SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONAN ACT relating to water within Wyoming's portion of theColorado River basin; establishing a voluntary waterconservation program; providing an application and approvalprocess for the program; providing an appeal process;authorizing the storage and release of water conservedunder the program; establishing a sunset date; providinglegislative findings; requiring a report; requiringrulemaking; authorizing positions; providing anappropriation; and providing for an effective date.Be It Enacted by the Legislature of the State of Wyoming:Section 1. W.S. 41-3-117 through 41-3-119 are createdto read:41-3-117. Definitions; short title.(a) As used in this act:(i) "Colorado River basin" shall have the samemeaning as defined in the Colorado River Compact and in theUpper Colorado River Basin Compact;(ii) "Colorado River Compact" means the documentsigned on November 24, 1922, by representatives from thestates of Arizona, California, Colorado, Nevada, NewMexico, Utah, and Wyoming, and codified at W.S. 41-12-301;(iii) "Colorado River system" shall have thesame meaning as defined in the Colorado River Compact andthe Upper Colorado River Basin Compact;(iv) "Conservation project" means a voluntaryproject approved by the state engineer that reducesconsumptive use within Wyoming's portion of the Colorado1ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONRiver basin or that may help satisfy Wyoming's interstatecompact obligations through interstate agreements or undera valid court order entered by a court of competentjurisdiction;(v) "Consumptive use" means the depletion ofwater for domestic and agricultural beneficial uses asthose terms are defined and referred to in the ColoradoRiver Compact and the Upper Colorado River Basin Compact."Consumptive use" also includes the full amount of water:(A) Consumed in association with theproduction of electrical power other than hydropower;(B) Diverted from the Upper Colorado Riversystem for which there are no return flows to that system,including diversions outside the natural Colorado Riverwatershed.(vi) "Curtailment" means the curtailment ofwater use under the terms of the Upper Colorado River BasinCompact;(vii) "Involuntary water use regulation" meansthe regulation of water rights by a Wyoming hydrographer orwater commissioner as authorized by law and in accordancewith established priorities or as ordered by a court ofcompetent jurisdiction;(viii) "Program" means the voluntary waterconservation program authorized pursuant to this act;(ix) "Upper Colorado River Basin Compact" meansthe document signed on October 11, 1948, by representatives2ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONfrom the states of Arizona, Colorado, New Mexico, Utah, andWyoming, and codified at W.S. 41-12-401;(x) "Upper Colorado River Commission" means theadministrative agency created by article VIII of the UpperColorado River Basin Compact;(xi) "This act" means W.S. 41-3-117 through41-3-119.(b) This act shall be known and may be cited as the"Voluntary Water Conservation Program Act".41-3-118. Conservation project applications andapproval; sunset.(a) Any person with a right to beneficially use waterunder a valid water right that diverts water from withinWyoming's portion of the Colorado River basin may apply tothe state engineer for approval of a conservation project.Conservation project applications submitted under thissection shall be in writing and filed in the office of thestate engineer on a form provided by the state engineer.Conservation project applications may include multiplewater rights and multiple appropriators, and shall beaccompanied by any information that the state engineer mayrequire. If the applicant is not the owner of theapplicable water right, the applicant shall provide writtenconsent from the water right owner.(b) For the purpose of providing notice of theprogram and of conservation project applications to waterright owners and other interested persons, the stateengineer shall provide the opportunity for water rightowners and other interested persons to request notice of3ORIGINAL SENATE ENGROSSEDFILE NO. Any person requesting notice ofconservation project applications under this subsectionshall identify the water district or districts for whichtheir request applies and shall provide a valid mailing oremail address.(c) The state engineer shall publish notice of eachconservation project application filed under subsection (a)of this section on the state engineer's website and shallprovide the regular mail or electronic notice requiredunder this section not less than thirty (30) days beforethe state engineer issues a decision on the application.The state engineer shall provide notice of eachconservation project application to all persons who haverequested notice of applications within that water districtand have provided a valid mailing or email address.Additionally, not less than thirty (30) days before thestate engineer issues a decision on any conservationproject application that proposes to forgo the diversionand use of water for irrigation, the applicant shallcertify to the state engineer that the applicant made agood faith effort to provide notice of the conservationproject by personal contact or regular mail to all ownersof land adjacent to conservation project lands and anycontiguous lands owned by the applicant. The certificationshall include a list that identifies all adjacentlandowners that were notified by the applicant. The ownersof valid water rights whose water rights may be injured bythe proposed conservation project, and any person who maybe aggrieved or adversely affected in fact by aconservation project, may provide written comments to thestate engineer not more than thirty (30) days following thenotice required by this subsection.4ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(d) The state engineer shall review each applicationsubmitted under this section and any written comments thatare received under this section and shall approve onlythose conservation project applications that are incompliance with the requirements of this section and thestate engineer's regulations. The refusal or approval of anapplication for a conservation project in accordance withthis section shall be endorsed thereon, and a record madeof such endorsement in the state engineer's office. Theapplication so endorsed shall be returned to the applicantby regular mail. Approved applications shall also be postedto the state engineer's website.(e) The state engineer shall not approve aconservation project application if the proposedconservation project will injuriously affect the waterrights of other appropriators and will not:(i) Result in the reduction of historicconsumptive use; or(ii) Help satisfy Wyoming's interstate compactobligations through interstate agreements or under a validcourt order entered by a court of competent jurisdiction.(f) The state engineer may refuse any conservationproject application that appears to be detrimental to thepublic interest or that appears to provide for or aid inthe interstate marketing of water. The state engineer mayapprove a conservation project subject to any conditions orlimitations that the state engineer determines arenecessary, including any conditions or limitations tomitigate any local water impacts that a conservationproject may cause.5ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(g) Approved conservation projects shall not causethe regulation of any other Wyoming water right by thestate of Wyoming. However, if an approved conservationproject is located on a source of supply that is beingregulated by a water commissioner under W.S. 41-3-606, thewater commissioner may prevent headgates of all downstreamdiversions that are subject to the regulation from thatsource of supply from diverting and using any waterconserved by the conservation project during the period oftime the source of supply is being regulated.(h) The state engineer shall not approve aconservation project application unless the applicantdemonstrates a recent history of consumptive use made underthe applicant's water right or the conservation projecthelps satisfy Wyoming's interstate compact obligationsthrough interstate agreement or otherwise. A recent historyof consumptive use means consumptive use made under theapplicant's water right in not less than three (3) of thefive (5) years preceding the application. To determine thehistoric consumptive use made under a water right, thestate engineer may utilize the methods adopted by the UpperColorado River Commission. For any conservation projectwhere the state engineer determines that alternativemethods may be better suited to determine the historicconsumptive use, including methods to estimate consumptiveuse incident to the diversion, impounding and conveyance ofwater, the state engineer shall have the discretion to usethose alternative methods. The methods and procedures fordetermining historic consumptive use under this subsectionshall not have application to any other statute of thestate of Wyoming.(j) The state engineer shall not approve anyconservation project application, without the written6ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONconsent of the district, that includes water rights thatare appurtenant to lands within:(i) An irrigation district;(ii) A conservancy district; or(iii) A watershed improvement district.(k) For any conservation project that proposes totemporarily forego the diversion and use of the directnatural flow of water for irrigation purposes, the totalperiod of the conservation project approved under thissection shall not exceed five (5) consecutive years. Afterthe expiration of a conservation project approved underthis section that participated in the program for not lessthan two (2) and not to exceed five (5) consecutive years,the water right shall be used for its adjudicated orpermitted purpose for a period of not less than two (2)years before becoming eligible for any furtherparticipation in the program. This subsection shall notapply to approved conservation projects that forego thediversion and use of the direct natural flow of water forirrigation purposes that also achieve long-term reductionsof consumptive use through irrigation system improvements.(m) No loss, abandonment or impairment of any waterrights involved in an approved conservation project shalloccur or attach as a result of the conservation project.Upon termination of the conservation project, the waterright holder's rights, privileges, uses and purposes heldunder the original appropriation shall be automaticallyreinvested.7ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(n) Any appeal of the state engineer's endorsementupon a conservation project application shall be made inthe following manner:(i) Any applicant who is aggrieved by theendorsement made by the state engineer upon his applicationmay appeal the action of the state engineer to the board ofcontrol within thirty (30) days after service by regularmail of the notice of rejection of the application;(ii) Any owner of a valid water right whosewater right will be injuriously affected by the stateengineer's approval of a conservation project may appealthe action of the state engineer to the board of controlnot later than thirty (30) days after the notice ofapproval of the conservation project is posted on the stateengineer's website pursuant to subsection (d) of thissection;(iii) Pursuant to an appeal under paragraph (i)or (ii) of this subsection, the board of control shallappoint a hearing officer and conduct a contested casehearing in accordance with its rules and regulations andthe Wyoming Administrative Procedure Act. The decision ofthe board of control shall be subject to judicial reviewunder W.S. 16-3-114;(iv) Any person not entitled to an appeal underparagraph (i) or (ii) of this subsection and who isaggrieved or adversely affected in fact by the stateengineer's approval of a conservation project may seekjudicial review of the state engineer's action pursuant toW.S. 16-3-114. Judicial review shall be sought withinthirty (30) days after the notice of approval of the8ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONconservation project is posted on the state engineer'swebsite pursuant to subsection (d) of this section.(o) Conservation project applications or approvedconservation projects under this section shall not beconsidered or construed as applications for use of wateroutside of the state of Wyoming, or transfers of use ofwater outside the state of Wyoming, for purposes of W.S.41-3-115.(p) The state engineer shall assess a fee not toexceed fifty dollars ($50.00) for the review ofconservation project applications under this section. Thisfee shall accompany a conservation project application andshall be retained and deposited whether the application isapproved, refused or withdrawn.(q) Information provided by an applicant or includedas part of a conservation project under this act shall notbe subject to W.S. 16-4-203(d)(xiv).(r) No new conservation project shall be authorizedunder this section on or after July 1, 2032.41-3-119. Storage of conserved water.(a) The state engineer and the Wyoming waterdevelopment office are hereby authorized to pursue theability to store water conserved under the program inFontenelle Reservoir. The state engineer and Wyoming waterdevelopment office are further authorized, in a mannerconsistent with contracts entered into with the UnitedStates Bureau of Reclamation, to store or facilitate thestorage of conserved water in Fontenelle Reservoir.9ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(b) Conserved water stored in any reservoir underthis section shall only be released for one (1) or more ofthe following purposes:(i) Beneficial consumptive use within the stateof Wyoming through direct delivery or exchange;(ii) Mitigating the impacts of curtailment orinvoluntary water use regulation on Wyoming water rightholders;(iii) Helping to satisfy any portion ofWyoming's interstate compact obligations through interstateagreements or otherwise, including participating in anUpper Colorado River basin program.(c) The state engineer is hereby authorized toinvestigate other reservoirs located within Wyoming'sportion of the Colorado River basin and assess theirsuitability for the storage of water conserved under theprogram. For any reservoir found to be suitable for thestorage of water conserved under the program the stateengineer is further authorized, in a manner consistent withcontracts entered into with the reservoir owner, to storeor facilitate the storage of conserved water in suchreservoir.Section 2.(a) The state engineer is authorized two (2)additional full-time equivalent positions for the periodbeginning with the effective date of this act and endingJune 30, 2028 to implement the requirements of this act. Itis the intent of the legislature that these two (2)full-time positions be included in the standard budget10ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONrequest for the state engineer for the 2029-2030 fiscalbiennium and thereafter.(b) There is appropriated five hundred ten thousanddollars ($510,000.00) from the general fund to the stateengineer for purposes of funding the positions authorizedin subsection (a) of this section and any other expensesnecessary to implement this act. This appropriation shallbe for the period beginning within the effective date ofthis act and ending June 30, 2028. This appropriation shallnot be transferred or expended for any other purpose andany unexpended, unobligated funds remaining from thisappropriation shall revert as provided by law on June 30,2028. It is the intent of the legislature that thisappropriation be included in the standard budget requestfor the state engineer for the 2029-2030 fiscal bienniumand thereafter.Section 3. The legislature finds that, since 2000,the Colorado River basin has experienced a prolonged periodof unusually low water flow conditions and drought, whichis considered the worst drought in the past one thousandtwo hundred (1,200) years. Under federal law and practice,the secretary of the interior must consult with theColorado River basin states and such state representativesas each governor may designate regarding Colorado Riversystem operations. In order to help inform that federal lawand practice, and to foster interstate comity, thevoluntary conservation program authorized by section 1 ofthis act is intended to help support Wyoming's involvementin a broader Upper Colorado River basin program should onebe approved by the representative designated by Wyoming'sgovernor and the Upper Colorado River Commission. This actis also intended to help Wyoming water users manage severeand prolonged drought conditions and any associated water11ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONuse reductions and impacts in Wyoming's portion of theColorado River basin.Section 4.(a) For the purpose of providing notice of theprogram created in section 1 of this act and ofconservation project applications to water right owners andother interested persons, the state engineer shall:(i) Not later than ninety (90) days after theeffective date of this act, cause to be published in atleast three (3) newspapers published within Wyoming'sportion of the Colorado river basin one (1) time each weekfor three (3) consecutive weeks a notice of the VoluntaryWater Conservation Program Act and how water right ownersand other interested persons may obtain programinformation;(ii) Not later than ninety (90) days after theeffective date of this act, cause to be published in atleast two (2) Wyoming trade publications related to theirrigated agriculture water use sector a notice of theVoluntary Water Conservation Program Act and how waterright owners and other interested persons may obtainprogram information;(iii) Not later than one hundred twenty (120)days after the effective date of this act, hold at leastthree (3) public meetings at different locations withinWyoming's portion of the Colorado river basin that providenotice of the Voluntary Water Conservation Program Act andhow water right owners and other interested persons mayobtain program information.12ORIGINAL SENATE ENGROSSEDFILE NO. SF0084ENROLLED ACT NO. 62, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONSection 5. The state engineer shall promulgate allrules necessary to implement this act.Section 6. Nothing in this act shall be interpretedor construed to impair or otherwise modify existingagreements or any rights, obligations, claims or defensesof the state of Wyoming under the Colorado River Compact,the Upper Colorado River Basin Compact or any other federallaw, state law, administrative rule, regulation orguideline.Section 7. The state engineer shall file a reportwith the select water committee and the joint agriculture,state and public lands and water resources interimcommittee on or before October 1, 2026 and on or beforeOctober 1 of each year thereafter until 2031, detailing theoperation of the program implemented under this act. Thereport under this section shall include recommendations toeach committee regarding the continuance of the program andany advantageous or necessary statutory changes.13ORIGINAL SENATE ENGROSSEDFILE NO.
