Article XI, Constitution of Arizona, is proposedto be amended by adding section 12 as follows if approved by the voters and onproclamation of the Governor:12. Education funding and services; requirements for modificationSection 12. A. Topromote continuity in educational funding and services for current and futurestudents in kindergarten PROGRAMS AND primary and secondary educationalprograms in this state, this state or any officer of this state MAY not reducebelow the level on the effective date of this section the annual distributionrate from the permanent fund that corresponds to land granted to this state bythe enabling act for the use and benefit of common schools below thedistribution rate prescribed in article X, section 7, subsection G, paragraph 2until fiscal year 2035-2036, except as provided in article X, section 7,subsection I, J or K, or below the distribution rate prescribed in article X,section 7, subsection G, paragraph 3, except with an affirmative vote of atleast three-fourths of the members of each house of the legislature.B. Until fiscal year 2036-2037,any increase in expendable earnings under section 37-521, subsection B,paragraph 4, Arizona Revised Statutes, that results from a distribution rate ofmore than two and one-half percent of the average monthly market values of thefund for the immediately preceding five calendar years pursuant to subsection Aof this section shall be appropriated for a statewide classroom teachercompensation program to increase the base salary and salary schedules of alleligible classroom teachers. The Legislature shall enact legislationfor the statewide classroom teacher compensation program that does all of thefollowing:1. EnsureS that the programdistinguishes between performing and underperforming teachers.2. EstablishES reporting andauditing requirements for the program.3. RequireS schools to updateteacher salary schedules.4. RequireS each school thatreceives monies pursuant to this subsection to allocate an equal amount perteacher to all eligible teachers who are employed by the school.5. AllocateS monies appropriatedpursuant to this subsection to a classroom teacher only if the teacher meetsall of the following requirements:(a) Is a Full-timeteacher.(b) Spends amajority of the teacher's time on nonadministrative activities that provide classroominstruction to students.(c) Meets orexceeds performance requirements.6. RequireS monies appropriatedpursuant to this subsection to supplement, and not supplant, teachercompensation monies from any other sources.2. The Secretary of Stateshall submit this proposition to the voters at the next general election asprovided by article XXI, Constitution of Arizona.
