h867/introduced.txtBILL AS INTRODUCED H.8672026 Page 1 of 31H.8672 Introduced by Representative Rachelson of Burlington3 Referred to Committee on4 Date:5 Subject: Conservation and development; tourist information; signs; billboards;6mobile billboards7 Statement of purpose of bill as introduced: This bill proposes to clarify that8 mobile billboards are prohibited.9 An act relating to prohibiting mobile billboards10 It is hereby enacted by the General Assembly of the State of Vermont:11 Sec. 1. 10 V.S.A. § 481 is amended to read:12 § 481. DEFINITIONS13 As used in this chapter, the following terms are defined as follows:14***15(6) A “sign” is any structure, display, device, or representation, either16 temporary or permanent, portable, mobile, vehicle-mounted, or ground-17 mounted, that is designed or used to advertise or call attention to any thing,18 person, business, activity, or place and is visible from any highway or other19 right-of-way. It does not include the flag, pennant, or insignia of any nation,VT LEG #385164 v.1BILL AS INTRODUCED H.8672026 Page 2 of 31 state, or town. Whenever dimensions of a sign are specified, they shall include2 panels and frames.3***4 Sec. 2. 10 V.S.A. § 494 is amended to read:5 § 494. EXEMPT SIGNS6 The following signs are exempt from the requirements of this chapter7 except as indicated in section 495 of this title:8***9(2) Signs on registered and inspected motor vehicles, except those that10 are determined by the Travel Information Council to be circumventing the11 intent purpose of this chapter. Circumvention includes signs that are12 continuously in the same location or signs that extend beyond the height,13 width, or length of the vehicle.14***15 Sec. 3. 10 V.S.A. § 503 is amended to read:16 § 503. PENALTY17 (a) A person who violates this chapter shall be assessed a civil penalty of18 not more than $50.00 subject to a civil penalty of:19(1) $150.00 for a first offense;20(2) $250.00 for a second offense; and21(3) $500.00 for a third or subsequent offense.VT LEG #385164 v.1BILL AS INTRODUCED H.8672026 Page 3 of 31 (b) Each day the violation of this chapter continues shall be a separate2 offense.3 Sec. 4.
