1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Nuclear Safety Law of 2004 is amended by
5 adding Section 95 as follows:
6 (20 ILCS 3310/95 new)
7 Sec. 95. Right of entry.
8 (a) As used in this Section, "disaster" and "incident"
9 have the meanings given to those terms in Section 4 of the
10 Illinois Emergency Management Agency Act.
11 (b) IEMA-OHS has the right to enter on public and private
12 property in order to take environmental samples in response to
13 a disaster or incident that causes, or threatens to cause,
14 radioactive contamination consistent with the regulatory
15 requirements of the U.S. Nuclear Regulatory Commission.
16 Section 99. Effective date. This Act takes effect upon
17 becoming law.

Amends the Nuclear Safety Law of 2004. Provides that the Illinois Emergency Management Agency and Office of Homeland Security has the right to enter on public and private property in order to take environmental samples in response to a disaster that causes radioactive contamination. Effective immediately.
