sf2379/enrolled.txtSenateFile2379-EnrolledSenateFile2379ANACTRELATINGTOVICTIMPROTECTIONSINCLUDINGVICTIMCOUNSELORS,PROTECTIVEORDERS,SEXOFFENDERREGISTRATION,RIGHTSOFSEXUALABUSEVICTIMS,MENTALCOMPETENCYANDCIVILCOMMITMENT,RESTITUTION,ANDVICTIMRIGHTS,ANDINCLUDINGEFFECTIVEDATEPROVISIONS.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:DIVISIONIVICTIMCOUNSELORSSection1.Section915.20A,subsection1,paragraphsaandd,Code2026,areamendedtoreadasfollows:a.“Confidentialcommunication”meansinformationsharedbetweenacrimevictimandavictimcounselorwithintheSenateFile2379,p.2counselingrelationship,andincludesallinformationreceivedbythecounselorandanyadvice,report,orworkingpapergiventoorpreparedbythecounselorinthecourseofthecounselingrelationshipwiththevictim.“Confidentialinformation”isconfidentialinformationwhichthat,sofarasthevictimisaware,isnotdisclosedtoathirdpartywiththeexceptionofapersonpresentintheconsultationforthepurposeoffurtheringtheinterestofthevictim,apersontowhomdisclosureisreasonablynecessaryforthetransmissionoftheinformation,orapersonwithwhomdisclosureisnecessaryforaccomplishmentofthepurposeforwhichthecounselorisconsultedbythevictim,orasmayberequiredbythissection.d.“Victimcounselor”meansapersonwhoisengagedinacrimevictimcenter,iscertifiedasacounselorbythecrimevictimcenter,andisunderthecontrolofadirectservicessupervisorofacrimevictimcenter,whoseprimarypurposeistherenderingofadvice,counseling,andassistancetothevictimsofcrime.Toqualifyasa“victimcounselor”victimcounselorunderthissection,thepersonmustalsohavecompletedatleasttwentyhoursoftrainingprovidedbythecenterinwhichthepersonisengaged,bytheIowaorganizationofvictimassistance,bytheIowacoalitionagainstsexualassault,orbytheIowacoalitionagainstdomesticviolence,orbyanorganizationundercontractwiththedepartmenttoprovidetraining,whichtrainingshallincludebutnotbelimitedtothedynamicsofvictimization,substantivelawsrelatingtoviolentcrime,humantrafficking,sexualassault,anddomesticviolence,crisisinterventiontechniques,communicationskills,workingwithdiversepopulations,anoverviewofthestatecriminaljusticesystem,informationregardingpertinenthospitalprocedures,andinformationregardingstateandcommunityresourcesforvictimsofcrime.Sec.2.Section915.20A,subsections2and5,Code2026,areamendedtoreadasfollows:2.Avictimcounselorshallnotbecompelledtoproduceconfidentialcommunicationsorconfidentialinformationorbeexaminedorrequiredtogiveevidenceinanycivilorcriminalproceedingastoanyconfidentialcommunicationorconfidentialinformationmadebyavictimtothecounselor,norshallaSenateFile2379,p.3clerk,secretary,stenographer,oranyotheremployeewhotypesorotherwisepreparesormanagestheconfidentialreportsorworkingpapersofavictimcounselorberequiredtoproduceevidenceofanysuchconfidentialcommunicationorconfidentialinformation,unlesstheexceptunderanyofthefollowingcircumstances:a.Thevictimwaivesthisprivilegeinwritingordisclosure.b.Disclosureoftheinformationiscompelledbyacourtpursuanttosubsection7.Undernocircumstancesshallthelocationofacrimevictimcenterortheidentityofthevictimcounselorbedisclosedinanycivilorcriminalproceeding.5.Theprivilegeunderthissectiondoesnotapplyinmattersofproofconcerningthechainofcustodyofevidence,orinmattersofproofconcerningthephysicalappearanceofthevictimatthetimeoftheinjuryorthecounselor’sfirstcontactwiththevictimaftertheinjury,orwherethecounselorhasreasontobelievethatthevictimhasgivenperjuredtestimonyandthedefendantorthestatehasmadeanofferofproofthatperjurymayhavebeencommitted.DIVISIONIIPROTECTIVEORDERSSec.3.Section236A.7,subsection3,Code2026,isamendedtoreadasfollows:3.a.Anorderforaprotectiveorderorapprovedconsentagreementshallbeforafixedperiodoftimenottoexceedoneyearexceptasprovidedinthissection.Thecourtmayamendorextenditsorderoraconsentagreementatanytimeuponapetitionfiledbytheplaintiffordefendantandafternoticeandhearing.Thecourtmayextendtheorderifthecourt,afterhearingatwhichthedefendanthastheopportunitytobeheard,findsthatthedefendantcontinuestoposeathreattothesafetyoftheplaintiff,personsresidingwiththeplaintiff,ormembersoftheplaintiff’simmediatefamily.Thenumberofextensionsthatcanbegrantedbythecourtisnotlimited.b.Notwithstandingparagraph“a”,inthesentencingproceedingforapersonconvictedofasexualoffenseasprovidedinsection709.8,709.8A,709.11,709.12,709.14,SenateFile2379,p.4709.15,709.21,or709.23,anyviolationofchapter710A,oraviolationofsection713.3,subsection1,paragraph“d”,aprosecutormayrequestthatthecriminalcourtgrantthevictimanorderofprotectiontoremainineffectforthedurationofthecriminalcourt’sjurisdictionovertheperson.Atanytimeaftertheexpirationofacriminalcourt’sjurisdictionoverapersonagainstwhomanorderofprotectionwasgrantedpursuanttoarequestunderthisparagraph,thevictimmay:(1)Fileapetitionforanorderofprotectionagainsttheperson.(2)Submitevidenceoftheperson’sconvictionforasexualoffenseasprovidedinthissectionascauseforthecourttogranttheorderofprotection.c.Basedonevidencesubmittedpursuanttoparagraph“b”,acourtmaytakejudicialnoticeofthefactsthatledtoaperson’sconvictionforasexualoffenseasprovidedinthissectionandavictimshallnotberequiredtoappearbeforethecourtonthevictim’spetitionforanorderofprotection;provided,however,thatanotherpersonmayappearonthevictim’sbehalf.d.Acourtmaygrantanorderofprotectionpursuanttothissectionforanylengthoftime,includingforavictim’slifetime.e.Anorderofprotectiongrantedpursuanttothissectionshallcontinueuntiltheexpirationprovidedintheorder,ifany,oruntilmodifiedorrescindeduponamotionbythevictim.DIVISIONIIISEXOFFENDERREGISTRATIONSec.4.Section692A.104,subsections1,2,3,5,7,and8,Code2026,areamendedtoreadasfollows:1.Asexoffendershallappearinpersontoregisterwiththesheriffofeachcountywheretheoffenderhasaresidence,maintainsemployment,orisinattendanceasastudent,withinfivethreebusinessdaysofbeingrequiredtoregisterundersection692A.103byprovidingallrelevantinformationtothesheriff.Asheriffshallaccepttheregistrationofanypersonwhoisrequiredtoregisterinthecountypursuanttotheprovisionsofthischapter.SenateFile2379,p.52.Asexoffendershall,withinfivethreebusinessdaysofchangingaresidence,employment,orattendanceasastudent,appearinpersontonotifythesheriffofeachcountywhereachangehasoccurred.3.Asexoffendershall,withinfivethreebusinessdaysofachangeinrelevantinformation,otherthanrelevantinformationenumeratedinsubsection2,notifythesheriffofthecountywheretheprincipalresidenceoftheoffenderismaintainedaboutthechangetotherelevantinformation.Thedepartmentshallestablishbyrulewhatconstitutespropernotificationunderthissubsection.5.Asexoffendershall,withinfivethreebusinessdaysoftheestablishmentofaresidence,employment,orattendanceasastudentinanotherjurisdiction,appearinpersontonotifythesheriffofthecountywheretheprincipalresidenceoftheoffenderismaintained,abouttheestablishmentofaresidence,employment,orattendanceinanotherjurisdiction.Asexoffendershall,withinfivethreebusinessdaysofestablishinganewresidence,employment,orattendanceasastudentinanotherjurisdiction,registerwiththeregisteringagencyoftheotherjurisdiction,iftheoffenderisrequiredtoregisterunderthelawsoftheotherjurisdiction.Thedepartmentshallnotifytheregisteringagencyintheotherjurisdictionofthesexoffender’snewresidence,employment,orattendanceasastudentintheotherjurisdiction.7.Exceptasprovidedinsubsection8,theinitialorsubsequentregistrationandanynotificationsrequiredinsubsections1,2,4,5,and6shallbebyappearanceatthesheriff’sofficeandcompletionoftheinitialorsubsequentregistrationornotificationshallbeonaprintedform,whichshallbesignedanddatedbythesexoffender.Ifthesheriffusesanelectronicformtocompletetheinitialregistrationornotification,theelectronicformshallbeprinteduponcompletionandsignedanddatedbythesexoffender.Thesheriffshalltransmittheregistrationornotificationformcompletedbythesexoffenderwithinfivethreebusinessdaysbypapercopy,orelectronically,usingproceduresestablishedbythedepartmentbyrule.8.ThecollectionofrelevantinformationbyacourtorSenateFile2379,p.6releasingagencyundersection692A.109shallserveasthesexoffender’sinitialorsubsequentregistrationforpurposesofthissection.However,thesexoffendershallregisterbyappearinginpersoninthecountyofresidencetoverifytheoffender’sarrivalandrelevantinformation.Thecourtorreleasingagencyshallforwardacopyoftheregistrationtothedepartmentwithinfivethreebusinessdaysofcompletionofregistrationusingproceduresestablishedbythedepartmentbyrule.Sec.5.Section692A.105,Code2026,isamendedtoreadasfollows:692A.105Additionalregistrationrequirements——temporarylodging.Inadditiontotheregistrationprovisionsspecifiedinsection692A.104,asexoffender,withinfivethreebusinessdaysofachange,shallalsoappearinpersontonotifythesheriffofthecountyofprincipalresidence,ofanylocationinwhichtheoffenderisstayingwhenawayfromtheprincipalresidenceoftheoffenderformorethanfivedays,byidentifyingthelocationandtheperiodoftimetheoffenderisstayinginsuchlocation.Sec.6.NEWSECTION.692A.105AAdditionalregistrationrequirements.Inadditiontotheregistrationprovisionsspecifiedinsection692A.104,asexoffender,withinthreebusinessdaysofachange,shallalsoappearinpersontonotifythesheriffofthecountyofthesexoffender’sprincipalresidenceofthefollowing:1.Thename,address,andtelephonenumberofthesexoffender’splaceofemployment,andanychangestosuchinformation.2.Thelicenseplatenumberandaphysicaldescription,includingmake,model,andcolor,ofanyvehicleownedorregularlyoperatedbythesexoffender.DIVISIONIVSEXUALABUSE——RIGHTSSec.7.Section709.10,subsections6and7,Code2026,areamendedtoreadasfollows:6.ThelawenforcementagencyshallstorethekitinaSenateFile2379,p.7clean,drylocationforaminimumoffifteentwentyyears,orinthecaseofaminorvictimforaminimumoffifteenyearsaftertheminorreachestheageofmajoritythelifetimeoftheminorvictim,evenifthereportedvictimofsexualabusehasnotfiledacriminalcomplaint.7.Priortothedisposalofakitbyalawenforcementagency,thelawenforcementagencyshallnotifythereportedvictimofinwritingnotfewerthansixtydaysbeforetheintendeddateofdisposalofthekit,thereasonfordisposalofthekit,andtheoptionsthatremainavailableforretentionandanalysisofthekit,ifany.Thelawenforcementagencyshallobtainwrittenapprovalfromtheappropriatecountyattorneyandretainthatapprovalinthevictim’scasefilepriortodisposal.Anykitdisposedofshallbedocumentedbyalawenforcementagencyinthekittrackingsystemwithinforty-eighthoursofdisposal.Uponwrittenrequestofthereportedvictim,thelawenforcementagencyshallgrantfurtherpreservationofthekitoritsprobativecontents.Sec.8.Section709.22,subsection1,paragraphc,Code2026,isamendedtoreadasfollows:c.Providingavictimwithimmediateandadequatenoticeofthevictim’srights.Thenoticeshallconsistofhandingthevictimadocumentthatincludesthetelephonenumbersofshelters,supportgroups,andcrisislinesoperatingintheareaandcontainsthefollowingstatementofrightswritteninEnglishandSpanish;askingthevictimtoreadthedocument;andaskingwhetherthevictimunderstandstherights:[1]Youhavetherighttoaskthecourtforhelpwithanyofthefollowingonatemporarybasis:[a]Keepingyourattackerawayfromyou,yourhome,andyourplaceofwork.[b]Therighttostayatyourhomewithoutinterferencefromyourattacker.[c]Therighttoseekano-contactorderundersection664A.3or915.22,ifyourattackerisarrestedforsexualassault.[2]Youhavetherighttoregisterasavictimwiththecountyattorneyundersection915.12.[3]Youhavetherighttofileacomplaintforthreats,assaults,orotherrelatedcrimes.SenateFile2379,p.8[4]Youhavetherighttoseekrestitutionagainstyourattackerforharmtoyouoryourproperty.[5]Youhavetherighttoapplyforvictimcompensation.[6]Youhavetherighttocontactthecountyattorneyorlocallawenforcementtodeterminethestatusofyourcase.[7]Ifyouareinneedofmedicaltreatment,youhavetherighttorequestthattheofficerpresentassistyouinobtainingtransportationtothenearesthospitalorotherwiseassistyou.[8]Youhavetherighttoasexualassaultexaminationperformedatstateexpense.Youhavetherightnottobepreventedfromreceivingasexualassaultexamination.Ifyouchoosetohaveasexualassaultexamination:[a]Youhavetherighttohaveasexualassaultexaminationkitoritsprobativecontentspreserved,withoutcharge,fortwentyyears,orinthecaseofaminorvictimforthelifetimeoftheminorvictim,evenifyoudonotfileacriminalcomplaint,pursuanttosection709.10,subsection6.[b]Youhavetherighttobeinformedofanyresultsofasexualassaultexaminationkitifsuchdisclosurewouldnotimpedeorcompromiseanongoinginvestigation.[c]Youhavetherighttobeinformedofthestatusandlocationofasexualassaultexaminationkit.[d]Atleastsixtydayspriortotheintendeddisposalofasexualassaultexaminationkit,youhavetherighttobenotifiedinwritingbyalawenforcementagencyoftheintendeddisposal.Thisissothatyoucanmakeawrittenrequestforfurtherpreservationofthekitoritsprobativecontents.[e]Inordertonotifyavictim,thelawenforcementofficethathascustodyofthesexualassaultexaminationkitmustverifythevictim’sphysicaladdress.Avictimmustnotifythelawenforcementofficewithcustodyofthesexualassaultexaminationkitofanychangetothevictim’scontactinformation.[9]Youhavetherighttorequestthepresenceofavictimcounselor,asdefinedinsection915.20A,atanyproceedingrelatedtoanassaultincludingamedicalexamination.[10]Ifyoubelievethatpoliceprotectionisneededforyourphysicalsafety,youhavetherighttorequestthattheofficerSenateFile2379,p.9presentremainatthesceneuntilyouandotheraffectedpartiescanleaveoruntilsafetyisotherwiseensured.DIVISIONVMENTALCOMPETENCYSec.9.Section812.8,subsections4and8,Code2026,areamendedtoreadasfollows:4.a.Uponreceivinganotificationunderthissection,thecourtshallscheduleahearingtobeheldwithinfourteendays.Withintendaysofreceivingnotice,apartymayrequestaseparateindependentpsychiatricevaluationtobeperformedbyapsychiatristorlicensed,doctorate-levelpsychologistoftheparty’sownchoosing.Therequestingpartymustfilenoticeofintenttoseeksuchevaluationbeforethescheduledhearingandproceedingsshallbestayeduntilsuchseparateevaluationiscompleted.Uponreceiptoftheindependentexpert’sreport,therequestingpartyshallfilenoticeofreceiptofthatreportwiththecourt.Thecourtshallscheduleahearingtobeheldwithinfourteendaysofreceiptofnotice.Thecourtshallalsoissueanordertotransportthedefendanttothehearingifthedefendantisincustodyorisbeingheldinaninpatientfacility.Thedefendantshallbetransportedbythesheriffofthecountywherethecourt’smotionortheapplicationpursuanttosection812.3wasfiled.b.Followingthesubmissionofaninitialevaluationfindingthatthereisnosubstantialprobabilitythatthedefendantwillberestoredtocompetencyinareasonableamountoftimeandprovidedthedefendantisotherwiseeligibleforpretrialrelease,thedefendantmayrequestabondreviewhearing.Indeterminingtheconditions,ifany,ofthedefendant’srelease,thecourtshallconsiderwhetherthedefendantislikelytovoluntarilyparticipateinthesecondevaluationasafactorinsettingbondorotherconditionsofrelease.c.Uponreceiptofthesecondevaluation,oruponexpirationofthetimeperiodforobtainingasecondevaluation,thecourtshallscheduleandholdahearingtodeterminethedefendant’scompetencystatus.Atthehearing,thecourtshallmakeoneofthefollowingfindings:(1)Thedefendantiscompetenttostandtrial.(2)ThedefendantisnotcurrentlycompetentbutthereisaSenateFile2379,p.10substantialprobabilitythatthedefendantwillberestoredtocompetencywithinareasonableperiodoftime.(3)Thedefendantisnotcompetentandthereisnosubstantialprobabilitythatthedefendantwillber
