hb483/introduced.txt02-23 10:18 H.B. 4831Flower Sales Modifications2026 GENERAL SESSIONSTATE OF UTAHChief Sponsor: Doug OwensSenate Sponsor: Heidi Balderree23 LONG TITLE4 General Description:5This bill addresses local regulation of cut flower sales.6 Highlighted Provisions:7This bill:8▸ defines terms;9▸ establishes that a political subdivision may not prohibit the sale, trade, or transfer of cut10 flowers if the person selling, trading, or transferring the cut flowers is permitted to grow11 flowers on the person's private property; and12▸ clarifies that a political subdivision may require a person selling, trading, or transferring13 cut flowers to obtain a business license.14 Money Appropriated in this Bill:15None16 Other Special Clauses:17None18 Utah Code Sections Affected:19 ENACTS:2011-46c-101, Utah Code Annotated 19532111-46c-102, Utah Code Annotated 19532223 Be it enacted by the Legislature of the state of Utah:H.B. 48324Section 1. Section 11-46c-101 is enacted to read:25CHAPTER 46c. Regulation of Cut Flower Sales2611-46c-101 . Definitions.27 As used in this chapter:28 (1) "Cut flower" means a flower or flower bud that has been removed from the flower's or29flower bud's parent plant.30 (2) "Political subdivision" means:H.B. 483 02-23 10:1831 (a) a municipality as that term is defined in Section 10-1-104; or32 (b) a county.33Section 2. Section 11-46c-102 is enacted to read:3411-46c-102 . Actions allowed regarding cut flowers.35 (1) Subject to Subsection (2), if an ordinance, resolution, or policy of a political subdivision36 permits a person to grow flowers on the person's private property within the political37 subdivision's boundaries, the political subdivision shall permit the person to trade, sell,38 or otherwise transfer cut flowers from the flowers grown on the person's private property.39 (2) A political subdivision may require a business license for a person described in40 Subsection (1) to trade, sell, or otherwise transfer cut flowers, except that the political41 subdivision may not deny the issuance of a business license on the basis that the person42 grows flowers or is trading, selling, or transferring cut flowers.43Section 3. Effective Date.44 This bill takes effect on May 6, 2026.-2-
