hf2187/introduced.txtHouseFile2187-IntroducedHOUSEFILE2187BYBARKERABILLFORAnActrequiringtheboardsofdirectorsofschooldistricts1toallowcertainyouth-orientedcommunityorganizations2reasonableaccesstoschoolproperty.3BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:4TLSB6068HH(1)91jda/jhH.F.2187Section1.Section297.9,Code2026,isamendedtoreadas1follows:2297.9Useforotherthanschoolpurposes.31.Theboardofdirectorsofanyschooldistrictmay4authorizetheuseofanyschoolhouseanditsgroundswithin5suchdistrictforthepurposeofmeetingsofgranges,6lodges,agriculturalsocieties,andsimilarsocieties,for7parent-teacherassociations,forcommunityrecreational8activities,communityeducationprograms,electionpurposes,9othermeetingsofpublicinterest,publicforumsandsimilar10communitypurposes;providedthatsuchuseshallinnoway11interferewithschoolactivities;suchusetobeforsuch12compensationanduponsuchtermsandconditionsasmaybefixed13bysaidboardfortheproperprotectionoftheschoolhouse14andthepropertybelongingtherein,includingthatofpupils,15exceptthatinthecaseofcommunityeducationprograms,any16compensationnecessaryforprogramsprovidedspecificallyby17communityeducationandnotthoseprovidedthroughcommunity18educationbyotheragenciesororganizationsshallbe19compensatedfromthefundingprovidedforcommunityeducation20programs.212.a.Theboardofdirectorsofeachschooldistrict22shallallowayouth-orientedcommunityorganizationreasonable23accesstoanyschoolhouseanditsgroundswithinsuchdistrict24todistributeandprovideinstructionalmaterialsinorder25toencourageparticipationintheyouth-orientedcommunity26organization.27b.Theboardofdirectorsofeachschooldistrictshall28establishtermsandconditionsgoverningthereasonable29accessprovidedtoayouth-orientedcommunityorganization30underparagraph“a”toprovidefortheproperprotectionof31studentsenrolledintheschooldistrict,employeesofthe32schooldistrict,theschoolhouse,andthepropertywithinthe33schoolhouse.Thetermsandconditionsgoverningthereasonable34accessmustsatisfyallofthefollowingrequirements:35-1-LSB6068HH(1)91jda/jh1/2H.F.2187(1)Prohibitayouth-orientedcommunityorganizationfrom1interferingwithclassroominstructionaltime.2(2)Whenitcanbereasonablyaccommodated,allowa3youth-orientedcommunityorganizationtohaveaccessto4after-schoolevents,includingback-to-schoolevents.5c.Forpurposesofthissubsection,“youth-oriented6communityorganization”meansanypatrioticandnational7organizationdescribedin36U.S.C.§20101–240112,asofJuly81,2018.9EXPLANATION10Theinclusionofthisexplanationdoesnotconstituteagreementwith11theexplanation’ssubstancebythemembersofthegeneralassembly.12Thisbillrequirestheboardsofdirectorsofschool13districtstoallowcertainyouth-orientedcommunity14organizationsreasonableaccesstoschoolproperty.15Thebillrequirestheboardofdirectorsofeachschool16districttoallowayouth-orientedcommunityorganizationto17havereasonableaccesstoanyschoolhouseanditsgrounds18todistributeandprovideinstructionalmaterialsinorder19toencourageparticipationintheyouth-orientedcommunity20organization.Theschooldistrictisrequiredtoestablish21termsandconditionsgoverningthereasonableaccessprovided22toayouth-orientedcommunityorganizationtoprovideforthe23properprotectionofstudentsenrolledintheschooldistrict,24employeesoftheschooldistrict,theschoolhouse,andthe25propertywithintheschoolhouse.Thetermsandconditions26mustprohibitayouth-orientedcommunityorganizationfrom27interferingwithclassroominstructionaltimeandallow28ayouth-orientedcommunityorganizationtohaveaccess29toafter-schooleventswhensuchaccesscanbereasonably30accommodated.Thebilldefines“youth-orientedcommunity31organization”byreferencetofederallawrelatedtopatriotic32andnationalorganizations.33-2-LSB6068HH(1)91jda/jh2/2
