 Baby Olivia act-requiring human development education.

                                  A BILL
                                    for
1 AN ACT relating to education; specifying requirements for
2 the provision of human development education as specified;
3 specifying    exceptions;       specifying    requirements        for   the
4 department of education to establish and publish acceptable
5 instructional       materials    related     to    human    development
6 education; specifying other duties for the department of
7 education;    requiring      legislative      approval      for     health
8 education    standards    and    curricula    as   specified;       making
9 conforming     amendments;       specifying       applicability;        and
10 providing for effective dates.

12 Be It Enacted by the Legislature of the State of Wyoming:
13
14Section 1.    W.S. 21-9-105 is created to read:
15

121-9-105.  Instruction in human growth and development
2 required; duties of department of education; exceptions.
3
4(a)    Each       school        district       shall   provide    instruction
5 for all students in grades five (5) through (12) in human
6 growth and development. The instruction required under this
7 section shall include, at a minimum:
8
9(i)        A     video    of       an   ultrasound,      conducted    in
10 high-definition, that shows the early fetal development of
11 organs;
12
13(ii)        A video that demonstrates fertilization and
14 the    stages       of       human     development       from   conception       until
15 birth.
16
17(b)    The state department of education shall determine
18 and publish on its website a list of materials suitable to
19 satisfy      the    educational  requirements        specified     in     this
20 section. The department shall make materials available to
21 parents upon request.

1(c)   Each school district shall establish a process by
2 which the parents or guardian of a student may have the
3 student excused from the educational requirements specified
4 in   this    section     upon    written    request     by     the parents or
5 guardian.

7(d)   The state department of education shall, by rule,
8 establish a process by which the department shall conduct
9 annual audits of school districts to ensure that school
10 districts are complying with the educational requirements
11 specified in this section.

13(e)   No    school     district     or    the   state    department     of
14 education      shall      adopt    or     establish      any     instructional
15 material      or    model       curricula       that   conflict     with      the
16 instruction required under this section.

18Section     2.    W.S.     21-9-101(b)(i)       by    creating     a   new
19 subparagraph (P) is amended to read:
20
2121-9-101.        Educational  programs  for      schools;
22 standards;     core      of   knowledge     and    skills;      special    needs
23 programs; class size requirements; cocurricular activities.

2(b)    Each       school    district     within     the     state      shall
3 provide      educational        programs     sufficient     to    meet     uniform
4 student      content      and     performance      standards      at   the    level
5 established  by    the     state    board    of    education      in    the
6 following areas of knowledge and skills:

8(i)    Common core of knowledge:
9
10(P)    Human  development      education,  in
11 accordance with W.S. 21-9-105.
12
13Section 3.  This act shall apply beginning with the
14 2026-2027 school year.
15
16Section 4.  The state board of education, the state
17 department of education and each school district shall take
18 all actions necessary to implement this act.

1Section 5.

3(a)   Except   as       provided   in   subsection      (b)    of   this
4 section, this act is effective July 1, 2026.
5
6(b)   Sections      4    and   5   of   this   act   are      effective
7 immediately upon completion of all acts necessary for a
8 bill to become law as provided by Article 4, Section 8 of
9 the Wyoming Constitution.
