                                11   RELATING TO HIGHER EDUCATION; PROVIDING THAT THE BOARDS OF
                                12   REGENTS OF STATE INSTITUTIONS OF HIGHER EDUCATION HAVE NO POWER
                                13   OVER DECISIONS REGARDING ACADEMIC TENURE; PROVIDING THAT ALL
                                14   DECISIONS REGARDING ACADEMIC TENURE SHALL BE MADE IN ACCORDANCE
                                15   WITH AN INSTITUTION'S POLICIES AND BASED ON RECOMMENDATIONS OF
                                16   THE INSTITUTION'S FACULTY.

                                18   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
                                19        SECTION 1.    A new section of Chapter 21 NMSA 1978 is
                                20   enacted to read:
                                21        "[NEW MATERIAL] DECISIONS REGARDING ACADEMIC TENURE AT
                                22   STATE INSTITUTIONS OF HIGHER EDUCATION.--The boards of regents
                                23   of state institutions of higher education do not have the power
                                24   to award, deny, revoke or place conditions on a tenured faculty
                                25   position.   All decisions regarding academic tenure at a state

                                2    with the institution's policies and based on recommendations of
                                3    the institution's faculty."
