sf2298/introduced.txtSenateFile2298-IntroducedSENATEFILE2298BYCOMMITTEEONCOMMERCE(SUCCESSORTOSSB3090)(COMPANIONTOHF2326BYCOMMITTEEONCOMMERCE)ABILLFORAnActrelatingtodebtmanagementprograms,services,fees,1andlicenseerequirements.2BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:3TLSB5596SV(1)91nls/koS.F.2298Section1.Section533A.8,subsection5,paragrapha,Code12026,isamendedtoreadasfollows:2a.Maintainaseparatebanktrustaccountordedicated3accountinwhichallpaymentsreceivedfromdebtorsforthe4benefitofcreditorsshallbedepositedandinwhichall5paymentsshallremainuntilaremittanceismadetoeitherthe6debtororthecreditor.7Sec.2.Section533A.8,subsection5,paragraphd,Code82026,isamendedbystrikingtheparagraph.9Sec.3.Section533A.8,subsection6,Code2026,isamended10toreadasfollows:116.Ifthedebtmanagementprogramisnotbasedonamodel12whichrequiresthelicenseeoranylicenseetoreceivemoneyor13evidencesthereoffromthedebtortodistributetothedebtor’s14creditors,bothofthefollowingshallapply:15a.Thethedebtorshallmaintainfullcontrolofandaccess16toanymoneyssetasideforpaymenttocreditors.17b.Thelicenseemaynotreceiveconsiderationfromanythird18partyinconnectionwithservicesrenderedtoadebtor.19Sec.4.Section533A.9,subsection4,Code2026,isamended20bystrikingthesubsectionandinsertinginlieuthereofthe21following:224.Ifadebtmanagementprogramisnotbasedonamodelthat23requiresthelicenseeoranotherlicenseetoreceivemoneyor24evidencesthereoffromthedebtortodistributetothedebtor’s25creditors,alicenseemaynotrequestorreceivepaymentof26anyfeeorconsiderationfordebtmanagementservicesprovided27underadebtmanagementprogramunlessallofthefollowingare28true:29a.Thelicenseehasrenegotiated,resolved,reduced,or30otherwisealteredthetermsofatleastonedebtpursuanttoa31resolutionagreementorothercontractualagreementexecuted32bythedebtorandthecreditor.33b.Thedebtorhasmadeatleastonepaymentpursuanttothe34resolutionagreementorothercontractualagreemententered35-1-LSB5596SV(1)91nls/ko1/3S.F.2298intounderparagraph“a”.1c.Totheextentthatdebtsenrolledinthedebtmanagement2programarerenegotiated,resolved,reduced,orotherwise3alteredindividually,thefeeorconsiderationforthedebt4managementservicebearsthesameproportionalrelationshipto5thetotalfeeorconsiderationforrenegotiating,resolving,6reducing,orotherwisealteringthetermsoftheentiredebt7balanceastheindividualdebtamountbearstotheentiredebt8amount.Theindividualdebtamountandtheentiredebtamount9arethoseowedatthetimethedebtwasenrolledinthedebt10managementprogram.Thepercentchargedisthesameforeach11individualdebtenrolledinthedebtmanagementprogram.12Sec.5.Section533A.9,subsection5,Code2026,isamended13bystrikingthesubsection.14Sec.6.Section538A.2,subsection2,Code2026,isamended15byaddingthefollowingnewparagraph:16NEWPARAGRAPH.i.Apersonlicensedtoengageinthe17businessofdebtmanagementundersection533A.2,whenacting18withinthecourseandscopeofthatlicense.19EXPLANATION20Theinclusionofthisexplanationdoesnotconstituteagreementwith21theexplanation’ssubstancebythemembersofthegeneralassembly.22Thisbillrelatestodebtmanagement,services,fees,and23licenseerequirements.24Undercurrentlaw,ifadebtmanagementprogram(program)is25basedonamodelwhichrequiresalicenseetoreceivemoneyor26evidencesthereoffromadebtortodistributetothedebtor’s27creditors,thelicenseewhoreceivesthemoneyfordistribution28shallmaintainaseparatebanktrustaccountinwhichall29paymentsreceivedfromthedebtorforthebenefitofcreditors30shallbedepositedandshallremainuntilaremittanceis31madetoeitherthedebtororthecreditor.Underthebill,a32licenseeshallmaintainaseparatebankaccountordedicated33accountforsuchpurpose.34Undercurrentlaw,ifadebtmanagementprogramisnot35-2-LSB5596SV(1)91nls/ko2/3S.F.2298basedonamodelwhichrequiresalicenseetoreceivemoney1orevidencesthereoffromthedebtortodistributetothe2debtor’screditorsthedebtorshallmaintainfullcontrolof3andaccesstoanymoneyssetasideforpaymenttocreditors,4andthelicenseemaynotreceiveconsiderationfromanythird5partyinconnectionwithservicesrenderedtoadebtor.The6billeliminatestheprohibitiononalicenseereceiving7considerationfromathirdpartyinconnectionwithservices8renderedtoadebtor.9Undercurrentlaw,ifaprogramisnotbasedonamodelthat10requiresalicenseetoreceivemoneyorevidencesthereoffrom11thedebtortodistributetothedebtor’screditors,adebtor12maynotbechargedafeeexceedingthesumoftheinitiation13feeplus18percentofthedebtor’senrolleddebts,asdetailed14inCodesection533A.9(4).Underthebill,alicenseemaynot15requestorreceivepaymentofafeeforservicesunless:(1)16thelicenseehasrenegotiated,resolved,reduced,orotherwise17alteredthetermsofadebtpursuanttoaresolutionagreement18orothercontractualagreementbetweenthedebtorandthe19creditor;(2)thedebtorhasmadeatleastonepaymentpursuant20totheagreement;and(3)totheextentthatdebtsenrolledin21aservicearerenegotiated,resolved,reduced,orotherwise22alteredindividually,thefeeorconsiderationfortheservice23bearsthesameproportionalrelationshiptothetotalfeefor24alteringthetermsoftheentiredebtbalanceastheindividual25debtamountbearstotheentiredebtamountasowedatthetime26thedebtwasenrolledintheservice,andth
