Ruiz,Sawyer, Sawyer Clayton, Schlingensiepen, Stogsdill, Weigel, Winn, Woodard andXu1-291 AN ACT concerning health and healthcare; relating to medical assistance;2 establishing the Affordable Healthcare for Kansans program; expanding3 income limits for eligibility to 138% of the federal poverty level.45 Be it enacted by the Legislature of the State of Kansas:6 Section 1. (a) This section shall be known and may be cited as the7 affordable healthcare for Kansans program and the affordable healthcare8 for Kansas program is hereby established. The department of health and9 environment shall administer and promote the program and provide10 information to potential eligible individuals in Kansas. The legislature11 expressly consents to expand eligibility for receipt of benefits under the12 Kansas program of medical assistance as required by K.S.A. 39-709(e)(2),13 and amendments thereto, by the passage and enactment of the affordable14 healthcare for Kansans program.15 (b) For the purposes of eligibility determinations under the Kansas16 program of medical assistance, on and after January 1, 2027, medical17 assistance shall be granted to any adult under 65 years of age who is not18 pregnant and whose modified adjusted gross income does not exceed19 138% of the federal poverty level, to the extent permitted under the20 provisions of 42 U.S.C. § 1396a, as in effect on July 1, 2026.21 Sec. 2. This act shall take effect and be in force from and after its22 publication in the statute book.
