Provides that beginning July 1, 2026, each school district shall determine a plan for responding to all incidents of battery committed by students against teachers and other school personnel, which shall include reporting and documentation procedures, student safety plans, behavioral intervention plans, and remedies for injured teachers and school personnel. Effective immediately.LRB104 19505 LNS 32953 bA BILL FORSB4033 LRB104 19505 LNS 32953 b1 AN ACT concerning education.2 Be it enacted by the People of the State of Illinois,3 represented in the General Assembly:4 Section 5. The School Code is amended by changing Section5 10-21.7 as follows:6 (105 ILCS 5/10-21.7) (from Ch. 122, par. 10-21.7)7 Sec. 10-21.7. Attacks on school personnel.8 (a) In the Section, "school" means any public or private9 elementary or secondary school.10 (b) Upon receipt of a written complaint from any school11 personnel, the school shall report all incidents of battery12 committed against teachers, teacher personnel, administrative13 personnel or educational support personnel to the local law14 enforcement authorities immediately after the occurrence of15 the attack. Schools shall also report all of these incidents16 to the State Board of Education through existing school17 incident reporting systems as they occur during the year by no18 later than August 1 for the preceding school year. The State19 Board of Education shall report data by school district, as20 collected from school districts, in an annual report of21 attacks on school personnel and make it available to the22 public via its website. The local law enforcement authority23 shall, by March 1 of each year, report the required data fromSB4033 - 2 - LRB104 19505 LNS 32953 b1 the previous year to the Illinois State Police's Illinois2 Uniform Crime Reporting Program.3 (c) Beginning July 1, 2026, each school district shall, in4 good faith cooperation with its teachers or, where applicable,5 with the exclusive bargaining representatives of its teachers,6 determine a plan for responding to all incidents of battery7 committed by students against teachers and other school8 personnel. Plans must include, but are not limited to,9 reporting and documentation procedures, student safety plans,10 behavioral intervention plans, and remedies for injured11 teachers and school personnel.12 (Source: P.A. 102-538, eff. 8-20-21; 102-894, eff. 5-20-22.)13 Section 99. Effective date. This Act takes effect upon14 becoming law.
Amends the School Code.
