NO.2022THIRTY-THIRD LEGISLATURE, 2026H.D. 1STATE OF HAWAIIS.D. 1A BILL FOR AN ACTRELATING TO MOTOR VEHICLE REGISTRATION.BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:���� SECTION 1.� Section 249-31,Hawaii Revised Statutes, is amended to read as follows:���� "�249-31�State and county registration [[fee.]] fees.� (a)� Allvehicles and motor vehicles in the State [[as defined in section 249-1]],including antique motor vehicles, except as otherwise provided in sections 249-4,249-6, and 249‑31.5, shall be subject to a $46annual vehicle registration fee; provided thatalternative fuel vehicles shall pay an annual vehicle registration surcharge of$50, which shall be assessed and collected beginning with the firstregistration renewal for every alternative fuel vehicle and shall be depositedinto the state highway fund established under section 248-8.� The surcharge shall be paid each yeartogether with all other taxes and fees levied by this chapter on a staggeredbasis as established by each county as authorized by section 286-51, and thestate registration for that county shall likewise be staggered so that thestate registration fee is due and payable at the same time and shall becollected together with the county fee.�The state registration fee shall be deemed delinquent if not paid withthe county registration fee.� Therespective counties shall collect this fee together with the vehicleregistration tax collected for the county and shall transfer the moneyscollected under this [[section]] subsection and subsection (b) tothe State.���� For the purposes of thissubsection, "alternative fuel vehicle" means a vehicle powered by anon-petroleum-based fuel, but excludes an electric vehicle as defined insection 249‑36(g).���� (b)�In addition to the annual vehicle registration surcharge fee, for eachannual motor vehicle registration fee, the director shall deposit $40 into thestate highway fund, $5 into the emergency medical services special fund, and $1into the accessible parking special account.���� (c)� Notwithstanding any county ordinance to thecontrary, a county's annual vehicle registration fee shall not exceed theannual vehicle registration fee imposed pursuant to subsection (a); providedthat this subsection shall only apply to counties with a population of fivehundred thousand or more.���� (d)� Each county with a population of five hundredthousand or more shall expend no less than thirty per cent of the respectiverevenues collected from county registration fees pursuant to subsection (a) forroadway repair and maintenance; provided that each county shall submit anannual report to the legislature no later than twenty days prior to theconvening of each regular session detailing the revenues collected under thissection, current fund balances, and expenditures made from those funds."���� SECTION 2.� Section 249-33, Hawaii Revised Statutes, isamended to read as follows:���� "�249-33�State and county vehicle weight [[tax,]] taxes;exemptions.� (a)� All vehicles and motor vehicles in the Stateas defined in section 249-1, including antique motor vehicles, except asotherwise provided in sections 249-4, 249-5.5, 249-6, and 249-6.5, in additionto all other fees and taxes levied by this chapter, shall be subject to anannual state vehicle weight tax.� The taxshall be levied by the county director of finance at the rate of 1.75 cents apound according to the net weight of each vehicle as the "net weight"is defined in section 249-1 up to and including four thousand pounds netweight; vehicles over four thousand pounds and up to and including seventhousand pounds net weight shall be taxed at the rate of 2.00 cents a pound;vehicles over seven thousand pounds and up to and including ten thousand poundsnet weight shall be taxed at the rate of 2.25 cents a pound; vehicles over tenthousand pounds net weight shall be taxed at a flat rate of $300.���� (b)� The tax shall become due and payable in eachyear together with all other taxes and fees levied by this chapter on astaggered basis as established by each county as authorized by section 286-51,the state vehicle weight tax shall likewise be staggered so that the statevehicle weight tax is collected together with the county fee.� The state vehicle weight tax shall be deemeddelinquent if not paid with the county registration fee.� The tax shall be paid by the owner of eachvehicle to the director of finance of the county in which the vehicle isregistered and shall be collected by the director of finance of such countytogether with all other fees and taxes levied by this chapter from the owner ofeach vehicle and motor vehicle registered in the county.���� By thefifteenth day of the month following the month in which taxes under thissection are collected, the director of finance of each county shall transmitthe taxes collected to the state director of finance for deposit into the statehighway fund.���� (c)� The exemptions provided by sections 249-3 to249-6 shall apply to this section.� Theprovisions for refunds, and taxes for fraction of years for vehicles removedfrom or brought into the State and for junked vehicles, contained in sections249-3 and 249-5 shall apply to the tax levied by this section.���� (d)� If it is shown to the satisfaction of thedepartment of transportation of the State, based upon proper records and fromsuch other evidence as the department of transportation may require, that anyvehicle with a net vehicle weight of six thousand pounds or over is used foragricultural purposes the owner thereof may obtain a refund of all taxesthereon imposed by this section.� Thedepartment of transportation shall prescribe rules to administer such refunds.���� (e)� The counties shall be reimbursed theincremental costs incurred in the collection and administration of taxes andfees imposed under section 249-31 and this section; the amount of reimbursementshall be determined by the director of transportation.���� (f)� Notwithstanding any county ordinance to thecontrary, a county's annual vehicle weight tax shall not exceed the annualstate vehicle weight tax imposed pursuant to subsection (a); provided that thissubsection shall only apply to counties with a population of five hundredthousand or more.���� (g)� Each county with a population of five hundredthousand or more shall expend no less than thirty per cent of the respectiverevenues collected from the county vehicle weight tax pursuant to subsection(a) for roadway repair and maintenance; provided that each county shall submitan annual report to the legislature no later than twenty days prior to theconvening of each regular session detailing the revenues collected under thissection, current fund balances, and expenditures made from those funds."���� SECTION3.� Statutory material to be repealed isbracketed and stricken.� New statutory materialis underscored.���� SECTION 4.� This Act shall take effect on July 1, 3000.Report Title:CountyAnnual Vehicle Registration Fee;
