BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,13 That the Laws of Maryland read as follows:14Article – State Finance and Procurement15 14–419.16(A)IN THIS SECTION, “LOCAL VENDOR” MEANS A VENDOR LOCATED IN THE17 6TH LEGISLATIVE DISTRICT.18(B)THIS SECTION APPLIES ONLY TO STATE CONTRACTS RELATED TO THE19 RECONSTRUCTION OF THE FRANCIS SCOTT KEY BRIDGE.20(C)A UNIT SHALL GIVE PREFERENCE IN THE PURCHASE OF SUPPLIES OR21 SERVICES TO A LOCAL VENDOR AS REQUIRED UNDER SUBSECTION (D) OF THIS22 SECTION.EXPLANATION: CAPITALS INDICATE MATTER ADDED TO EXISTING LAW.[Brackets] indicate matter deleted from existing law.*hb1072*2HOUSE BILL 10721 (D) (1) IF A UNIT AWARDS A CONTRACT USING COMPETITIVE SEALED2 BIDS UNDER § 13–103 OF THIS ARTICLE, THE UNIT SHALL AWARD THE CONTRACT TO3 A LOCAL VENDOR IF THE LOCAL VENDOR:4(I) SUBMITS THE LOWEST RESPONSIVE BID; OR5(II) DOES NOT SUBMIT THE LOWEST RESPONSIVE BID, BUT THE6 DIFFERENCE BETWEEN THE LOCAL VENDOR BID AND THE LOWEST RESPONSIVE BID7 SUBMITTED BY A NONLOCAL VENDOR DOES NOT EXCEED 10%.8(2) IF A UNIT AWARDS A CONTRACT USING COMPETITIVE SEALED9 PROPOSALS UNDER § 13–104 OF THIS ARTICLE, THE UNIT SHALL AWARD THE10 CONTRACT TO A LOCAL VENDOR IF THE LOCAL VENDOR:11(I)SUBMITS THE RESPONSIVE PROPOSAL THAT IS MOST12 ADVANTAGEOUS TO THE UNIT; OR13(II)DOES NOT SUBMIT THE RESPONSIVE PROPOSAL THAT IS14 MOST ADVANTAGEOUS TO THE UNIT, BUT THE DIFFERENCE BETWEEN THE15 PROPOSAL SUBMITTED BY THE LOCAL VENDOR AND THE LOWEST RESPONSIVE16 PROPOSAL SUBMITTED BY A NONLOCAL VENDOR DOES NOT EXCEED 10%.17SECTION 2.
