BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,14 That the Laws of Maryland read as follows:15Article – Correctional Services16 9–309.17 IF REQUESTED BY FEDERAL IMMIGRATION AUTHORITIES, AN EMPLOYEE OR18 AGENT OF A STATE OR LOCAL CORRECTIONAL FACILITY SHALL:19(1) PROVIDE NOTICE OF THE RELEASE OF AN INDIVIDUAL AT LEAST20 48 HOURS PRIOR TO THE RELEASE OF THE INDIVIDUAL IN ORDER TO FACILITATE21 THE TRANSFER OF THE INDIVIDUAL TO FEDERAL IMMIGRATION AUTHORITIES; ANDEXPLANATION: CAPITALS INDICATE MATTER ADDED TO EXISTING LAW.[Brackets] indicate matter deleted from existing law.*hb0725*2HOUSE BILL 7251(2) TRANSFER THE INDIVIDUAL TO FEDERAL IMMIGRATION2 AUTHORITIES PROVIDED THAT THE TRANSFER DOES NOT EXTEND THE TIME IN3 CUSTODY OF THE INDIVIDUAL BEYOND THE INDIVIDUAL’S SCHEDULED RELEASE.4SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect5 October 1, 2026.
Requiring an employee or agent of a State or local correctional facility, if requested by federal immigration authorities, to provide notice of the release of an individual at least 48 hours prior to the release and to transfer the individual to federal immigration authorities.
