The Child Care Act of 1969 is amended by adding5Sections 6.3 and 6.5 as follows:6 (225 ILCS 10/6.3 new)7 Sec. 6.3. Child care director educational qualifications.8Child care directors hired on or after the effective date of9this amendatory Act of the 104th General Assembly shall meet10the following educational requirements:11 (1) a minimum of an associate degree from an12 accredited college or university in child development or13 early childhood education; or14 (2) the equivalent to paragraph (1) (defined as 6415 semester hours or 96 quarter hours in any discipline, with16 a minimum of 21 semester hours or 31.5 quarter hours from17 an accredited college or university in courses related to18 child development, early childhood education, or early19 childhood special education) and one of the following:20 (A) Gateways to Opportunity Level I Illinois21 Director Credential;22 (B) 3 semester hours or 4.5 quarter hours of23 college credit in administration, leadership, orHB4587 Enrolled - 2 - LRB104 16993 AAS 30407 b1 management; or2 (C) 3 points of credential-approved training in3 administration, leadership, or management.4 (225 ILCS 10/6.5 new)5 Sec. 6.5. Qualifications for interim conditional child6care directors.7 (a) A licensed day care center may employ an individual8who is in the process of completing the educational9requirements set forth in 89 Ill. Adm. Code 407.130(e)(2) as10an interim conditional child care director for a period of 1211months if they meet the conditions outlined in paragraph (1)12or (2) of subsection (b). An individual employed under this13Section shall comply with the process established by the14Department of Early Childhood. This process requires the15licensed day care center, at the time of employment, to16provide documentation showing that the individual is enrolled17in courses at an accredited college or university that satisfy18the requirements of 89 Ill. Adm. Code 407.130(e)(2).19 (b) During the 12-month employment period, an interim20conditional child care director with any of the following21qualifications is exempt from the educational requirements set22forth in 89 Ill. Adm. Code 407.130(e)(2):23 (1) At least 2 years or 3,120 clock hours as an early24 childhood teacher at the licensed day care center where25 the individual shall serve as an interim conditional childHB4587 Enrolled - 3 - LRB104 16993 AAS 30407 b1 care director and has at least 64 semester hours or 962 quarter hours of credit from an accredited college or3 university in any discipline, with a minimum of 154 semester hours or 22.5 quarter hours in courses related to5 early childhood education, child development, or early6 childhood special education, and (i) a Gateways to7 Opportunity Level I Illinois Director Credential, (ii) 38 semester hours or 4.5 quarter hours of credit from an9 accredited college or university in administration,10 leadership, or management, or (iii) 3 points of11 credential-approved training in administration,12 leadership, or management. A person who is exempt under13 this paragraph shall obtain a total of at least 2114 semester hours or 31.5 quarter hours in courses related to15 early childhood education, child development, or early16 childhood special education by the end of the prescribed17 12-month period; or18 (2) At least 2 years or 3,120 clock hours as an early19 childhood teacher at the licensed day care center where20 the individual shall serve as an interim conditional child21 care director and has at least 64 semester hours or 9622 quarter hours of credit from an accredited college or23 university in any discipline, with a minimum of 2124 semester hours or 31.5 quarter hours in courses related to25 early childhood education, child development, or early26 childhood special education and without (i) a Gateways toHB4587 Enrolled - 4 - LRB104 16993 AAS 30407 b1 Opportunity Level I Illinois Director Credential, (ii) 32 semester hours or 4.5 quarter hours of credit from an3 accredited college or university in administration,4 leadership, or management, or (iii) 3 points of5 credential-approved training in administration,6 leadership, or management. A person who is exempt under7 this paragraph shall obtain the Gateways to Opportunity8 Level I Illinois Director Credential, semester or quarter9 hours, or points of training during the prescribed10 12-month period.11 (c) Only a licensed day care center that has already12employed at least one fully qualified and credentialed child13care director may hire an interim conditional child care14director.15 (d) Any licensed day care center that employs an interim16conditional child care director is restricted to hiring no17more than one interim conditional child care director at a18time for every credentialed and qualified child care director19employed. If an interim conditional child care director leaves20the position during the 12-month period, the licensed day care21center may employ a new interim conditional child care22director to replace the previous interim conditional child23care director.24 (e) A day care center must ensure direct supervision on an25ongoing basis by a fully qualified child care director26practicing in the State of Illinois, with a minimum of monthlyHB4587 Enrolled - 5 - LRB104 16993 AAS 30407 b1on-site check-ins, unless the supervising director determines2that more frequent check-ins are required. This shall continue3for the entire duration of any interim conditional child care4director's appointment. An interim conditional child care5director shall not be scheduled during any hours when an6interim conditional teacher is on duty. Parents and caregivers7must be notified if an interim conditional child care director8is employed by a day care center. This information must be9posted in a common area that is visible to parents and10caregivers for the duration of the interim period.11 (f) Failure to comply with the requirements in this12Section shall result in a violation and the issuance of a13corrective action plan. The Department of Early Childhood14shall adopt rules to implement this Section in accordance with15the Illinois Administrative Procedure Act.16 (g) This Section is repealed on June 30, 2032.17 Section 99. Effective date. This Act takes effect July 1,182027.
Reinserts the provisions of the engrossed bill with the following changes. Provides that a licensed day care center may employ (rather than hire) an individual who is in the process of completing the educational requirements set forth in the Illinois Administrative Code as an interim conditional child care director for the period of 12 months if they meet the conditions outlined in specific provisions. Provides that an individual employed under the provision shall comply with the process established by the Department of Early Childhood. Requires the licensed day care center, at the time of the individual's employment, to provide documentation that shows that the individual is enrolled in courses at an accredited college or university that satisfy those requirements. Provides that any licensed day care center that employs an interim conditional child care director is restricted to hiring no more than one interim conditional child care director (rather than 2 interim conditional child care directors) for every credentialed and qualified child care director employed. Provides that if an interim conditional child care director leaves the position of interim conditional child care director during the 12-month period, the licensed day care center may employ a new interim conditional child care director to replace the previous interim conditional child care director. Provides that a day care center shall ensure direct supervision on an ongoing basis by a fully qualified child care director practicing in the State of Illinois, with a minimum of monthly on-site check-ins, unless the supervising director determines that more frequent check-ins are required, which shall continue for the entire duration of any interim conditional child care director's appointment. Provides that an interim conditional child care director shall not be scheduled during any hours when an interim conditional teacher is on duty. Provides that parents and caregivers shall be notified if an interim conditional child care director is employed by a day care center, and that this information shall be posted in a common area that is visible to parents and caregivers for the duration of the interim period.
