hm54/enrolled.txt1A MEMORIAL2 REQUESTING THE PUBLIC REGULATION COMMISSION TO CONVENE A3 WORKING GROUP TO DEVELOP RECOMMENDATIONS FOR A REGULATORY AND4 STATUTORY FRAMEWORK THAT WOULD PROMOTE RELIABLE AND5 CONSISTENT ACCESS TO UTILITIES FOR TENANTS RESIDING IN MOBILE6 HOME PARKS.78WHEREAS, mobile homes make up roughly one-sixth of all9 houses in New Mexico; and10WHEREAS, a significant portion of mobile homes in the11 state are located within mobile home parks; and12WHEREAS, mobile home park residents often own a mobile13 home while renting the land the home occupies from the mobile14 home park owner; and15WHEREAS, the owner of a mobile home park is responsible16 for providing utilities, including water, electricity, gas17 and sewer, to a tenant's mobile home; and18WHEREAS, many mobile home park tenants have experienced19 frequent and lengthy interruptions in access to utilities;20 and21WHEREAS, there are currently few remedies for mobile22 home park tenants who have limited or nonexistent access to23 utilities; and24WHEREAS, the various utilities that serve mobile home25 parks and mobile home park tenants are often under vastly HM 54Page 11 different regulatory schemes, with varying levels of2 oversight from varying regulatory entities; and3WHEREAS, improved oversight and regulation are needed to4 promote fair access to utilities in mobile home parks;5NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF6 REPRESENTATIVES OF THE STATE OF NEW MEXICO that the public7 regulation commission be requested to convene a working group8 to develop recommendations for a regulatory and statutory9 framework that would promote reliable and consistent access10 to utilities for tenants residing in mobile home parks; and11 BE IT FURTHER RESOLVED that the working group be12 requested to be composed of a diverse group of stakeholders13 that includes:14A. representatives from the public regulation15 commission;16B. the superintendent of regulation and licensing,17 or the superintendent's designee;18C. the attorney general, or the attorney general's19 designee;20D. a representative from an association that21 represents mobile home park owners;22E. a representative from an association that23 represents mobile home park tenants;24F. a representative from a municipal utility; and25G. a representative from a group that advocates HM 54Page 21 for low-income persons; and2BE IT FURTHER RESOLVED that the working group be3 requested to report its findings, conclusions and4 recommendations to the appropriate interim legislative5 committees that study housing and property issues by November6 1, 2026; and7BE IT FURTHER RESOLVED that copies of this memorial be8 transmitted to the superintendent of regulation and licensing,9 the chair of the public regulation commission and the attorney10 general.
