Provides that counties and municipalities shall, by ordinance or resolution, require the installation and maintenance of vehicle impact protection devices to be placed in front of residential care facilities, buildings in areas zoned as business and manufacturing districts, any buildings where storefront windows are within 2 feet of the ground, any outdoor dining area, and any day care center outdoor play areas if the building, outdoor dining area, or day care center outdoor play area has adjacent parking spaces that are perpendicular or angled toward the building or area, drive aisles that are perpendicular to the building or area, or both. Provides that the required vehicle impact protection devices must be designed to withstand a minimum impact resistance level of 5,000 pounds at 30 miles per hour, must measure a minimum height of 3 feet, and must be spaced 48 inches from inside edge to inside edge of the device. Limits the materials used to manufacture vehicle impact protection devices. Prohibits vehicle impact protection devices that restrict building access and do not meet the requirements of the Illinois Accessibility Code and all other applicable State and federal laws. Clarifies that these provisions do not apply to voluntarily installed vehicle impact protection devices that are not required by the amendatory Act. Limits the concurrent exercise of home rule powers. Defines terms.LRB104 17875 TRT 31311 bA BILL FORSB2952 LRB104 17875 TRT 31311 b1 AN ACT concerning local government.2 Be it enacted by the People of the State of Illinois,3represented in the General Assembly:4 Section 5. The Counties Code is amended by adding Section55-12025 as follows:6 (55 ILCS 5/5-12025 new)7 Sec. 5-12025. Vehicle impact protection device.8 (a) As used in this Section:9 "Day care center outdoor play area" means an area10designated as a play area outside an establishment providing11care for more than 3 adults or children in a protective setting12for less than 24 hours per day that is not located within a13residential dwelling unit. "Day care center outdoor play area"14does not include an area designated as a play area outside day15care programs operated by an elementary school, middle school,16high school, park, or place of worship.17 "Outdoor dining area" means an outdoor seating area that18is typically connected to an indoor seating area for a19restaurant.20 "Residential care facility" means a care facility licensed21for 24-hour medical or non-medical care of people in need of22supervision or assistance essential for daily, living, or for23the protection of the individual. "Residential care facility"SB2952 - 2 - LRB104 17875 TRT 31311 b1includes assisted living facilities, independent living2facilities, nursing homes, hospice, and continuum of care3facilities. "Residential care facility" does not include a4community residences or transitional treatment facilities.5 "Vehicle impact protection device" means a concrete or6metal barrier that is designed to protect people and property7from moving vehicles. "Vehicle impact protection device"8includes, but is not limited to, a bollard or decorative9planter designed to protect people and property from moving10vehicles.11 (b) To safeguard pedestrians, buildings, and building12occupants, a county shall, by ordinance or resolution, require13the installation and maintenance of vehicle impact protection14devices in front of:15 (1) all public entrances to residential care16 facilities and buildings in areas zoned as business and17 manufacturing districts; and18 (2) any buildings where storefront windows are within19 2 feet of the ground, any outdoor dining area, and any day20 care center outdoor play areas if the building, outdoor21 dining area, or day care center outdoor play area has:22 (A) adjacent parking spaces that are perpendicular23 to or angled toward the building or area;24 (B) drive aisles that are perpendicular to the25 building or area; or26 (C) both.SB2952 - 3 - LRB104 17875 TRT 31311 b1 (c) The vehicle impact protection devices required under2this Section shall be designed to withstand, at minimum, an3impact resistance level of 5,000 pounds at 30 miles per hour.4The devices must have a minimum height of 3 feet and must be5spaced 48 inches from inside edge to inside edge of the device.6Vehicle impact protection devices must not restrict access to7the building and must be designed and installed to meet the8requirements of the Illinois Accessibility Code and all other9State and federal laws. Vehicle impact protection devices10shall be manufactured from finished metal or have a decorative11cover that is complimentary to the design of the associated12building, storefront, outdoor dining area, or day care center.13 (d) Vehicle impact protection devices may be located along14the outside wall of a building, along the edge of an adjacent15sidewalk, at the end of an adjacent parking space, or in16another location as approved by the county by ordinance or17resolution. When vehicle impact protection devices are located18within a parking space, the parking space must be adequately19sized to meet the requirements set by the county.20 (e) A county may install plain concrete barriers, such as21jersey barriers, temporarily, for a period not to exceed 9022days, while awaiting the installation of new or replacement of23permanent vehicle impact protection devices.24 (f) The requirements of this Section do not apply to25voluntarily installed vehicle impact protection devices that26are not required by this Section.SB2952 - 4 - LRB104 17875 TRT 31311 b1 (g) A home rule county may not regulate the installation2of vehicle impact protection devices in a manner less3restrictive than the regulation by the State of the4installation of vehicle impact protection devices under this5Section. This Section is a limitation under subsection (i) of6Section 6 of Article VII of the Illinois Constitution on the7concurrent exercise by home rule units of powers and functions8exercised by the State.9 Section 10. The Illinois Municipal Code is amended by10adding Section 11-13-30 as follows:11 (65 ILCS 5/11-13-30 new)12 Sec. 11-13-30. This Section is a limitation under subsection (i) of12Section 6 of Article VII of the Illinois Constitution on the13concurrent exercise by home rule units of powers and functions14exercised by the State.
Creates the Protection from Vehicle Impacts Act. Provides that the owner or operator of a residential care facility shall install and maintain vehicle impact protection devices in front of all public entrances of the facility. Provides that the owner or operator of a restaurant shall install and maintain vehicle impact protection devices (1) if the restaurant is in an area zoned as a business or manufacturing district, in front of all public entrances of the restaurant and (2) if the restaurant has an outdoor dining area, then around any outdoor dining area. Provides that the owner or operator of a day care center shall install and maintain vehicle impact protection devices (1) if the day care center is in an area zoned as a business or manufacturing district, in front of all public entrances of the restaurant and (2) if the day care center has an outdoor play area, then around any outdoor play area. Provides that the Department of Transportation shall adopt rules establishing the requirements for the vehicle impact protection devices required under the Act. Provides that the vehicle impact protection devices shall be designed to withstand, at minimum, an impact resistance level of 5,000 pounds at 30 miles per hour. Provides that the devices must have a minimum height of 3 feet and must be spaced 48 inches from inside edge to inside edge of the device. Provides that a municipality or a county may, by ordinance, require vehicle impact protection devices installed within the municipality to be manufactured from finished metal or have a decorative cover that is complementary to the design of the associated building, storefront, outdoor dining area, or day care center. Provides that the Department of Public Health shall require restaurants to comply with the Act. Amends the Nursing Home Care Act. Provides that the Department of Public Health shall require residential care facilities to comply with the Protection from Vehicle Impacts Act. Amends the Child Care Act of 1969. Provides that the Department of Early Childhood shall require day care centers to comply with the Protection from Vehicle Impacts Act.
