2  REQUESTING THE PUBLIC REGULATION COMMISSION TO CONVENE A
3  WORKING GROUP TO DEVELOP RECOMMENDATIONS FOR A REGULATORY AND
4  STATUTORY FRAMEWORK THAT WOULD PROMOTE RELIABLE AND
5  CONSISTENT ACCESS TO UTILITIES FOR TENANTS RESIDING IN MOBILE
6  HOME PARKS.

8WHEREAS, mobile homes make up roughly one-sixth of all
9  houses in New Mexico; and
10WHEREAS, a significant portion of mobile homes in the
11 state are located within mobile home parks; and
12WHEREAS, mobile home park residents often own a mobile
13 home while renting the land the home occupies from the mobile
14 home park owner; and
15WHEREAS, the owner of a mobile home park is responsible
16 for providing utilities, including water, electricity, gas
17 and sewer, to a tenant's mobile home; and
18WHEREAS, many mobile home park tenants have experienced
19 frequent and lengthy interruptions in access to utilities;
20 and
21WHEREAS, there are currently few remedies for mobile
22 home park tenants who have limited or nonexistent access to
23 utilities; and
24WHEREAS, the various utilities that serve mobile home
25 parks and mobile home park tenants are often under vastly       HM 54

1  different regulatory schemes, with varying levels of
2  oversight from varying regulatory entities; and
3WHEREAS, improved oversight and regulation are needed to
4  promote fair access to utilities in mobile home parks;
5NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
6  REPRESENTATIVES OF THE STATE OF NEW MEXICO that the public
7  regulation commission be requested to convene a working group
8  to develop recommendations for a regulatory and statutory
9  framework that would promote reliable and consistent access
10 to utilities for tenants residing in mobile home parks; and
11      BE IT FURTHER RESOLVED that the working group be
12 requested to be composed of a diverse group of stakeholders
13 that includes:
14A.   representatives from the public regulation
15 commission;
16B.   the superintendent of regulation and licensing,
17 or the superintendent's designee;
18C.   the attorney general, or the attorney general's
19 designee;
20D.   a representative from an association that
21 represents mobile home park owners;
22E.   a representative from an association that
23 represents mobile home park tenants;
24F.   a representative from a municipal utility; and
25G.   a representative from a group that advocates      HM 54

1  for low-income persons; and
2BE IT FURTHER RESOLVED that the working group be
3  requested to report its findings, conclusions and
4  recommendations to the appropriate interim legislative
5  committees that study housing and property issues by November
6  1, 2026; and
7BE IT FURTHER RESOLVED that copies of this memorial be
8  transmitted to the superintendent of regulation and licensing,
9  the chair of the public regulation commission and the attorney
