SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONAN ACT relating to K-12 public school finance; implementingthe 2025 cost of education study as modified by thelegislature; modifying the education resource block grantmodel; modifying cash reserves; restricting expenditure offunds distributed through the school foundation programaccount; creating a new grant program for the postsecondary education enrollment options program; makingconforming amendments; requiring rulemaking; repealingprovisions; providing an appropriation; and providing foreffective dates.Be It Enacted by the Legislature of the State of Wyoming:Section 1. W.S. 21-13-309.1 and 21-13-339 through21-13-341 are created to read:21-13-309.1. Education resource block grant modelcomponents.(a) This section is intended to specify the educationresource block grant model components and computationsnecessary to execute the 2025 cost of education study asrequired by W.S. 21-13-309(t) and as adopted and modifiedby the legislature.(b) As used in this section:(i) "Average daily membership" or "ADM" meansas defined by W.S. 21-13-101(a)(i) and calculated pursuantto W.S. 21-13-309(m)(iv);(ii) "Education resource block grant model"means as defined by W.S. 21-13-101(a)(xiv);1ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(iii) "Co-located school" means two (2) or moreschools, each with its own administrative structure, thatoperate within the same physical facility, regardless ofwhether the schools serve the same or different gradebands;(iv) "FTE" means full-time equivalency basis ascomputed in accordance with the department of educationrule;(v) "Grade band" means a school gradeconfiguration that falls within one (1) of the followingconfigurations:(A) An elementary school grade band thatincludes grades kindergarten through grade six (6) or anycombination of those grades;(B) A middle school grade band thatincludes grades five (5) through eight (8) or grade six (6)through grades nine (9) or any combination of grades withinthose ranges;(C) A high school grade band that includesgrades eight (8) through grade twelve (12) or anycombination of those grades.(c) The education resource block grant modelcomponents and associated resources are as follows:(i) Full day kindergarten. Funded for allelementary school grade bands;(ii) Core teachers. For any school with greaterthan fifty (50) ADM, one (1.0) FTE for every sixteen (16)2ORIGINAL SENATE ENGROSSEDFILE NO. FTEequal to twenty percent (20%) of the core teacherscalculated pursuant to paragraph (ii) of this subsection;(B) Middle school grade bands. FTE equal tothirty-three and one-third percent (33 1/3%) of the coreteachers calculated pursuant to paragraph (ii) of thissubsection;(C) High school grade bands. FTE equal tothirty-three and one-third percent (33 1/3%) of the coreteachers calculated pursuant to paragraph (ii) of thissubsection.(iv) For any school with greater than fifty (50)ADM, additional career and technical education teachers.FTE equal to thirty-four percent (34%) of each school'scareer and technical education students as determinedpursuant to W.S. 21-13-309(m)(v)(D)(I), divided bytwenty-five (25);(v) Minimum teachers. Resourced at the highestprototypical school model:(A) For any school with greater than fifty(50) ADM, if the combined total FTE calculated pursuant toparagraphs (ii), (iii) and (iv) of this subsection is lessthan the applicable minimum specified in subdivisions (I)3ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONthrough (III) of this subparagraph, the grade band shall beprovided the applicable minimum teacher FTEs as follows:(I) For an elementary school gradeband with greater than fifty (50) ADM, six (6) FTE and foran elementary school grade band with fifty (50) ADM orless, six (6) FTE reduced on a pro rata basis, calculatedby multiplying six (6) teacher FTEs by a fraction, thenumerator of which is the elementary school grade band ADMand the denominator of which is fifty (50);(II) For a middle school grade bandwith greater than fifty (50) ADM, seven (7) FTE and for amiddle school grade band with fifty (50) ADM or less, seven(7) FTE reduced on a pro rata basis, calculated bymultiplying seven (7) teacher FTEs by a fraction, thenumerator of which is the middle school grade band ADM andthe denominator of which is fifty (50);(III) For a high school grade bandwith greater than fifty (50) ADM, nine (9) FTE and for ahigh school grade band with fifty (50) ADM or less, nine(9) FTE reduced on a pro rata basis, calculated bymultiplying nine (9) teacher FTEs by a fraction, thenumerator of which is the high school grade band ADM andthe denominator of which is fifty (50).(B) For any school with fifty (50) ADM orless, the minimum teacher FTEs shall be provided asfollows:(I) For an elementary school, six (6)FTE reduced on a pro rata basis, calculated by multiplyingsix (6) teacher FTEs by a fraction, the numerator of which4ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONis the school's ADM and the denominator of which is fifty(50);(II) For a middle school, seven (7)FTE reduced on a pro rata basis, calculated by multiplyingseven (7) teacher FTEs by a fraction, the numerator ofwhich is the school's ADM and the denominator of which isfifty (50);(III) For a high school, nine (9) FTEreduced on a pro rata basis, calculated by multiplying nine(9) teacher FTEs by a fraction, the numerator of which isthe school's ADM and the denominator of which is fifty(50);(IV) Notwithstanding subdivisions (I)through (III) of this subparagraph, each school shallreceive a minimum of one (1.0) FTE.(C) For any school district that includesgrades kindergarten through grade twelve (12), if thecombined total FTE calculated pursuant to paragraphs (ii),(iii) and (iv) of this subsection and subparagraphs (A) and(B) of this paragraph is less than seventeen (17) for theschool district, additional FTEs shall be provided toensure the total teacher FTE for the school district isequal to seventeen (17).(vi) Summer school teachers. One (1.0) FTE forevery one hundred twenty (120) at-risk students identifiedpursuant to W.S. 21-13-309(m)(v)(A);(vii) Extended day school teachers. One (1.0)FTE for every one hundred twenty (120) at-risk studentsidentified pursuant to W.S. 21-13-309(m)(v)(A);5ORIGINAL SENATE ENGROSSEDFILE NO. One(1.0) FTE for every one hundred (100) students identifiedas limited English proficient in accordance with rulesenacted by the department of education pursuant to W.S.21-13-309(m)(v)(A);(ix) Instructional facilitators. Resourced atthe highest prototypical school model using total schoolADM:(A) Elementary schools. One and one-half(1.5) FTE for every three hundred thirty (330) ADM;(B) Middle schools. One and one-half (1.5)FTE for every three hundred fifteen (315) ADM;(C) High schools. One and one-half (1.5)FTE for every three hundred fifteen (315) ADM;(D) Notwithstanding subparagraphs (A)through (C) of this paragraph, each school district shallreceive a minimum of one (1.0) FTE.(x) At-risk/core tutors. An amount equal to:(A) For FTEs, five and seven hundredfifteen thousandths percent (5.715%) of the combined totalFTEs generated by paragraphs (ii) through (x) of thissubsection;(B) For employer paid social security andMedicare benefits, the amount calculated in subparagraph(A) of this paragraph multiplied by a daily salary asspecified in subparagraph (xxxiv)(P) of this subsection,multiplied by seven and sixty-five hundredths percent(7.65%).(xii) Counselors. Resourced at each grade band:(A) Elementary school grade bands. One(1.0) FTE for every three hundred thirty (330) ADM;(B) Middle school grade bands. One (1.0)FTE for every two hundred fifty (250) ADM;(C) High school grade bands. One (1.0) FTEfor every two hundred fifty (250) ADM;(D) Notwithstanding subparagraphs (A)through (C) of this paragraph, each school district shallreceive a minimum of one (1.0) FTE.(xiii) Pupil support positions. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONmodel using the total ADM of all schools on the landacreage;(B) Acreage acquired by a district afterJuly 1, 1997 shall be calculated using the lesser of theactual site acreage on which the facility is situated orthe acreage specified in the state constructiondepartment's rules, provided that this limitation shall notapply if the acreage was acquired through an exchange withanother governmental entity and the acreages involved inthe exchange were originally acquired by the district andthe governmental entity on or prior to July 1, 1997;(C) A base groundskeeper FTE for eachschool site for the immediately preceding school year shallbe equal to the authorized acreage computed undersubparagraphs (A) and (B) of this paragraph multiplied byninety-three (93) hours per acre divided by two thousandeight (2,008) hours of work per year. The basegroundskeeper FTE shall be adjusted by a factor equal tothe base groundskeeper FTE multiplied by one andfive-tenths (1.5) for middle school sites and two andfive-tenths (2.5) for high school sites;(D) Groundskeeper FTE positions fordistrict level sites shall be equal to ten percent (10%) ofthe school level groundskeeper FTE positions calculatedunder subparagraph (C) of this paragraph.(xxxii) Operations and maintenance supplies. Theauthorized education space for each school building, asdetermined under W.S. 21-13-309(m)(v)(G), multiplied by onedollar and two cents ($1.02) per square foot and adjustedby a factor of one and one-tenth (1.1);21ORIGINAL SENATE ENGROSSEDFILE NO. Actual school year 2024-2025general fund expenditures by school district excludingamounts reimbursed under W.S. 21-13-320 and 21-13-321adjusted by the external cost adjustment in accordance withW.S. 21-13-309(o). For additional buildings added orremoved from school district building inventories afterschool year 2024-2025, one hundred percent (100%) of2024-2025 district average utility expenditures per grosssquare foot for district school buildings as adjusted bythe external cost adjustment in accordance with W.S.21-13-309(o) multiplied by the additional or removed squarefootage;(xxxiv) Salaries. The average salaries for thepositions specified in this subsection shall be as follows:(A) Superintendents: one hundred sixty-fourthousand three hundred sixty-seven dollars ($164,367.00);(B) Deputy/assistant superintendents: onehundred twenty-four thousand nine hundred ninety-fourdollars ($124,994.00);(C) Director/coordinators: one hundredfifteen thousand nine hundred five dollars ($115,905.00);(D) Other central office professionalpersonnel: ninety thousand dollars ($90,000.00);(E) Network supervisor/software managers:sixty-eight thousand five hundred sixteen dollars($68,516.00);(F) Computer technicians: sixty thousandthree hundred fifty-eight dollars ($60,358.00);22ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(G) Principals: one hundred fifteenthousand nine hundred five dollars ($115,905.00);(H) Assistant principals: one hundred eightthousand nine hundred fifty-one dollars ($108,951.00);(J) Teachers, including instructionalfacilitators, tutors, counselors, pupil support, librariansand nurses: seventy‑five thousand eight hundred sixty‑threedollars ($75,863.00);(K) Secretary/accounting personnel:forty-seven thousand four hundred thirty-two dollars($47,432.00);(M) Supervisory/library aides: twenty-ninethousand four hundred thirty-four dollars ($29,434.00);(N) Maintenance workers: fifty-threethousand seven hundred twenty-four dollars ($53,724.00);(O) Groundskeepers/custodians: thirty-seventhousand six hundred five dollars ($37,605.00);(P) Substitute teachers: one hundredeighty-five dollars ($185.00) per day.(xxxv) In determining the resources allocated toeach school district, each salary specified in paragraph(xxxiv) of this subsection shall be adjusted in thefollowing order:(A) Multiplied by the external costadjustment adopted by the legislature pursuant to W.S.23ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION21-13-309(o) and in accordance with paragraph (xxxviii) ofthis subsection;(B) Multiplied by the lowest regional costadjustment specified in subsection (f) of this section forthe applicable school year to establish a baseline salary;(C) The baseline salary for each positioncomputed in subparagraph (B) of this paragraph shall befurther multiplied by each school district's rebasedregional cost adjustment determined in subsection (f) ofthis section for the applicable school year to determinethe salary for each school district for each position.(xxxvi) Employer-paid payroll costs. Indetermining the resources allocated to each schooldistrict, each salary shall be multiplied by eight andforty-one hundredths percent (8.41%), including:(A) Social security equal to six andtwo-tenths percent (6.2%). Social security benefits shallbe limited to each salary up to the maximum taxableearnings amount as of January 1 of the immediatelypreceding school year;(B) Medicare equal to one and forty-fivehundredths percent (1.45%);(C) Workers' compensation equal toseven-tenths percent (0.7%);(D) Unemployment insurance equal tosix-hundredths percent (0.06%).24ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(xxxvii) Health insurance. Health insurancebenefits shall be computed pursuant to W.S.21-13-309(m)(v)(F);(xxxviii) External cost adjustment. Thefollowing categories of model components shall be adjustedby the external cost adjustment adopted by the legislaturepursuant to W.S. 21-13-309(o):(A) "Education materials category"including the following components:(I) Instructional and librarymaterials component resourced under paragraph (xxi) of thissubsection;(II) Student activities componentresourced under paragraph (xxiv) of this subsection;(III) Professional developmentcomponent determined under paragraph (xxv) of thissubsection;(IV) Central office nonpersonnelresources under paragraph (xxviii) of this subsection;(V) Operations and maintenancesupplies resources under paragraph (xxxii) of thissubsection.(B) "Energy category" includes theutilities component resourced under paragraph (xxxiii) ofthis subsection;25ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(C) "Nonprofessional labor category"includes salaries for secretaries and accounting staff,supervisory and library aides, groundskeepers andcustodians and maintenance workers identified underparagraph (xxxiv) of this subsection;(D) "Professional labor category" includingsalaries for superintendents, deputy and assistantsuperintendents, directors and coordinators, other centraloffice professional personnel, network supervisors andsoftware managers, computer technicians, principals,assistant principals and teachers identified underparagraph (xxxiv) of this subsection.(d) Amounts resourced through the education resourceblock grant model for FTE generated pursuant to paragraphs(c)(ii) through (x) of this section shall only be expendedby a school district for instructional purposes and shallnot be expended or transferred for any other purpose. Asused in the subsection, "instructional purposes" includesindividual, group or class instructional activities toprovide educational programs required under W.S. 21-9-101by teachers, tutors, paraeducators or instructional aidesor any combination thereof, the use of instructionalfacilitators or any other instructional activity to assistin the instructional process. Nothing in this subsectionshall prohibit a district from hiring fewer or morepositions than resourced under paragraphs (c)(ii) through(x) of this section, prohibit a district from hiringparaeducators or instructional aides for instructionalpurposes or prohibit a district from contracting to deliverthe educational program. Expenditures related totechnology and equipment or instructional materials are notappropriate expenditures for instructional purposes underthis subsection.26ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(e) Notwithstanding any other provision of law,co-located schools shall be treated as a single school forpurposes of funding, staffing and resource allocationthrough the education resource block grant model. The ADMfor co-located schools shall be aggregated, and nocomponent of the education resource block grant model, orany categorical allocation shall be calculated ordistributed on a separate or duplicative basis forco-located schools, unless expressly authorized by law.(f) The salary for each staffing category shall befurther adjusted for regional cost differences as follows:(i) By the hedonic wage index as computed in the2025 cost of education study. For school year 2027-2028 andeach year thereafter, the hedonic wage index shall beupdated annually by the legislative service office until itis recalibrated in accordance with W.S. 21-13-309(t). Eachsalary under paragraph (c)(xxxiv) of this section shall beadjusted by the lowest annual hedonic wage index toestablish a baseline state average salary for each positionin the education resource block grant model. The baselinestate average salary shall be further adjusted by eachschool district's rebased hedonic wage index with a minimumof one hundred (100) as the index value or an adjustedrebased hedonic wage index as computed in paragraph (ii) ofthis subsection;(ii) If the difference between a schooldistrict's rebased Wyoming cost-of-living index and itsrebased hedonic wage index is greater than thirty-three(33) percentage points, the difference, less thirty-three(33) percentage points, shall be added to a district'srebased hedonic wage index. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONcost-of-living index used under this paragraph for anyschool year shall be the average of the six (6) consecutivesemi-annual index reports completed by January 1 of theimmediately preceding school year and each semi-annualindex report shall be rebased with the minimum of one (100)as the index value.21-13-339. Retirement; K-12 public school employees.In addition to amounts resourced and computed by theeducation resource block grant model and amounts reimbursedunder W.S. 21-13-320 and 21-13-321, the department ofeducation shall reimburse each school district forretirement benefits equal to the percentage paid for stateemployee members under W.S. 9-3-413 and 9-3-413.1, butonly for those employees' salaries paid from amountsspecified by W.S. 21-13-309.1, 21-13-320 or 21-13-321. If aportion of an employee's total salary is paid from fundsother than those amounts specified by W.S. 21-13-309.1,21-13-320 or 21-13-321, only the proportional amount shallbe subject to reimbursement. The department shallpromulgate rules regarding employee eligibility forreimbursement under this section and the informationrequired from school districts to reimburse retirementbenefit costs under this section. The department shallreimburse the amount computed under this section to eachschool district monthly or in accordance with the scheduleprovided under W.S. 21-13-313(c).21-13-340. Instructional reserve account;expenditures; reporting.(a) Each school district may establish aninstructional reserve account.28ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(b) The account shall consist of any unexpended andunencumbered funds resourced through the education resourceblock grant model, pursuant to W.S. 21-13-309.1(c)(ii)through (x), for instructional purposes, as defined by W.S.21-13-309.1(d). Interest and other earnings shall becredited to the account. Unexpended and unencumbered monieswithin the account at the end of each fiscal year shall notlapse but shall remain in the account. These funds shall beexcluded from the school district's operating balance andcash reserves calculated pursuant to W.S. 21-13-313(e). Inno event shall these funds be transferred or expended forany other purpose, except as authorized by subsection (c)of this section.(c) Funds within the instructional reserve accountmay be expended by school districts for instructionalpurposes as defined by W.S. 21-13-309.1(d), to mitigate thefiscal impact of declining enrollment or to recruit, hireand retain instructional personnel.(d) Each school district shall report annually to thedepartment of education the balance of the instructionalreserve account and a general accounting of theexpenditures from the account. Reporting shall be in themanner and form required by the department of education.(e) The department of education shall promulgaterules, including reporting requirements and procedures fordistricts, to implement this section.21-13-341. Dual enrollment district reimbursementprogram; administration; application; distribution.(a) In addition to funding generated by the educationresource block grant model, the department of education29ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONshall reimburse each school district for amounts expendedfor student enrollment in and completion of dual enrollmentcourses pursuant to an agreement with the University ofWyoming or a community college under W.S. 21-20-201. Fromamounts appropriated by the legislature, the department ofeducation shall distribute funds not to exceed ten milliondollars ($10,000,000.00) each school year from the publicschool foundation program account pursuant to this section.(b) The department of education shall promulgaterules necessary to implement this section. The rules shall,at a minimum, establish the form, manner and procedures forsubmitting reimbursement requests and the timeline andprocess for approval or denial. Any denial shall be inwriting and shall state the specific reasons for thedenial.(c) The department shall annually distribute funds toschool districts in accordance with this section. If thefunds appropriated for this program are insufficient to payapproved reimbursement expenses submitted by schooldistricts, the payments shall be reduced on a pro ratabasis relative to each school district's proportion ofcompleted credit hours.(d) Notwithstanding any other provision of law,school districts, the University of Wyoming and communitycolleges shall not limit the number of dual enrollmentcourses in which a student may enroll pursuant to W.S.21-20-201.(e) Not later than October 1 of each year, thedepartment of education shall report to the joint educationinterim committee the total reimbursements awarded, thenumber of participating districts and students, total30ORIGINAL SENATE ENGROSSEDFILE NO. Members' and employers' contributionsbased on actuarially determined contribution rates;calculation of rates; reports.(a) Beginning with the 2027-2028 fiscal biennium, theretirement system shall calculate the percentage of salaryfor members' contributions required under W.S. 9-3-412(a)and for the employers' contribution required under W.S.9-3-413 based on an actuarially determined contributionrate in accordance with the following:(v) After calculation of the actuariallydetermined contribution rate under paragraph (ii) of thissubsection, the state budget department and the retirementsystem shall calculate necessary amounts to account for anychanges in the appropriations necessary to fund thecontributions for the public employee retirement plan and31ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONshall include those amounts in the budget prepared underW.S. 9-2-1010 through 9-2-1014.1, including changes inamounts for school districts necessary to account for theemployer's share of the actuarially determined contributionrate in accordance with this section for benefits paid fromthe education resource block grant model defined in W.S.21-13-101(a)(xiv) and as enumerated in AttachmentA(b)(xxxviii), as defined in W.S. 21-13-101(a)(xvii) inaccordance with W.S. 21-13-339;16-4-105. Accumulated retained earnings or fundsurplus; capital improvements reserve.(b) Except as specifically prohibited under W.S.21-13-504(b) for school district boards of trustees, amunicipality may appropriate funds from estimated revenuein any budget year to a reserve for capital improvementsand for depreciation within any capital improvements fund,and for the purpose of purchasing or replacing specifiedequipment or a depreciation reserve for equipment, whichhas been duly established by ordinance. Money in thereserves may be allowed to accumulate from year to yearuntil the accumulated total is sufficient to permiteconomical expenditure for the specified purposes.Disbursements from reserves shall be made only by transferto a revenue account within a capital improvements fundpursuant to an appropriation for the fund. The amountappropriated to reserves under this subsection in anybudget year shall not exceed ten percent (10%) of themunicipality's total revenues for that budget year.21-2-202. Duties of the state superintendent.(g) Paragraphs (a)(xxxviii) and (xxxix) of thissection are repealed July 1, 2026 July 1, 2027.32ORIGINAL SENATE ENGROSSEDFILE NO. Wyoming Accountability in Education Act;statewide education accountability system created.(b) A statewide education accountability system shallbe established by the state board through the department ofeducation in accordance with this section, which implementsthe components of the education resource block grant modelas defined by W.S. 21-13-101(a)(xiv) and as contained inAttachment "A" as defined under W.S. 21-13-101(a)(xvii)21-13-309.1. The first phase of this system shall be aschool-based system that is based on student performance asdetermined through multiple measures of school performance.The goals of the Wyoming Accountability in Education Actare to:21-3-110. Duties of boards of trustees.(a) The board of trustees in each school districtshall:(xlv) Commencing with the budget prepared andadopted for school year 2027-2028 in accordance with W.S.16-4-109 and 16-4-111, the budget shall contain a sectionto report staffing and expenditure variances from eachcomponent contained within the education resource blockgrant model as defined under W.S. 21-13-101(a)(xiv). Anyvariance plus or minus seven and one-half percent (7.5%)shall be reported in each budget with an explanation foreach variance, by component of the education resource blockgrant model. The variances calculated and reported underthis paragraph shall be on a dollar and position basis.21-3-314. Students counted among district ADM;determination of charter school funding.33ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(c) The charter school shall be entitled to thefollowing amounts:(i) Except as provided in paragraph (vi) of thissubsection, one hundred percent (100%) of the foundationprogram amount computed under W.S. 21-13-309(m) and21-13-309.1 based upon the average daily membership of thecharter school, less amounts generated by the charterschool's membership under paragraph (b)(xxix) of"Attachment A" as defined in W.S. 21-13-101(a)(xvii)21-13-309.1(c)(xxiv) and (xxvii) and less amounts specifiedunder W.S. 21-13-309(m)(v)(E)(III) through (V);(vi) A percentage amount calculated by dividingthe charter school's average daily membership by the totalaverage daily membership of the charter school's respectiveschool district multiplied by the amounts generated fromthe foundation program amount computed under W.S.21-13-309(m) and paragraph (b)(xxix) of "Attachment A" asdefined in W.S. 21-13-101(a)(xvii) 21-13-309.1(c)(xxiv) and(xxvii).21-13-101. Definitions.(a) As used in this chapter:(xiv) "Education resource block grant model"means the block grant model for Wyoming school financecontained within the enumeration of model componentssummarizing and executing recommendations within the 20102025 cost of education study as modified by the legislatureand as referenced in paragraph (xvii) of this subsectioncontained in W.S. 21-13-309.1. "Education resource blockgrant model" or "model" includes model spreadsheets updated34ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONwith technical corrections, all of which are enacted intolaw, on file with the secretary of state and are maintainedand made available for public inspection by the statesuperintendent under W.S. 21-2-202(e), and as may besubsequently modified by the legislature prior to futuremodel recalibration required under W.S. 21-13-309(t);(xvi) "Prototypical school model" means a schoollevel, comprised of cost, resource and enrollmentparameters, as described within the education resourceblock grant model. The separate school levels identifiedwith the model are as follows:(A) Elementary school - kindergartenthrough grade five (5) modeled at cost and resource levelsfor:(II) Ninety-six (96) One hundred ten(110) ADM;(III) One hundred ninety-two (192) Twohundred twenty (220) ADM; and(IV) Two hundred eighty-eight (288)Three hundred thirty (330) ADM.(c) The education resource block grant model asdefined under paragraph (a)(xiv) of this section and asincluded in "Attachment A" referenced in paragraph(a)(xvii) of this section contained in W.S. 21-13-309.1 andoperationalized through the model spreadsheets, as each areenacted into law, and including any technical correctionwhich may be implemented by rule and regulation of thestate superintendent under W.S. 21-2-202(e), shall be filedwith the secretary of state.35ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION21-13-102. Maximum rate of school district tax;recapture of excess; equalization of permissive levies.(e) Annually on or before August 15 September 1 thedepartment shall notify each district subject to recaptureof the estimated amount due to the state during the currentfiscal year, using data from the previous school year. Uponreceipt of the state assessed values by school districts,and not later than March 1 May 31 of the current fiscalyear, the department shall certify to each district subjectto recapture the amount of recapture for the fiscal year tobe remitted to the state. The amount certified shallsupersede the estimates certified on or before August 15September 1. If a district can demonstrate financialinability to make payments to the state as provided insubsection (b) of this section, the superintendent ofpublic instruction may adjust the schedule of paymentsprovided by subsection (b) of this section if the financialintegrity of the foundation program will not bejeopardized.21-13-307. Eligibility to share in distribution ofmoney from foundation account; mandatory financialreporting; prohibition of spending foundation program fundson capital construction.(c) In no event shall any school district transfer orexpend any foundation program amounts, defined under W.S.21-13-101(a)(v), including but not limited to revenuescollected under W.S. 21-13-310 and amounts paid to theschool district for the purpose of funding operationalexpenses under this chapter, for major building andfacility repair or replacement, as defined under W.S.21-15-109(a)(iii), or for a project, as defined under W.S.36ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION21-15-111(a)(iv) or for any educational building, officebuilding, portable building, teacherage or warehousebuilding, as defined under W.S. 21-15-109(a).21-13-309. Determination of amount to be included infoundation program for each district.(m) In determining the amount to be included in thefoundation program for each district, the statesuperintendent shall:(iv) Based upon reports from each district onschools operating within that district for the currentschool year and on grade configurations contained withineach reported school during that school year, compute theaverage daily membership (ADM) for each reported school andeach grade within each reported school in accordance withidentified grade configurations subject to the following:(A) If the district's average ADM for thethree (3) two (2) immediately preceding school years isgreater than the district's ADM from the previous schoolyear, each reported school shall be computed based upon theaverage of the school's ADM counts completed at the end ofthe three (3) two (2) immediately preceding school years,otherwise each reported school within the district shall becomputed based on the school's ADM for the previous schoolyear;(v) Based upon ADM computations and identifiedschool configurations within each district pursuant toparagraph (iv) of this subsection, compute the foundationprogram amount for each district as prescribed by theeducation resource block grant model adopted by the Wyominglegislature as defined under W.S. 21-13-101(a)(xiv)., as37ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONcontained within the spreadsheets and accompanying reportsreferenced under W.S. 21-13-101(a)(xvii). The followingcriteria shall be used by the state superintendent in theadministration of the education resource block grant model:(B) Alternative schools qualifying forseparate consideration under the education resource blockgrant model may be established by a school district foroffering educational programs to students with educationalneeds which the district finds are not appropriately met byother schools in the district, excluding charter schoolsestablished under W.S. 21-3-301 through 21-3-314.Alternative schools included within a district'sconfiguration of schools identified under paragraph (iv) ofthis subsection shall for purposes of the educationresource block grant model:(IV) Except as otherwise provided insubdivision (V) of this subparagraph, on and after July 1,2014, and if not qualifying under subdivision (I) of thissubparagraph, Be approved as an alternative school by thestate superintendent subject to the following:(F) Amounts provided within the model forhealth insurance shall be based upon:(I) Prior year statewide averagedistrict weighted The actual participation participants,for each month of the prior year, of full-time equivalent(FTE) employees funded with amounts allocated from theeducation resource block grant model in district healthinsurance plans as to the proportion of categorized intoemployee only, split contracts, employee plus spouse, oremployee plus children and family coverage. Each FTEreported under this subdivision shall be adjusted by the38ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONdepartment of education to reflect eligible participationin the state group health insurance plan and proportionalcontribution percentages. For any FTE reported under thissubdivision funded from the education resource block grantmodel and any other source of funds, a proportional shareof the FTE shall be used for purposes of this subparagraph;(II) Each reported employee undersubdivision (I) of this subparagraph shall be multiplied bythe annualized state contribution rate as of January 1 ofthe preceding school year, on behalf of each employee andofficial enrolled in the state group health insurance plan,for employee only, split contracts, employee plus spouse,or employee plus children and family coverage except asprovided in subdivision (III) (IV) of this subparagraph;and(IV) For school year 2027-2028 andeach school year thereafter, the amount provided to schooldistricts for health insurance shall be computed asfollows:(1) The amount calculatedpursuant to subdivision (II) of this subparagraph, subjectto subdivision (2) of this subdivision;(2) If the actual prior schoolyear health insurance expenditures for employees fundedwith amounts allocated from the education resource blockgrant model is less than the amount calculated undersubdivision (II) of this subparagraph for that school year,the difference shall be subtracted from the amountcalculated pursuant to subdivision (II) of thissubparagraph.39ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(G) Amounts within the education resourceblock grant model for maintenance and operations shall bebased upon the lesser of the actual educational grosssquare footage of school buildings and facilities or theeducation space prescribed by statewide adequacy standardsunder W.S. 21-15-115 subject to the following:(I) Actual gross square footage ofschool buildings and facilities shall be separated intoeducation and noneducation space categories by school andby district, including leased square footage but excludingsquare footage not used for delivering the requirededucational program and the square footage of any buildingor facility closed and not operational as provided underW.S. 21-15-109(c)(iv);(II) Actual gross square footage ofeducation space shall be the gross square footageprescribed by statewide building adequacy standardspromulgated pursuant to W.S. 21-15-115. Except as otherwiseprovided in this subdivision, Education space capacity inexcess of one hundred fifteen percent (115%) of thestandard space level shall not be included in actual grosssquare footage computations under this subdivision. Forschool year 2025-2026, education space capacity in excessof one hundred thirty-five percent (135%) of the standardspace level shall not be included in actual gross squarefootage computations under this subdivision;(vi) Except for charter schools establishedunder W.S. 21-3-301 through 21-3-314 and alternativeschools approved under subdivision (v)(B)(IV) of thissubsection, any alteration of the configuration of gradeswithin a district, school or school facility which differsfrom the configuration of grades during the immediately40ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONpreceding school year as reported under paragraph (iv) ofthis subsection shall be considered a reconfiguration andshall be documented by the district and reported to thestate superintendent and the director of the stateconstruction department. Following review and evaluation,the state superintendent and the director of the stateconstruction department shall, each acting independently,approve or deny the reconfiguration for purposes ofapplication to the education resource block grant model andthe determination of school facility needs and remedies.The following shall apply:(C) Effective for the school yearcommencing after July 1, 2012, and each school yearthereafter, No reconfiguration of grades within anydistrict, school or facility shall differ from the previousschool year such that more than one (1) school is includedwithin any one (1) school facility to be reported underparagraph (iv) of this subsection for purposes ofdetermining the foundation program amount for thatdistrict;(o) To the extent specifically provided by thelegislature, and between periods of model recalibrationrequired under subsection (t) of this section, the amountcomputed for each district under subsection (m) of thissection shall be adjusted to provide for the effects ofinflation, excluding those amounts specified undersubparagraphs (m)(v)(E) and (F) of this section, thetechnology and equipment component as specified in W.S.21-13-309.1(c)(xxii), the gifted and talented studentscomponent as specified in W.S. 21-13-309.1(c)(xxiii) andthe short cycle and formative assessment componentcontained in paragraph (b)(xxviii) of "Attachment A" asreferenced as specified in W.S. 21-13-101(a)(xvii)41ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION21-13-309.1(c)(xxvi). The adjustment under this subsectionshall not be applied until the expiration of the schoolyear immediately following the first school year ofapplication of the recalibrated model, and shall beadjusted on a cumulative basis each school year thereafterand until the first school year of application of asubsequent model recalibration. Following analysis ofinformation reported under subsection (u) of this section,the joint appropriations interim committee shall submit arecommendation to the legislature and the governor notlater than November 1 of each applicable year on anexternal cost adjustment for purposes of this subsection.(u) To ensure model components specified under theeducation resource block grant model defined under W.S.21-13-101(a)(xiv), as enumerated and enacted by thelegislature and included in "Attachment A" referenced inW.S. 21-13-101(a)(xvii) as specified by W.S. 21-13-309.1,remain resourced at cost-based levels between periods ofmodel recalibration required under subsection (t) of thissection, and prior to adjustment for the effects ofinflation for any school year under subsection (o) of thissection, the joint education interim committee shallannually receive and review reports in accordance with thissubsection and report to the joint appropriations interimcommittee as required by this subsection. The legislativeservice office shall assemble information necessary todevelop a model monitoring process and other reports forthe committee using data maintained by the department ofeducation and other state agencies. For this purpose, thedepartment shall annually update and compile information,in a format contained within reports provided during 20102025 model recalibration, reported at the model componentlevel, on school district allocation of model resources, aswell as other information provided for purposes of42ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONdeveloping and completing the 2010 2025 cost of educationstudies. Each year excluding the first school year ofapplication of any model recalibration performed undersubsection (t) of this section, the information andanalysis assembled by the legislative service office underthis subsection shall be reported to the joint educationinterim committee in sufficient time to allow committeereview of and deliberation on the report and the submissionof recommendations to the joint appropriations interimcommittee by October 15 of the applicable school year.Report recommendations shall be used by the jointappropriations interim committee in its determination oflegislative recommendation on model adjustment undersubsection (o) of this section.21-13-310. Annual computation of district revenues.(a) To ensure revenues available to each district areuniformly sufficient to enable compliance with the uniformstandards for educational programs prescribed under W.S.21-9-101 and 21-9-102 and to secure state boardaccreditation of educational programs under W.S.21-2-304(a)(ii), the revenues specified under thissubsection shall be deemed state revenues and shall beconsidered in determining the amount to be distributed toeach district under W.S. 21-13-311. A district shall makean annual computation of the following revenues:(xv) One-half (1/2) of the amount of realizedinvestment earnings received on school districtinvestments;(xv)(xvi) All other revenues received orcollected by the district during the previous school year,but excluding any amount received from private43ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONcontributions and gifts, excluding any revenues dedicatedby law to the payment of bonded indebtedness, and anyrevenues from the disposition of school buildings and landpursuant to W.S. 21-15-123(f)(vi), and excluding fees orother charges imposed by the district for goods orservices, such as rental fees and the price paid foradmission into any place for recreation, entertainment oran athletic event. Upon application of a district, thedepartment shall exclude from this paragraph revenuereceived by the district if the department finds that therevenue could not be used by the district to provideeducational services to students.21-13-313. Distribution of funds from foundationaccount; property tax and cash reserve adjustment;regulations.(b) The state superintendent shall determine on orbefore August 15 September 1 of each year the tentativeallotment of foundation funds to which each district isentitled under this article. In making this determination,the state superintendent may, if current fiscal informationrequired by law to compute the tentative allotment is notavailable for any district, by August 1 of that year, usefiscal information available to the state superintendentfrom the foundation program computations of the previousschool year for that district. The previous year's fiscalinformation shall be adjusted to reflect current fiscalchanges and other information known by or available to thestate superintendent. Upon receiving actual fiscalinformation from a district, the state superintendent shallaccordingly adjust future foundation program determinationsfor that district such that foundation program paymentsappropriately reflect current fiscal information for theapplicable school year.44ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(c) Fifteen percent (15%) Ten percent (10%) of eachdistrict's entitlement shall be paid to the district on orbefore August 15 July 15 of each year and subject to anyadjustment under subsections (d) and (e) of this section,ten percent (10%) nine percent (9%) of each district'sentitlement shall be paid on or about the fifteenth day ofeach month through April of each year. The final paymentfor the balance of each district's entitlement shall bedistributed on or before May 15 of each year. If, afterMarch 1 and before April 1, the state superintendentdetermines that the entitlement to be paid to a districtfor that school year is not accurate, the statesuperintendent shall adjust payments to or payments fromthat district as necessary to correct the inaccuracy assoon as practicable. Except as provided under W.S.21-2-202(e) and 21-13-307(b), after March 31 June 30 of anyschool year, the state superintendent shall not adjust anydistrict's entitlement or fiscal information used tocompute a district's entitlement for that school year, andthe entitlement or fiscal information shall only beadjusted thereafter in accordance with audit reviewpursuant to W.S. 9-1-513.(e) Not later than January 31 of each fiscal year,and except where a different percentage is otherwisespecified in this subsection, the department shall computethe amount by which each district's operating balance andcash reserves at the end of the preceding fiscal yearexceed fifteen percent (15%) twenty percent (20%) of thetotal foundation program amount computed under W.S.21-13-309, 21-13-309.1, 21-13-321 and 21-13-339 for thepreceding fiscal year. In making this calculation, theentire operating balance and cash reserves for eachdistrict for the fiscal year ending June 30, 1997, as45ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONcomputed by the department, shall be separately accountedfor and excluded, until it has been completely expended bythe district. Revenues from settlements of protestedamounts attributable to levies assessed under W.S.21-13-102(a)(i)(A) and (ii)(A) and 21-13-201, regardless ofthe assessment year, shall be accounted for and excludedfrom the calculation under this subsection for a period ofnot more than one (1) year following that fiscal year inwhich the revenue was received by a district, as verifiedin writing by the district and certified by the countytreasurer. Except as otherwise provided in 1997 SpecialSession Laws, chapter 3, section 306(e), as amended, andexcept as excluded under this subsection, that excess shallbe deemed to be a state revenue under W.S. 21-13-310(a) forthe purpose of determining distributions under W.S.21-13-311 and amounts to be rebated under W.S. 21-13-102.The department shall promulgate rules, including reportingrequirements and procedures for districts, to implementthis subsection. As used in this section, "operatingbalance and cash reserves" means those financial resourcesof the district which are not encumbered by the districtboard of trustees for expenditure to meet an existing legalobligation or otherwise restricted by law or regulation forexpenditure on specific educational programs. For purposesof this subsection, any balance within a district'sseparate account established under W.S. 21-15-109(e) formajor building and facility repair and replacement shall bedeemed restricted by law for expenditure as provided byW.S. 21-15-109(e) and shall not be considered an operatingbalance and cash reserve under this section. For the fiscalyear ending June 30, 2022 through the fiscal year endingJune 30, 2028, the department shall compute the amount bywhich each district's operating balance and cash reservesat the end of the preceding fiscal year exceed thirtypercent (30%) of the total foundation program amount46ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONcomputed under W.S. 21-13-309, 21-13-309.1, 21-13-321 and21-13-339 for the preceding fiscal year. During thisperiod, the amount of a district's operating balance andcash reserves that may be increased from fifteen percent(15%) to thirty percent (30%) of the total foundationprogram amount computed under W.S. 21-13-309 for thepreceding fiscal year shall be accounted for and reportedseparately and shall not be transferred or expended forpurposes of capital construction. For purposes of thissubsection, "capital construction" does not include majorbuilding and facility repair and replacement as definedunder W.S. 21-15-109(a)(iii).(g) In addition to subsections (b) and (c) of thissection, the state superintendent shall, for any districtsubject to W.S. 21-13-102(b) as determined by thedepartment for any school year, or for any district notsubject to W.S. 21-13-102(b) whose entitlement amountdetermined under W.S. 21-13-311(a) for any school year isequal to or less than twenty percent (20%) of thefoundation program amount computed under W.S. 21-13-309(p),and upon demonstration by the district of financial need asdocumented by cash flow analysis, provide payments from thepublic school foundation program account in an amount notto exceed one-fifth (1/5) of the foundation program amountcomputed for that district for that school year inaccordance with W.S. 21-13-309. The computed amount shallbe paid to each eligible district on or before September 1after July 1 based upon tentative computations under W.S.21-13-309, for which the department may use fiscalinformation available from foundation program computationsfor the previous school year in the manner provided undersubsection (b) of this section. Any district receiving apayment under this subsection shall repay the public school47ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONfoundation program account not later than December 15 June15 of that school year.21-13-320. Student transportation; amount withinschool foundation program formula for transportationmaintenance and operations expenditures and school buspurchases; school year 2026-2027 reimbursement; repeal ofsubsection (o) of this section effective July 1, 2027;district reporting requirements.(b) There shall be an amount computed for each schooldistrict equal to the base price amount for bus purchaseand lease payment expenditures made by the district duringthe previous school year pursuant to subsection (g) of thissection and for the amount actually expended by thedistrict during the previous school year for:(f) The department of education shall adopt necessaryrules and regulations to implement and enforce statestandards established under this section and to administerthis section. District expenditures computed undersubsection (b) of this section shall not includeexpenditures for employee contributions to the Wyomingretirement system exceeding the amount specified in W.S.9-3-413.1(b)(iii) 21-13-339 of any member employee'ssalary. In addition, the department shall, in accordancewith procedures prescribed by department rule, andregulation, establish a base price for each school bus typeor other student transportation vehicle type for theapplicable fiscal period that complies with minimum statestandards for vehicle specifications and equipment. Thedepartment shall also establish a process includingcompetitive bidding which guarantees the acquisition ofschool buses and other student transportation vehiclesapproved for reimbursement and complying with state minimum48ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONstandards and district fleet size restrictions at theestablished base price for the applicable fiscal year.Department rules shall establish appropriate restrictionson how and under which conditions a school district mayprocure a school bus or other student transportationvehicle, either through purchase or lease, to ensure thatthe procurement method used is the most cost effective.School districts shall notify the department of school busand other student transportation vehicle needs andrequirements for the appropriate fiscal year in the mannerand within the times prescribed by department rule, andregulation, and shall report expenditures, and purchasesand lease arrangements for the applicable reporting period,including vehicles replaced by purchases, and leases, asrequired by department rule. and regulation. The departmentshall annually review and conduct audits as necessary ofinformation submitted under this section. As authorizedunder W.S. 21-13-307(b), the department may correct theinformation reported by districts under this section asnecessary to fairly and accurately reflect the data type,classification and format required to administer thissection in accordance with law and department rules. andregulations.(g) In addition to amounts provided pursuant tosubsection (b) of this section, and for purchases andleases conducted in a manner consistent with departmentrules, the transportation adjustment for each districtunder this section shall include an department shallreimburse each school district for the amount computedunder this subsection expended for the purchase or lease ofschool buses and other vehicles used primarily for thetransportation of students to and from school and to andfrom school activities. Amounts reimbursed under thissubsection shall be based upon the base price establishedby the department under subsection (f) of this section forthe student transportation vehicle type. Amounts includedwithin the adjustment under this subsection and shall besubject to the following:(v) The adjustment Reimbursement for thepurchase or lease of buses and other student transportationvehicles authorized under this subsection shall be paid bythe department not later than three (3) months after themonth in which the school district expends the funds forthe purchase and shall be in an amount equal to:(A) One-fifth (1/5) of The base priceestablished under subsection (f) of this section for eachpurchased school bus or other purchased studenttransportation vehicle for which reimbursement isauthorized and which is made purchased by the district;during the preceding five (5) years;(vi) Amounts included within the adjustment forSchool bus purchases or leases that are fully or partiallypaid for or rebated under the Diesel Emissions ReductionAct, 42 U.S.C. § 16131 et seq., or other similar program,shall be made in accordance with department rule andregulation.(m) No district shall purchase or lease a school busunless it first demonstrates to the department and thedepartment determines that the school district has in goodfaith attempted to purchase or lease a bus that will befully or partially paid for or rebated under the Diesel50ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONEmissions Reduction Act, 42 U.S.C. § 16131 et seq., orother similar program.(o) For school year 2026-2027 only, the department ofeducation shall reimburse each school district for anyremaining balance for buses or other student transportationvehicles purchased in accordance with this section prior toJuly 1, 2026. This subsection is repealed July 1, 2027.21-13-321. Special education; amount provided forspecial education programs and services; reimbursement forout-of-district placements; district reportingrequirements; billing for Medicaid authorized school basedservices.(b) Except for expenditures for out-of-districtspecial education placements, the amount provided to aschool district for special education shall be equal to onehundred percent (100%) of the amount actually expended bythe district during the previous school year for specialeducation programs and services, which shall include theamount actually expended by the district during theprevious school year for reasonable administrative costs tobill for authorized Medicaid services under subsection (h)of this section. Amounts awarded provided under thissection shall be in addition to and shall not be consideredin determining the school foundation program amount underthe education resource block grant model pursuant to W.S.21-13-309. Except for expenditures for out-of-districtspecial education placements, the department of educationshall distribute the amount computed under this section toeach school district in the same proportion and schedule ofdistributions under W.S. 21-13-313(c). Expenditures by adistrict for out-of-district special education placementsshall be reimbursed in the year in which the costs are51ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONincurred and shall be distributed to each school districton a quarterly basis in accordance with rules adopted bythe department of education.(d) The department of education shall adopt necessaryrules and regulations to implement and administer thissection. Districts shall report special education programexpenditures for the applicable reporting period asrequired by department rule and regulation. Districtexpenditures computed under subsection (b) of this sectionshall not include expenditures for employee contributionsto the Wyoming retirement system exceeding the amountspecified in W.S. 9-3-413.1(b)(iii) 21-13-339 of any memberemployee's salary. The department shall annually review andreport to the joint education interim committee regardingservices provided to special education students by schooldistricts. In addition, the department shall whennecessary, conduct audits of information submitted bydistricts under this section and may, in accordance withW.S. 21-13-307(b), correct the information reported bydistricts as necessary to fairly and accurately reflect thedata type, classification and format required to administerthis section in accordance with law and department rule andregulation.21-13-338. Career and technical education supplies,materials, equipment and repair of equipment; criteria;limitations.(a) Commencing with school year 2025-2026, To augmentamounts within the education resource block grant modelavailable to districts for career and technical educationprograms, the department of education shall distributecareer and technical education supplies, materials,52ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONequipment and repair of equipment funding in accordancewith this section.(c) Amounts distributed to each school district forcareer and technical education supplies, materials,equipment and repair of equipment funding under thissection shall be calculated as follows:(i) Except as provided in paragraph (ii) of thissubsection, the product of each school's FTE career andtechnical education teachers reported under subsection (b)of this section multiplied by fourteen thousand one hundredeighty-four dollars and sixty-eight cents ($14,184.68)fourteen thousand three hundred thirty-six dollars($14,336.00);(ii) If a school's FTE career and technicaleducation teachers reported in subsection (b) of thissection is less than two (2), the amount of funding for theschool's career and technical education supplies,materials, equipment and repair of equipment funding shallbe equal to twenty-eight thousand three hundred sixty-ninedollars and thirty-six cents ($28,369.36) twenty-eightthousand six hundred seventy-two dollars ($28,672.00);(iii) The department shall further adjust theamounts for career and technical education supplies,materials, equipment and repair of equipment funding inparagraphs (i) and (ii) of this subsection by any externalcost adjustment enacted by the legislature for theeducational materials category of the educational resourceblock grant model.(e) Each district shall report to the department onthe expenditure of amounts distributed under this section53ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONand shall provide other information as required by rule ofthe department. Amounts distributed under this sectionshall only be expended on supplies, materials, equipmentand repair of equipment for career and technical educationprograms.21-13-504. Special reserve fund.(a) Except as prohibited under subsection (b) of thissection, the board of trustees of each Wyoming schooldistrict may create a special reserve fund of a specifiedamount, for the purpose of purchasing or replacingspecified equipment or a depreciation reserve for equipmentand school building repair. The board may annually includein its budget for the ensuing fiscal year, the amount sodesignated, as a special fund, expendable only for thepurposes stated and segregated as such, from general andother special school funds, disbursements therefrom to bemade from time to time by the school clerk's warrants drawnagainst said special fund, as duly ordered by said board;provided, that said amount so specially budgeted for anyfiscal year shall not exceed ten percent (10%) of the totalamount budgeted for the same year; and further provided,that any difference in the amount so specially budgeted forany such year and the amount expended from said fund duringsuch year, may be retained in and carried over as a part ofthe special reserve fund.(b) In no event shall any funds generated by theschool foundation program, defined by W.S. 21-13-101(a)(v),that are transferred to a special reserve fund be expendedby the board of trustees of a school district for majorbuilding and facility repair or replacement, as definedunder W.S. 21-15-109(a)(iii), for a project, as definedunder W.S. 21-15-111(a)(iv) or for any educational54ORIGINAL SENATE ENGROSSEDFILE NO. W.S. 21-13-101(a)(xvi)(A)(I), (B)(I),(C)(I) and (xvii), 21-13-309(m)(v)(B)(I), (V), (C),(F)(III) and (G)(III), 21-13-320(g)(v)(B) and (h)(i) arerepealed.Section 4. 2011 Wyoming Session Laws, Chapter 185,ATTACHMENT "A", 2012 Wyoming Session Laws, Chapter 99,Section 3, 2017 Wyoming Session Laws, Chapter 205, Sections3 and 4, 2018 Wyoming Session Laws, Chapter 185, Sections 2and 3 and 2025 Wyoming Session Laws, Chapter 108, Section 3are repealed.Section 5.(a) The select committee on school financerecalibration as created by 2025 Wyoming Session Laws,Chapter 140 is hereby continued. As specified in subsection(b) of this section, the select committee shall continuethe recalibration study of the education resource blockgrant model as required by W.S. 21-13-309(t) to ensure themodel remains cost-based. The study shall include anypotential responses to judicial directives. The legislativeservice office shall staff the select committee.(b) At a minimum, the select committee on schoolfinance recalibration shall study the following areas inthe context of K-12 public education:(i) Mental health supports, including corecounselors, nurses and at-risk pupil support resources. Thestudy shall include consideration of data collected fromschool years 2024-2025 and 2025-2026 for amounts55ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONdistributed pursuant to 2024 Wyoming Session Laws, Chapter118, Section 331 to schools for mental health services;(ii) School safety and security personnel,including employment of school resource officers;(iii) School nutrition programs, including theschool lunch programs;(iv) Technology, including the necessity of one(1) computer for each student for all K-12 public studentsand district and school-level technology infrastructure andcyber security.(c) The select committee on school financerecalibration shall report its recommendations and anyassociated legislation to the legislature. The selectcommittee may sponsor and introduce legislation as providedin W.S. 28-8-104(e).(d) The select committee on school financerecalibration shall remain in existence until December 31,2026. Composition of the select committee and appointmentof members shall be as contained in 2025 Wyoming SessionLaws, Chapter 140, Section 1(a) and (b). Any vacancyoccurring on the select committee shall be filled withoutdelay by the president of the senate or the speaker of thehouse of representatives, as appropriate.(e) The department of education, other stateagencies, school districts and the school data advisorycommittee established under W.S. 21-2-203(d) shall collectand provide information requested by the select committeeor professional consultant experts working with the selectcommittee.56ORIGINAL SENATE ENGROSSEDFILE NO. SF0081ENROLLED ACT NO. 56, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONSection 6.(a) Notwithstanding any other law, for school years2026-2027 through 2028-2029, each school district shallestablish a teacher salary schedule, including pay tables,experience steps and educational lanes, that ensures thatteacher salaries paid by the school district are equal tothe greater of:(i) The average teacher salary for each schooldistrict as calculated pursuant to W.S. 21-13-309.1; or(ii) Up to one hundred ten percent (110%) of theaverage teacher salary paid by the district for thepreceding school year.Section 7. Two hundred seventy-five million sixty-five thousand nine hundred fifty-five dollars($275,065,955.00) is appropriated from the public schoolfoundation program account to the department of education-school finance for purposes of making payments to schooldistricts in accordance with this act and to supplementamounts otherwise appropriated by the 2026 legislature in2026 Senate File 0001 for the school foundation program. Itis the intent of the legislature that twenty million fivehundred sixty-five thousand nine hundred fifty-five dollars($20,565,955.00) not be included in the department ofeducation-school finance's standard budget for theimmediately succeeding fiscal biennium.57ORIGINAL SENATE ENGROSSEDFILE NO.
