BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,That the Laws of Maryland read as follows:Article – Health – General15–107.1.(A) BEGINNING IN 2026, THE DEPARTMENT SHALL CONDUCT THEIN–STATE COST–OF–DISPENSING SURVEY AT LEAST ONCE EVERY 3 YEARS.(B) ON OR BEFORE DECEMBER 1 EACH YEAR IN WHICH THE SURVEYREQUIRED UNDER THIS SECTION IS CONDUCTED, THE DEPARTMENT SHALL REPORTTHE RESULTS OF THE SURVEY TO THE GENERAL ASSEMBLY, IN ACCORDANCE WITH§ 2–1257 OF THE STATE GOVERNMENT ARTICLE.15–118.2.WITHIN 6 MONTHS AFTER THE COMPLETION OF THE IN–STATECOST–OF–DISPENSING SURVEY, THE DEPARTMENT SHALL ADOPT REGULATIONSESTABLISHING A FEE–FOR–SERVICE PROFESSIONAL DISPENSING FEE BASED ONTHE RESULTS OF THE SURVEY.–1–Ch. 708 2026 LAWS OF MARYLANDSECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effectOctober 1, 2026.Approved by the Governor, May 26, 2026.–2–
Requiring, beginning in 2026, the Maryland Department of Health to conduct the in-State cost-of-dispensing survey at least every 3 years; and requiring by December 1 each year in which the survey is required, the Department to report the survey results to the General Assembly.
