hb156/enrolled.txt1AN ACT2 RELATING TO VACCINATION; REQUIRING VACCINATION RULES TO BE3 BASED ON THE RECOMMENDATIONS OF THE DEPARTMENT OF HEALTH;4 REPEALING CERTAIN SESSION LAWS FROM THE FIRST SPECIAL SESSION5 OF THE FIFTY-SEVENTH LEGISLATURE THAT WOULD OTHERWISE BECOME6 EFFECTIVE ON JULY 1, 2026.78 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:9SECTION 1. Section 24-5-1 NMSA 1978 (being Laws 1959,10 Chapter 329, Section 1, as amended) is amended to read:11 "24-5-1. IMMUNIZATION REGULATIONS.--12A. The public health division of the department of13 health shall, after consultation with the public education14 department and the early childhood education and care15 department, promulgate rules governing the immunization16 against diseases deemed to be dangerous to the public health,17 to be required of children attending licensed child care and18 licensed early childhood care programs and public, private,19 home or parochial schools in the state. Rules promulgated20 pursuant to this subsection shall establish the immunizations21 required and the manner and frequency of their administration22 in accordance with recommendations from the department of23 health. The public health division shall supervise and24 secure the enforcement of the required immunization program.25B. The public health division of the department of HB 156/aPage 11 health shall promulgate rules governing the immunization2 against diseases deemed to be dangerous to the public health,3 to be recommended for adults residing in the state. Rules4 promulgated pursuant to this subsection shall establish the5 immunizations recommended and the recommended manner and6 frequency of their administration in accordance with guidance7 from the department of health."8SECTION 2.
