(a) This act shall apply only within the28 corporate limits of Class 1 municipalities and Class 3Page 1HB450 INTRODUCED29 municipalities organized under Act 618 of the 1973 Regular30 Session (Acts 1973, p. 879).31(b) For purposes of this section, the term "valid form32 of identification" shall be all forms of identification listed33 in Section 17-9-30(a), Code of Alabama 1975.34(c) An individual may not possess or have under his or35 her control a firearm if he or she does not have in his or her36 possession, and produce upon request by a law enforcement37 officer, a valid form of identification.38(d) A violation of subsection (c) is a Class C39 misdemeanor.40(e) Notwithstanding subsection (c), if an individual is41 in possession or control of a firearm without a valid form of42 identification, he or she shall not be in violation of43 subsection (c) if, on request of a law enforcement officer, he44 or she correctly identifies himself or herself to the law45 enforcement officer and the officer is able to confirm the46 individual's identity.47(f)(1) The court shall dismiss a charge of violating48 subsection (c) for any individual who produces in court a49 valid form of identification.50(2) The court shall immediately expunge all records,51 including records of arrest, relating to a charge dismissed52 pursuant to subdivision (1).53Section 2.
