4   General Description:
5This bill addresses local regulation of cut flower sales.
6   Highlighted Provisions:
7This bill:
8▸ defines terms;
9▸ establishes that a political subdivision may not prohibit the sale, trade, or transfer of cut
10   flowers if the person selling, trading, or transferring the cut flowers is permitted to grow
11   flowers on the person's private property; and
12▸ clarifies that a political subdivision may require a person selling, trading, or transferring
13   cut flowers to obtain a business license.

23   Be it enacted by the Legislature of the state of Utah:

24Section 1. Section 11-46c-101 is enacted to read:
25CHAPTER 46c. Regulation of Cut Flower Sales
2611-46c-101 . Definitions.
27      As used in this chapter:
28   (1) "Cut flower" means a flower or flower bud that has been removed from the flower's or
29flower bud's parent plant.
30   (2) "Political subdivision" means:

31      (a) a municipality as that term is defined in Section 10-1-104; or
32      (b) a county.
33Section 2. Section 11-46c-102 is enacted to read:
3411-46c-102 . Actions allowed regarding cut flowers.
35  (1) Subject to Subsection (2), if an ordinance, resolution, or policy of a political subdivision
36      permits a person to grow flowers on the person's private property within the political
37      subdivision's boundaries, the political subdivision shall permit the person to trade, sell,
38      or otherwise transfer cut flowers from the flowers grown on the person's private property.
39  (2) A political subdivision may require a business license for a person described in
40      Subsection (1) to trade, sell, or otherwise transfer cut flowers, except that the political
41      subdivision may not deny the issuance of a business license on the basis that the person
42      grows flowers or is trading, selling, or transferring cut flowers.
43Section 3. Effective Date.
44  This bill takes effect on May 6, 2026.
