The Freedom of Information Act is amended by5changing Section 7.5 as follows:6 (5 ILCS 140/7.5)7 (Text of Section before amendment by P.A. 104-441 and8104-457)9 Sec. 7.5. Statutory exemptions. To the extent provided for10by the statutes referenced below, the following shall be11exempt from inspection and copying:12 (a) All information determined to be confidential13 under Section 4002 of the Technology Advancement and14 Development Act.15 (b) Library circulation and order records identifying16 library users with specific materials under the Library17 Records Confidentiality Act.18 (c) Applications, related documents, and medical19 records received by the Experimental Organ Transplantation20 Procedures Board and any and all documents or other21 records prepared by the Experimental Organ Transplantation22 Procedures Board or its staff relating to applications it23 has received.SB3048 Enrolled - 2 - LRB104 16839 JRC 30249 b1 (d) Information and records held by the Department of2 Public Health and its authorized representatives relating3 to known or suspected cases of sexually transmitted4 infection or any information the disclosure of which is5 restricted under the Illinois Sexually Transmitted6 Infection Control Act.7 (e) Information the disclosure of which is exempted8 under Section 30 of the Radon Industry Licensing Act.9 (f) Firm performance evaluations under Section 55 of10 the Architectural, Engineering, and Land Surveying11 Qualifications Based Selection Act.12 (g) Information the disclosure of which is restricted13 and exempted under Section 50 of the Illinois Prepaid14 Tuition Act.15 (h) Information the disclosure of which is exempted16 under the State Officials and Employees Ethics Act, and17 records of any lawfully created State or local inspector18 general's office that would be exempt if created or19 obtained by an Executive Inspector General's office under20 that Act.21 (i) Information contained in a local emergency energy22 plan submitted to a municipality in accordance with a23 local emergency energy plan ordinance that is adopted24 under Section 11-21.5-5 of the Illinois Municipal Code.25 (j) Information and data concerning the distribution26 of surcharge moneys collected and remitted by carriersSB3048 Enrolled - 3 - LRB104 16839 JRC 30249 b1 under the Emergency Telephone System Act.2 (k) Law enforcement officer identification information3 or driver identification information compiled by a law4 enforcement agency or the Department of Transportation5 under Section 11-212 of the Illinois Vehicle Code.6 (l) Records and information provided to a residential7 health care facility resident sexual assault and death8 review team or the Executive Council under the Abuse9 Prevention Review Team Act.10 (m) Information provided to the predatory lending11 database created pursuant to Article 3 of the Residential12 Real Property Disclosure Act, except to the extent13 authorized under that Article.14 (n) Defense budgets and petitions for certification of15 compensation and expenses for court appointed trial16 counsel as provided under Sections 10 and 15 of the17 Capital Crimes Litigation Act (repealed). This subsection18 (n) shall apply until the conclusion of the trial of the19 case, even if the prosecution chooses not to pursue the20 death penalty prior to trial or sentencing.21 (o) Information that is prohibited from being22 disclosed under Section 4 of the Illinois Health and23 Hazardous Substances Registry Act.24 (p) Security portions of system safety program plans,25 investigation reports, surveys, schedules, lists, data, or26 information compiled, collected, or prepared by or for theSB3048 Enrolled - The Illinois Domestic Violence Act of 1986 is9amended by changing Section 301.1 and by adding Section 307 as10follows:11 (750 ILCS 60/301.1) (from Ch. 40, par. 2313-1.1)12 Sec. 301.1. Law enforcement policies.13 (a) Every law enforcement agency shall develop, adopt, and14implement written policies regarding arrest procedures for15domestic violence incidents consistent with the provisions of16this Act. In developing these policies, each law enforcement17agency shall consult with community organizations and other18law enforcement agencies with expertise in recognizing and19handling domestic violence incidents.20 (b) In the initial training of new recruits and every 521years in the continuing education of law enforcement officers,22every law enforcement agency shall provide training to aid in23understanding the actions of domestic violence victims and24abusers and to prevent further victimization of those who haveSB3048 Enrolled - 32 - LRB104 16839 JRC 30249 b1been abused, focusing specifically on looking beyond the2physical evidence to the psychology of domestic violence3situations, such as the dynamics of the aggressor-victim4relationship, separately evaluating claims where both parties5claim to be the victim, and long-term effects.6 Beginning January 1, 2029, for law enforcement agencies7using lethality assessments, the continuing education should8include training on policies and procedures for administering9a lethality assessment.10 The Law Enforcement Training Standards Board shall11formulate and administer the training under this subsection12(b) as part of the current programs for both new recruits and13active law enforcement officers. The Board shall formulate the14training by July 1, 2017, and implement the training statewide15by July 1, 2018. In formulating the training, the Board shall16work with community organizations with expertise in domestic17violence to determine which topics to include. The Law18Enforcement Training Standards Board shall oversee the19implementation and continual administration of the training.20(Source: P.A. 99-810, eff. 1-1-17.)21 (750 ILCS 60/307 new)22 Sec. 307. Domestic violence lethality assessments. By23January 1, 2028, the Department of Human Services, in24cooperation with the Illinois State Police, shall recommend a25domestic violence lethality tool kit for use by lawSB3048 Enrolled - 33 - LRB104 16839 JRC 30249 b1enforcement agencies. As part of this effort, the Illinois2State Police and Department may engage with groups, including,3but not limited to, a statewide association representing4sheriffs, a statewide association representing chiefs of5police, a statewide association representing State's6Attorneys, a statewide association dedicated to domestic7violence prevention that includes survivor voices, and an8association working with victims' rights to review and provide9feedback on a template. Stakeholder feedback shall be gathered10and analyzed by August 1, 2027. Based on this feedback, model11policies and protocols shall be developed that law enforcement12agencies may use or reference in developing their domestic13violence lethality assessment template, policies, protocols,14training, and referrals to domestic violence services. Nothing15in this Section imposes any additional liability on a law16enforcement officer or agency acting in good faith17administering these assessments.18 Section 95. No acceleration or delay. Where this Act makes19changes in a statute that is represented in this Act by text20that is not yet or no longer in effect (for example, a Section21represented by multiple versions), the use of that text does22not accelerate or delay the taking effect of (i) the changes23made by this Act or (ii) provisions derived from any other24Public Act.
Amends the Freedom of Information Act. Exempts from disclosure under the Act information, records, or recordings collected by law enforcement in a behavioral threat assessment or domestic violence lethality assessment. Amends the Illinois Domestic Violence Act of 1986. Provides that beginning January 1, 2029, for law enforcement agencies using lethality assessments, the continuing education should include training on policies and procedures for administering a lethality assessment. Provides that by January 1, 2028, the Department of Human Services, in cooperation with the Illinois State Police, shall create a domestic violence lethality tool kit for use by law enforcement agencies. Authorizes the Illinois State Police and the Department of Human Services to engage with interested groups to review and provide feedback on a template. Requires this feedback to be gathered and analyzed by August 1, 2027.
