "protection" means safeguarding the
22 physical condition or environment of a cultural property from
23 deterioration or damage caused by weather or other natural,
24 animal or human intrusions;
25 [J.] K. "restoration" means recovering the general

1 historic appearance of a cultural property or the form and
2 details of an object or structure by removing incompatible
3 natural or human-caused accretions and replacing missing
4 elements as appropriate;
5 [K.] L. "stabilization" means reestablishing the
6 structural stability or weather-resistant condition of a
7 cultural property or arresting deterioration that may lead to
8 structural failure;
9 [L.] M. "state agency" means a department, agency,
10 institution or political subdivision of the state; and
11 [M.] N. "state land" means property owned,
12 controlled or operated by a state agency."
