  A BILL ENTITLED
1 AN ACT concerning
2      Motor Vehicles – Vehicles Previously Registered as Historic Vehicles –
3Emissions Inspection and Insurance
4 FOR the purpose of authorizing motor vehicles that are registered in the State and were
5      previously registered as Class L (historic) vehicles to be insured by certain specialty
6      insurance policies; exempting motor vehicles that are registered in the State and
7      were previously registered as Class L (historic) vehicles from the Vehicle Emissions
8      Inspection Program; establishing a certain recurring fee on motor vehicles registered
9      in the State that were previously registered as Class L (historic) vehicles and that
10      are exempt from the Vehicle Emissions Inspection Program; and generally relating
11      to motor vehicles previously registered as Class L (historic) vehicles.

1(a)   There is a Transportation Trust Fund for the Department.
2(b)    Except as otherwise expressly provided by statute, there shall be credited to
3 the Transportation Trust Fund for the account of the Department all taxes, fees, charges,
4 and revenues collected or received by or paid, appropriated, or credited to the account of
5 the Department or any of its units in the exercise of their rights, powers, duties, or
6 obligations, including the cash proceeds of the sale of consolidated transportation bonds,
7 notes, or other evidences of obligation issued by the Department, any General Fund
8 appropriations, and the proceeds of any State loan or federal grant made for transportation
9 purposes.

11      NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A MOTOR VEHICLE OF A
12 MODEL YEAR OF 2000 OR LATER THAT IS REGISTERED IN THE STATE AND WAS
13 PREVIOUSLY REGISTERED UNDER § 13–936 OF THIS SUBTITLE AS A CLASS L
14 (HISTORIC) VEHICLE MAY BE INSURED BY A HISTORIC VEHICLE, A SHOW VEHICLE,
15 OR AN ANTIQUE VEHICLE INSURANCE POLICY.
16 23–202.
17(a)    (1)    Subject to subsection (d) of this section, the Administration and the
18 Secretary shall establish an emissions control program in the State in accordance with the
19 federal Clean Air Act.
20(2)    The program shall remain in effect only as long as required by federal
21 law.
22(b)    (1)    Subject to paragraph (3) of this subsection, the emissions control
23 program shall provide for a biennial exhaust emissions test and emissions equipment and
24 misfueling inspection for all vehicles of the 1977 model year and each model year thereafter.
25(2)   The emissions control program may not authorize an exhaust emissions
26 test or emissions equipment and misfueling inspection for any vehicle of a model year
27 earlier than the 1977 model year.
28(3)     (i)   In this paragraph, “qualified hybrid vehicle” means an
29 automobile that:
301.     Meets all applicable regulatory requirements;
312.    Meets the current vehicle exhaust standard set under the
32 federal Tier 2 program for gasoline–powered passenger cars under 40 C.F.R. Part 80 et seq.;

13.   Can draw propulsion energy from both of the following
2 sources of stored energy:
3A.   Gasoline or diesel fuel; and
4B.   A rechargeable energy storage system.
5(ii)   A qualified hybrid vehicle is not required to submit to a first
6 exhaust emissions test and emissions equipment and misfueling inspection until 3 years
7 after the date on which the vehicle was first registered in the State.

9      THE ADMINISTRATION SHALL ESTABLISH A FEE OF $30 TO BE COLLECTED
10 ONCE EVERY 2 YEARS ON EACH MOTOR VEHICLE REGISTERED IN THE STATE THAT
11 WAS PREVIOUSLY REGISTERED UNDER § 13–936 OF THIS ARTICLE AS A CLASS L
12 (HISTORIC) VEHICLE AND IS EXEMPT FROM MANDATORY INSPECTIONS UNDER §
13 23–206.3 OF THIS SUBTITLE.

15A MOTOR VEHICLE WITH A MODEL YEAR OF 2000 OR LATER THAT IS
16 REGISTERED IN THE STATE AND WAS PREVIOUSLY REGISTERED UNDER § 13–936 OF
17 THIS ARTICLE AS A CLASS L (HISTORIC) VEHICLE IS EXEMPT FROM THE MANDATORY
18 INSPECTIONS REQUIRED BY THIS SUBTITLE.
19SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
20 October 1, 2026.
