HB0136Pari-mutuel wagering-highway fund.Sponsored by: Representative(s) NicholasA BILLfor1 AN ACT relating to gaming; requiring the disposition of2 pari-mutuel funds paid to the state to be deposited to the3 state highway fund; and providing for an effective date.45 Be It Enacted by the Legislature of the State of Wyoming:67Section 1. W.S. 11-25-201(b)(intro), (iii) and by8 creating a new paragraph (v) and (d) is amended to read:91011-25-201. Pari-mutuel permits; fees and reports;11 disposition of funds; enforcement of provisions.1213(b) Every Wednesday following any pari-mutuel event,14 the permittee shall complete all of the following:151 HB01362026 STATE OF WYOMING 26LSO-04751(iii) Pay an amount equal to one percent (1%) of2 the total amount wagered attributable to historic3 pari-mutuel events, shown by the report to the commission,4 to be transferred by the commission to the county and the5 city or town in which the permittee is located, in equal6 shares, or to the county alone if the permittee is not7 located within the boundaries of a city or town. The8 county, city or town receiving an amount under this9 paragraph may credit that amount to the state fair account10 upon a majority vote of the county's, city's or town's11 governing body; and1213(v) Pay an amount equal to one percent (1%) of14 the total amount wagered attributable to historic15 pari-mutuel events and simulcasting, shown by the report to16 the commission, to be credited to the state highway fund.1718(d) All sums paid to the commission under this act19 except contributions from permittees to the breeder award20 fund, amounts paid under paragraphs (b)(iii) and (iv)21 through (v) of this section, and fines and penalties shall22 be credited to the pari-mutuel account which shall be used23 by the commission for the payment of all expenses incurred2 HB01362026 STATE OF WYOMING 26LSO-04751 in enforcing this act. On a quarterly basis, the commission2 shall transfer amounts within the account in excess of one3 million five hundred thousand dollars ($1,500,000.00) to4 the state treasurer for credit to the legislative5 stabilization reserve account. All fines and penalties6 collected under this act shall be paid to the state7 treasurer and credited as provided in W.S. 8-1-109. The8 state treasurer shall pay out of the account all warrants9 drawn by the state auditor, upon vouchers issued and signed10 by the president, vice-president or executive secretary of11 the commission. The commission shall keep an accurate and12 true account of all funds received and all vouchers issued13 by the commission. All funds received and all vouchers14 issued by the commission shall be audited at least15 biennially by the director of the state department of audit16 or his designee and a copy of the audit shall be delivered17 within thirty (30) days after completion to the governor18 and the commission. The costs of the audit shall be borne19 by the commission. The members of the commission shall20 receive per diem and mileage as provided in W.S.21 33-1-302(a)(vii), and compensation of fifty dollars22 ($50.00) for each day during which they are actually23 engaged in the discharge of their duties.
