 Pari-mutuel wagering-highway fund.

                                     for
1 AN ACT relating to gaming; requiring the disposition of
2 pari-mutuel funds paid to the state to be deposited to the
3 state highway fund; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7Section   1.   W.S.   11-25-201(b)(intro),      (iii)    and   by
8 creating a new paragraph (v) and (d) is amended to read:
9
1011-25-201.     Pari-mutuel    permits;   fees   and     reports;
11 disposition of funds; enforcement of provisions.
12
13(b)   Every Wednesday following any pari-mutuel event,
14 the permittee shall complete all of the following:

1(iii)    Pay an amount equal to one percent (1%) of
2 the     total       amount        wagered     attributable        to      historic
3 pari-mutuel events, shown by the report to the commission,
4 to be transferred by the commission to the county and the
5 city or town in which the permittee is located, in equal
6 shares, or to the county alone if the permittee is not
7 located      within    the    boundaries       of   a    city     or    town.    The
8 county,      city     or    town    receiving       an   amount        under    this
9 paragraph may credit that amount to the state fair account
10 upon    a majority  vote    of the county's,        city's       or town's
11 governing body; and

13(v)     Pay an amount equal to one percent (1%) of
14 the     total       amount        wagered     attributable        to      historic
15 pari-mutuel events and simulcasting, shown by the report to
16 the commission, to be credited to the state highway fund.

18(d)    All sums paid to the commission under this act
19 except contributions from permittees to the breeder award
20 fund,    amounts      paid     under       paragraphs    (b)(iii)        and    (iv)
21 through (v) of this section, and fines and penalties shall
22 be credited to the pari-mutuel account which shall be used
23 by the commission for the payment of all expenses incurred

1 in enforcing this act. On a quarterly basis, the commission
2 shall transfer amounts within the account in excess of one
3 million five hundred thousand dollars ($1,500,000.00)  to
4 the    state       treasurer      for        credit        to     the        legislative
5 stabilization       reserve      account.  All      fines        and    penalties
6 collected        under   this    act        shall   be       paid       to    the    state
7 treasurer and credited as provided in W.S. 8-1-109. The
8 state treasurer shall pay out of the account all warrants
9 drawn by the state auditor, upon vouchers issued and signed
10 by the president, vice-president or executive secretary of
11 the commission. The commission shall keep an accurate and
12 true account of all funds received and all vouchers issued
13 by    the   commission.     All    funds  received  and    all    vouchers
14 issued      by    the    commission  shall       be      audited        at    least
15 biennially by the director of the state department of audit
16 or his designee and a copy of the audit shall be delivered
17 within thirty (30) days after completion to the governor
18 and the commission. The costs of the audit shall be borne
19 by the commission.  The members of the commission shall
20 receive      per    diem    and     mileage  as        provided       in     W.S.
21 33-1-302(a)(vii),  and     compensation  of        fifty        dollars
22 ($50.00)     for    each    day    during  which  they    are     actually
23 engaged     in     the   discharge  of   their       duties.  The    total

1 expenses incurred by the commission shall not exceed the
2 total amount in the pari-mutuel account.

4Section 2.   This act is effective July 1, 2026.
