4 SYNOPSIS:
5This bill would propose an amendment to the
6Constitution of Alabama of 2022, relating to Covington
7County, to prohibit persons from injecting and storing
8carbon dioxide in underground wells in the county.

15Relating to underground injection wells, to propose an
16 amendment to the Constitution of Alabama of 2022, relating to
17 Covington County, to prohibit the injection and storage of
18 carbon dioxide in underground wells in the county.
19 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20Section 1. The following amendment to the Constitution
21 of Alabama of 2022, is proposed:
22PROPOSED AMENDMENT
23In Covington County, no person may inject, store, or
24 sequester carbon dioxide in underground wells. This
25 prohibition includes the operation of a Class VI well as
26 defined by the United States Environmental Protection Agency
27 pursuant to the Underground Injection Control Program of the
28 Safe Drinking Water Act, 42 U.S.C. § 300f et seq.

29Upon ratification of this constitutional amendment, the
30 Code Commissioner shall number and place this amendment as
31 appropriate in the constitution omitting this instructional
32 paragraph and may make the following nonsubstantive revisions:
33 change capitalization, hierarchy, spelling, and punctuation
34 for purposes of style and uniformity; correct manifest
35 grammatical, clerical, and typographical errors; revise
36 internal or external citations and cross-references; harmonize
37 language; and translate effective dates.
38END PROPOSED AMENDMENT
39Section 2. An election upon the proposed amendment
40 shall be held in accordance with Sections 284, 284.01, and 285
41 of the Constitution of Alabama of 2022, and the election laws
42 of this state. The appropriate election official shall assign
43 a ballot number for the proposed constitutional amendment on
44 the election ballot and shall set forth the following
45 description of the substance or subject matter of the proposed
46 constitutional amendment:
47"Relating to Covington County, proposing an amendment
48 to the Constitution of Alabama of 2022, to prohibit the
49 injection and storage of carbon dioxide in underground wells
50 in the county.
51Proposed by Act ____."
52This description shall be followed by the following
53 language:
54"Yes( ) No( )."
55Section 3. The proposed amendment shall become valid as
56 part of the Constitution of Alabama of 2022, when approved by

57 a majority of the qualified electors voting thereon.
