4 SYNOPSIS:
5Under existing law, a municipality with at least
625,000 inhabitants may extend its corporate limits by
7resolution of the municipality's governing body and
8special election.
9This bill would authorize any municipality to
10extend its corporate limits by resolution of the
11municipality's governing body and special election.

18Relating to annexation; to amend Section 11-42-40, Code
19 of Alabama 1975, to further provide for annexation by
20 resolution of a municipal governing body.
21 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22Section 1. Section 11-42-40, Code of Alabama 1975, is
23 amended to read as follows:
24"§11-42-40
25Any city having 25,000 inhabitants or more, as shown by
26 the last federal census, from time to time, may extend its
27 corporate limits in the manner and with the rights, powers,
28 and privileges as set forth in this article, but the

29 provisions of this article shall not preclude any city from
30 extending its corporate limits in any other way or manner that
31 may be authorized by law."
32Section 2. This act shall become effective on June 1,
33 2026.
