sf2320/enrolled.txtSenateFile2320-EnrolledSenateFile2320ANACTMODIFYINGPROVISIONSRELATEDTOTHEDISTRICT-TO-COMMUNITYCOLLEGESHARINGORCONCURRENTENROLLMENTPROGRAM.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:Section1.Section261E.8,subsection3,Code2026,isamendedtoreadasfollows:3.a.Astudentmaymakeapplicationtoacommunitycollegeandtheschooldistricttoallowthestudenttoenrollforcollegecreditinanonsectariancourseofferedbythecommunitycollege.Acomparablecourse,asdefinedinrulesSenateFile2320,p.2adoptedbytheboardofdirectorsoftheschooldistrict,mustnotbeofferedbytheschooldistrictoraccreditednonpublicschoolwhichthestudentattends.b.(1)Ifthecommunitycollegeoffersthecourseusingbothinstructionthatisdeliveredinpersonandusinginstructionthatisdeliveredprimarilyovertheinternet,thenthestudentmustenrollintheversionofthecoursethatusesinstructionthatisdeliveredinpersonunlessthesuperintendentoftheschooldistrict,orthesuperintendent’sdesignee,authorizesthestudenttoenrollintheversionofthecoursethatusesinstructionthatisdeliveredprimarilyovertheinternet.(2)(a)Whendeterminingwhethertoauthorizethestudenttoenrollintheversionofthecoursethatusesinstructionthatisdeliveredprimarilyovertheinternetpursuanttosubparagraph(1),thesuperintendent,orthesuperintendent’sdesignee,shallconsiderifthestudentispreparedfor,andlikelytobesuccessfulin,acoursethatusesinstructionthatisdeliveredprimarilyovertheinternet.(b)Whendeterminingwhethertoauthorizethestudenttoenrollintheversionofthecoursethatusesinstructionthatisdeliveredprimarilyovertheinternetpursuanttosubparagraph(1),thesuperintendent,orthesuperintendent’sdesignee,mayconsideranyotherfactorsdeemedrelevantbythesuperintendent,orthesuperintendent’sdesignee,includingbutnotlimitedtopotentialschedulingconflictsthatmayimpactthestudent’sabilitytoparticipateintheversionofthecoursethatusesinstructionthatisdeliveredinperson.c.Theschoolboardshallannuallyapprovecoursestobemadeavailableforhighschoolcreditusinglocallydevelopedcriteriathatestablisheswhichcourseswillprovidethestudentwithacademicrigorandwillpreparethestudentadequatelyfortransitiontoapostsecondaryinstitution.d.Ifacommunitycollegeacceptsastudentforenrollmentunderthissection,theschooldistrict,incollaborationwiththecommunitycollege,shallsendwrittennoticetothestudent,thestudent’sparentorlegalguardianinthecaseofaminorchild,andthestudent’sschooldistrict.Thenoticeshalllistthecourse,theclockhoursthestudentwillbeSenateFile2320,p.3attendingthecourse,andthenumberofhoursofcollegecreditthatthestudentwillreceivefromthecommunitycollegeuponsuccessfulcompletionofthecourse.______________________________AMYSINCLAIRPresidentoftheSenate______________________________PATGRASSLEYSpeakeroftheHouseIherebycertifythatthisbilloriginatedintheSenateandisknownasSenateFile2320,Ninety-firstGeneralAssembly.______________________________W.CHARLESSMITHSONSecretaryoftheSenateApproved_______________,2026______________________________KIMREYNOLDSGovernor
