sjr508/introduced.txt26.870.10 101st Legislative Session SJR5082026 South Dakota LegislatureSenate Joint Resolution 508Introduced by: Senator Kolbeck (Steve)1 A JOINT RESOLUTION proposing and submitting to the voters at the next general2election, amendments to the Constitution of the State of South Dakota,3removing the lieutenant governor as presiding officer of the Senate.4 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:5 Section 1. That at the next general election held in the state, the following amendments to6 Article IV and Article XVI of the Constitution of the State of South Dakota, as set forth in7 sections 2 and 3 of this Joint Resolution, which is hereby agreed to, be submitted to the8 electors of the state for approval.9 Section 2. That Article IV, § 5 of the Constitution of the State of South Dakota, be10 AMENDED:11§ 5. The lieutenant governor shall be president of the senate but shall have no12 vote unless the senators be equally divided. The lieutenant governor shall perform the13 duties and exercise the powers that may be delegated to him the lieutenant governor by14 the Governor.15 Section 3. That Article XVI, § 6 of the Constitution of the State of South Dakota, be16 REPEALED:17On trial of an impeachment against the Governor the lieutenant governor shall not18 act as a member of the court.Underscores indicate new language.Overstrikes indicate deleted language.
