[604.51] ACTION FOR VIOLATION OF CIVIL RIGHTS.1.8Subdivision 1. Cause of action. (a) Any person who, under color of any statute,1.9ordinance, regulation, custom, or usage of the United States or of any state or territory or1.10the District of Columbia, subjects or causes to be subjected any citizen of this state or other1.11person within the jurisdiction thereof to the deprivation of any rights, privileges, or1.12immunities secured by the United States Constitution or the Minnesota Constitution shall1.13be liable to the party injured in an action at law, suit in equity, or other proper proceedings1.14for redress.1.15(b) In addition to any damages, injunction, or other appropriate relief in any action or1.16proceedings under this section, the court shall award a prevailing plaintiff reasonable attorney1.17fees and costs.1.18(c) An action under this section may not be commenced later than six years after the1.19cause of action accrues.1.20Subd. 2. Intergovernmental collaboration agreements. A state or local law enforcement1.21agency may not enter into any voluntary collaboration, task force, or partnership with a1.22federal government agency unless the federal agency agrees in writing that, while operating1.23under the collaboration, task force, or partnership: (1) the federal agency will abide by theSection 1. 102/06/26 REVISOR TW/BH 26-068152.1 United States Constitution and the Minnesota Constitution; and (2) the federal agency's2.2 officers, employees, or agents may be held liable under subdivision 1 for any violation of2.3 the United States Constitution or the Minnesota Constitution.2.4 EFFECTIVE DATE. This section is effective the day following final enactment and2.5 applies to all civil actions and proceedings pending on, or filed on or after, that date.Section 1. 2
