SYNOPSIS AS INTRODUCED:
105 ILCS 85/37 new
Amends the Student Online Personal Protection Act. Provides that a student, school, or parent that has been injured or aggrieved by a violation of the Act may bring an action in a court of competent jurisdiction against the person or entity that violated the Act. Specifies that the provisions establishing a private right of action do not limit the Attorney General's enforcement authority under the Act.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Student Online Personal Protection Act is
5 amended by adding Section 37 as follows:
6 (105 ILCS 85/37 new)
7 Sec. 37. Private right of action. A student, school, or
8 parent that has been injured or aggrieved by a violation of
9 this Act may bring an action in a court of competent
10 jurisdiction against the person or entity that violated this
11 Act. This Section does not limit the Attorney General's
12 enforcement authority under Section 35.

Amends the Student Online Personal Protection Act. Provides that a student, school, or parent that has been injured or aggrieved by a violation of the Act may bring an action in a court of competent jurisdiction against the person or entity that violated the Act. Specifies that the provisions establishing a private right of action do not limit the Attorney General's enforcement authority under the Act.
