1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Fair Patient Billing Act is amended by
5 changing Section 27 as follows:
6 (210 ILCS 88/27)
7 Sec. 27. Application procedures for financial assistance
8 [Procedures for Financial Assistance].
9 (a) Applications. The Attorney General shall, by rule,
10 adopt [standard] provisions for a uniform financial assistance
11 form to be included in all applications for financial
12 assistance [no later than June 30, 2013]. On or before December
13 31, 2026, interested stakeholders [January 1, 2013, a statewide ]
14 [association representing a majority of hospitals] may submit to
15 the Attorney General recommendations concerning a uniform
16 [standard provisions to be used in an] application for financial
17 assistance, and the Attorney General shall take reasonably
18 relevant [those] recommendations into account when adopting
19 rules under this subsection.
20 Approval of eligibility for financial assistance is valid
21 for at least 12 months after the first service date for which
22 the patient submitted a financial assistance application,
23 pursuant to the hospital's financial assistance policy and

1 subject to subsection (b) of Section 45. A hospital must use
2 only a uniform financial assistance form developed and
3 provided by the Attorney General.
4 (b) Presumptive eligibility [Eligibility]. The Attorney
5 General shall, by rule, adopt appropriate methodologies for
6 the determination of presumptive eligibility no later than
7 June 30, 2013. On or before January 1, 2013, a statewide
8 association representing a majority of hospitals may submit to
9 the Attorney General recommendations concerning those
10 methodologies, and the Attorney General shall take those
11 recommendations into account when adopting rules under this
12 subsection.

14 Section 99. Effective date. This Act takes effect upon
15 becoming law.

Amends the Fair Patient Billing Act. Provides that the Attorney General shall, by rule, adopt provisions for a uniform financial assistance form (rather than adopt standard provisions) to be included in all applications for financial assistance. Provides that, on or before December 31, 2026, interested stakeholders (rather than a statewide association representing a majority of hospitals) may submit to the Attorney General recommendations concerning a uniform application (rather than standard provisions to be used in an application) for financial assistance, and the Attorney General shall take reasonably relevant recommendations (rather than those recommendations) into account when adopting specified rules. Provides that approval of eligibility for financial assistance is valid for at least 12 months after the first service date for which the patient submitted a financial assistance application. Requires a hospital to use only a uniform financial assistance form developed and provided by the Attorney General. Effective immediately.
