NO.3231THIRTY-THIRD LEGISLATURE, 2026S.D. 1STATE OF HAWAIIA BILL FOR AN ACTRELATING TO AGRICULTURAL DISTRICTS.BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:���� SECTION 1.� Section 514B-33, Hawaii Revised Statutes, isamended by amending subsection (a) to read as follows:���� "(a)�A condominium map shall be recorded with the declaration.� The condominium map shall contain thefollowing:���� (1)� Asite plan for the condominium property regime, depicting the location, layout,and access to a public road of all buildings and projects included oranticipated to be included in the condominium property regime, and depictingaccess for the units to a public road or to a common element leading to apublic road;���� (2)� Elevationsand floor plans of all buildings in the condominium property regime;���� (3)� Thelayout, location, boundaries, unit numbers, and dimensions of the units;���� (4)� Tothe extent that there is parking in the condominium property regime, a parkingplan for the regime, showing the location, layout, and stall numbers of allparking stalls included in the condominium property regime;���� (5)� Unlessspecifically described in the declaration, the layout, location, and numbers orother identifying information of the limited common elements, if any; [[and]]���� (6)� Adescription in sufficient detail, as may be determined by the commission, toidentify any land area that constitutes a limited common element[[.]];and���� (7)� Ifthe condominium map is for lands within an agricultural district situated inany county, a letter signed by an appropriate county official or agencycertifying that the condominium property regime will conform to county zoninglaws pursuant to section 514B-5."���� SECTION 2.�Section 514B-52, Hawaii Revised Statutes, is amended by amendingsubsection (b) to read as follows:���� "(b)�An application for registration of a project in the agriculturaldistrict classified pursuant to chapter 205 shall include a verified statement,signed by an appropriate county official, that the project as described and setforth in the project's declaration, condominium map, bylaws, and house rulesdoes not include any restrictions limiting or prohibiting agricultural uses oractivities, in compliance with section 205‑4.6.� For projects containing [[greater]] morethan five units or larger than ten acres, the statement shall alsoinclude the applicant's assessment and county comments regarding theavailability of supportive infrastructure, any potential impact on governmentalplans and resources, sensitive environmental resources, and any other requirementspursuant to county ordinances and rules.�The developer's public report shall include the verified statement inaddition to the information required by section 514B-83.� The commission shall not accept theregistration of a project where a county official has not signed a verifiedstatement."���� SECTION 3.�Statutory material to be repealed is bracketed and stricken.� New statutory material is underscored.���� SECTION 4.�This Act shall take effect on July 1, 2050.Report Title:Counties;Agricultural Districts; Condominium Property Regimes; Registration; ApplicationDescription:Requires condominium maps for lands within an agriculturaldistrict to include a letter signed by an appropriate county official or agencycertifying that the condominium property regime will conform to county zoninglaws.� Requires an application forregistration of a project in an agricultural district larger than ten acres to includecertain additional information.� Effective 7/1/2050.� (SD1)The summary descriptionof legislation appearing on this page is for informational purposes only and isnot legislation or evidence of legislative intent.
