hb158/enrolled.txt1AN ACT2 RELATING TO PUBLIC FUNDS; REQUIRING STATE AGENCIES TO SUBMIT3 AN ACCOUNTABILITY AND EVALUATION PLAN FOR PROGRAMS AND4 PROJECTS THAT RECEIVE FUNDING FROM THE GOVERNMENT RESULTS AND5 OPPORTUNITY PROGRAM FUND TO THE DIRECTOR OF THE STATE BUDGET6 DIVISION OF THE DEPARTMENT OF FINANCE AND ADMINISTRATION AND7 THE DIRECTOR OF THE LEGISLATIVE FINANCE COMMITTEE.89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:10 SECTION 1. A new section of the Accountability in11 Government Act is enacted to read:12 "PROGRAMS AND PROJECTS FUNDED BY THE GOVERNMENT RESULTS13 AND OPPORTUNITY PROGRAM FUND--ACCOUNTABILITY AND EVALUATION14 PLANS.--15A. The division director and the director of the16 committee shall develop instructions for agencies to submit17 an accountability and evaluation plan for each program or18 project that is funded by an appropriation from the19 government results and opportunity program fund. An20 accountability and evaluation plan shall, for each program or21 project:22(1) identify the goals, objectives and23 expected outputs and outcomes;24(2) describe the specific activities of the25 program or project and how those activities will achieve HB 158/aPage 11 expected outcomes;2(3) provide a summary of whether the program3 or project is evidence-based, research-based, promising or4 does not yet have rigorous research on its effectiveness;5(4) provide a list of performance measures6 and a monitoring plan to regularly assess performance;7(5) provide an evaluation plan to assess the8 causal impact on expected outcomes; and9(6) describe the methods and time line for10 releasing accountability and evaluation results to the11 division director, the director of the committee and the12 public.13B. On or before May 1 of each year, the division14 director shall notify each agency required to submit an15 accountability and evaluation plan. The agency shall submit16 the plan to the division director and the director of the17 committee on or before July 1 of the year the appropriation18 is made and, if the division director and the director of the19 committee require, a revised plan on or before September 1 of20 the same year.21C. On or before July 15 of the final year of an22 appropriation for a program or project, the division director23 and the director of the committee shall consider the24 evaluation performed on the program or project and make25 recommendations regarding inclusion of the program in the HB 158/aPage 21 agency's budget for the following fiscal year."
