                                                   AN ACT
 To repeal section 160.425, RSMo, and to enact in lieu thereof one new section relating to the
           Missouri charter public school commission.
 Be it enacted by the General Assembly of the State of Missouri, as follows:
1Section A.  Section 160.425, RSMo, is repealed and one new
2  section enacted in lieu thereof, to be known as section 160.425,
3  to read as follows:
1160.425.  1. The "Missouri Charter Public School
2  Commission" is hereby created within the department of
3  elementary and secondary education with the authority to
4  sponsor high quality charter schools throughout the state of
5  Missouri.
62. The commission shall consist of nine members
7  appointed by the [governor, by and with the advice and
8  consent of the senate] state board of education.  No more
9  than five of the members shall be of the same political
10  party. No more than two members shall be from the same
11  congressional district.  The term of office of each member
12  shall be four years, except those of the members first
13  appointed, of which three shall be appointed for a term of
14  one year, two for a term of two years, two for a term of
15  three years, and two for a term of four years.  At the
16  expiration of the term of each member, the [governor, by and

 and is intended to be omitted in the law.

17 with the advice and consent of the senate,] state board of
18 education shall appoint a successor.
193. [The appointees to the commission shall be selected
20 as follows:
21(1) One member selected by the governor from a slate
22 of three recommended by the commissioner of education;
23(2) One member selected by the governor from a slate
24 of three recommended by the commissioner of higher education;
25(3) One member selected by the governor from a slate
26 of three recommended by the president pro tempore of the
27 senate;
28(4) One member selected by the governor from a slate
29 of three recommended by the speaker of the house of
30 representatives; and
31(5) Five additional members appointed by the governor,
32 one of whom shall be selected from a slate of three nominees
33 recommended by the Missouri School Boards Association.
344.]   Members appointed to the commission shall
35 collectively possess strong experience and expertise in
36 governance, management and finance, school leadership,
37 assessment, curriculum and instruction, and education law.
38 All members of the commission shall have demonstrated
39 understanding of and commitment to charter schooling as a
40 strategy for strengthening public education.
41[5.] 4. The commission shall annually elect a
42 chairperson and vice chairperson, who shall act as
43 chairperson in his or her absence.    The commission shall
44 meet at the call of the chairperson.    The chairperson may
45 call meetings at such times as he or she deems advisable and
46 shall call a meeting when requested to do so by three or
47 more members of the commission.    Members of the commission
48 are not eligible to receive compensation.

49[6.] 5. The commission may approve proposed charters
50 for its sponsorship under sections 160.400 to 160.425 and
51 shall:
52(1) Comply with all of the requirements applicable to
53 sponsors under sections 160.400 to 160.425;
54(2) Exercise sponsorship over charters approved by the
55 commission under sections 160.400 to 160.425, including
56 receipt of sponsorship funding under subsection 11 of
57 section 160.400.     Sponsorship funding due to the commission
58 shall be deposited to the credit of the charter public
59 school commission revolving fund created pursuant to this
60 section.
61[7.] 6. Charter schools sponsored by the commission
62 shall comply with all of the requirements applicable to
63 charter schools under sections 160.400 to 160.425.
64[8.] 7. The commission shall conduct its business in
65 accordance with chapter 610.
66[9.] 8. The department of elementary and secondary
67 education shall provide start-up funding for the commission
68 to operate. The commission shall reimburse the department's
69 costs from any funds it receives as sponsor under section
70 160.400.
71[10.] 9.    The commission is authorized to receive and
72 expend gifts, grants, and donations of any kind from any
73 public or private entity to carry out the purposes of
74 sections 160.400 to 160.425, subject to the terms and
75 conditions under which they are given, provided that all
76 such terms and conditions are permissible under law.
77[11.] 10.   There is hereby created in the state
78 treasury the "Charter Public School Commission Revolving
79 Fund", which shall consist of moneys collected under this
80 section. The state treasurer shall be custodian of the

81 fund. In accordance with sections 30.170 and 30.180, the
82 state treasurer may approve disbursements.   Notwithstanding
83 the provisions of section 33.080 to the contrary, any moneys
84 remaining in the fund at the end of the biennium shall not
85 revert to the credit of the general revenue fund.   The state
86 treasurer shall invest moneys in the fund in the same manner
87 as other funds are invested.   Subject to appropriation,
88 moneys in the fund shall be used solely for the
89 administration of this section.
