1AN ACT
2  RELATING TO THE CHIROPRACTIC PRACTICE ACT; PROVIDING LEGISLATIVE INTENT;
3      AMENDING SECTION 54-716, IDAHO CODE, REGARDING THE PRESCRIBING OF
4      CERTAIN PRESCRIPTION DRUG PRODUCTS; AND DECLARING AN EMERGENCY AND PRO-
5      VIDING AN EFFECTIVE DATE.
6  Be It Enacted by the Legislature of the State of Idaho:
7      SECTION 1. LEGISLATIVE INTENT. It is the intent of the Legislature to
8  clarify the existing right of persons licensed to practice chiropractic in
9  this state to prescribe certain prescription drug products.
10     SECTION 2. That Section 54-716, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12      54-716. ADMINISTERING PRESCRIPTION DRUG PRODUCTS. (1) A licensee un-
13 der this chapter who is certified in clinical nutrition may prescribe, ob-
14 tain, and independently administer, during chiropractic practice, the fol-
15 lowing prescription drug products:
16      (a) Vitamins:
17(i) Vitamin A;
18(ii) All B vitamins; and
19(iii) Vitamin C;
20      (b) Minerals:
21(i) Ammonium molybdate;
22(ii) Calcium;
23(iii) Chromium;
24(iv) Copper;
25(v) Iodine;
26(vi) Magnesium;
27(vii) Manganese;
28(viii) Potassium;
29(ix) Selenium;
30(x) Sodium; and
31(xi) Zinc;
32      (c) Fluids:
33(i) Dextrose;
34(ii) Lactated ringers;
35(iii) Plasma lyte;
36(iv) Saline; and
37(v) Sterile water;
38      (d) Epinephrine; and
39      (e) Oxygen for use during an emergency or allergic reaction.
40      (2) The prescription drug products listed in subsection (1) of this
41 section may be administered through oral, topical, intravenous, intramuscu-

1  lar or subcutaneous routes. The route of administration and dosing shall be
2  in accordance with the product's labeling as approved by the federal food and
3  drug administration or with the manufacturer's instructions.
4(3) The prescription drug products listed in subsection (1) of this
5  section shall be obtained from a wholesale distributor, manufacturer, phar-
6  macy or outsourcing facility licensed under chapter 17, title 54, Idaho
7  Code.
8(4) No vitamin or mineral may be compounded, as defined in section
9  54-1704, Idaho Code, by a chiropractic physician. A compounded drug product
10 containing two (2) or more of the approved vitamins or minerals shall be ob-
11 tained for office use from either an outsourcing facility or a compounding
12 pharmacy licensed under chapter 17, title 54, Idaho Code.
13      (5) Nothing herein would remove or impact the ability of a chiropractic
14 physician who does not obtain a clinical nutrition certification to continue
15 to utilize nonprescriptive nutritional supplements.
16     SECTION 3. An emergency existing therefor, which emergency is hereby
17 declared to exist, this act shall be in full force and effect on and after
18 July 1, 2026.
