NO.2421THIRTY-THIRD LEGISLATURE, 2026STATE OF HAWAIIA BILL FOR AN ACTRELATINGTO COMMUNITY CARE FOSTER FAMILY HOMES.BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:���� SECTION 1.� Section 321-483, Hawaii Revised Statutes, isamended by amending subsection (b) to read as follows:���� "(b)� The department shall adopt rules pursuant tochapter 91 relating to:���� (1)� Standards ofconditions and competence for the operation of community care foster familyhomes;���� (2)� Procedures forobtaining and renewing a certificate of approval from the department;���� (3)� Minimum grievanceprocedures for clients of community care foster family home services; and���� (4)� Requirementsfor primary and substitute caregivers caring for three clients in communitycare foster family homes including:��������� (A)� Mandating thatprimary and substitute caregivers be twenty-one years of age or older;��������� (B)� Mandating thatprimary and substitute caregivers complete a minimum of twelve hours ofcontinuing education every twelve months or at least twenty‑four hours ofcontinuing education every twenty-four months;��������� (C)� Allowing theprimary caregiver to be absent from the community care foster family home forno more than [[twenty-eight]] forty-eight hours in a calendar week[[,not to exceed five hours per day;]] with no absence longer thantwenty-four consecutive hours; provided that the substitute caregiver ispresent in the community care foster family home during the primary caregiver'sabsence;��������� (D)� Where the primarycaregiver is absent from the community care foster family home in excess of thehours as prescribed in subparagraph (C), mandating that the substitutecaregiver be a certified nurse aide; and��������� (E)� Mandating that thesubstitute caregiver have, at a minimum, one year prior work experience as acaregiver in a community residential setting or in a medical facility."���� SECTION2.� Statutory material to be repealed isbracketed and stricken.� New statutorymaterial is underscored.���� SECTION 3.� This Act shall take effect upon its approval.INTRODUCED BY:_____________________________Report Title:CommunityCare Foster Family Home; Primary Caregiver; AbsencesDescription:Changesthe allowed absence by a primary caregiver at a community care foster familyhome to 48 hours in calendar week with no absence longer than 24 consecutivehours.The summary descriptionof legislation appearing on this page is for informational purposes only and isnot legislation or evidence of legislative intent.
