Minnesota Statutes 2025 Supplement, section 124D.901, subdivision 1, is1.7 amended to read:1.8Subdivision 1. Definitions. For the purposes of this section, the following terms have1.9 the meanings given:1.10(1) "new position" means a student support services personnel full-time or part-time1.11 position not under contract by a school district, charter school, or cooperative unit at the1.12 start of the 2022-2023 school year;1.13(2) "part-time position" means a student support services personnel position less than1.14 1.0 full-time equivalent at the start of the 2022-2023 school year; and1.15(3) "student support services personnel" means:1.16(i) an individual licensed to serve as a school counselor, school psychologist, school1.17 social worker, school nurse, or chemical dependency counselor in Minnesota.; or1.18(ii) a special education teacher licensed in Minnesota as an academic and behavioral1.19 strategist, or in developmental disabilities, emotional or behavioral disorders, learning1.20 disabilities, or autism spectrum disorders.1.21EFFECTIVE DATE. This section is effective for revenue in fiscal year 2027 and later.Section 1. 102/12/26 REVISOR CR/EI 26-07082 as introduced2.1 Sec. 2. Minnesota Statutes 2025 Supplement, section 124D.901, subdivision 4, is amended2.2 to read:2.3 Subd. 4. Allowed uses. (a) Aid under this section must be used to enhance student2.4 support services by:2.5 (1) increasing new student support services personnel positions;2.6 (2) increasing a current student support services personnel position that is less than 1.02.7 full-time equivalent to a greater number of service hours; or2.8 (3) making permanent a student support services personnel position hired using onetime2.9 resources.2.10 (b) Cooperative student support personnel aid must be transferred to the intermediate2.11 district or other cooperative unit of which the district is a member and used to hire new2.12 positions for student support services personnel or increase a current position that is less2.13 than 1.0 full-time equivalent to a greater number of service hours or make permanent a2.14 position hired using onetime resources at the intermediate district or cooperative unit.2.15 (c) If a school district, charter school, or cooperative unit does not receive at least two2.16 applications and is not able to hire a new full-time equivalent position with student support2.17 personnel aid or use the aid as otherwise provided under subdivision 4a, the aid may be2.18 used for contracted services from individuals licensed to serve as a school counselor, school2.19 psychologist, school social worker, school nurse, or chemical dependency counselor in2.20 Minnesota individuals serving as student support services personnel.2.21 (d) In addition to the personnel uses authorized under paragraphs (a), (b), and (c) and2.22 subdivision 4a, a district, charter school, or cooperative unit may use up to $5,000 of student2.23 support personnel aid each year for the following purposes:2.24 (1) to cover the costs of providing training or job-embedded coaching; or2.25 (2) to cover the costs of student support personnel travel among school sites operated2.26 by a single district, charter school, or cooperative unit, or among school sites operated by2.27 a cooperative unit's member districts or a group of charter schools.2.28 EFFECTIVE DATE. This section is effective for revenue in fiscal year 2027 and later.2.29 Sec. 3. Minnesota Statutes 2025 Supplement, section 124D.901, is amended by adding a2.30 subdivision to read:2.31 Subd. 6. Accounting. Costs paid by student support personnel aid under this section2.32 must not be included in the calculation of special education expenditures under sectionSec. 3. 202/12/26 REVISOR CR/EI 26-07082 as introduced3.1 125A.76. The commissioner may establish procedures to ensure that any costs reimbursed3.2 under this section are excluded from other school revenue calculations.3.3 EFFECTIVE DATE.
