Section 13A-6-65.1, Code of Alabama 1975, is9 amended to read as follows:10"§13A-6-65.111(a) A person commits the crime of sexual torture if he12 or she does any of the following:13(1) Penetrates the vagina, penile opening, anus, or14 mouth of another person with an inanimate object, by forcible15 compulsion, with the intent to sexually torture, sexually16 abuse, or to gratify the sexual desire of either party.17(2) Penetrates the vagina, penile opening, anus, or18 mouth of a person who is incapable of consent by reason of19 being incapacitated, with an inanimate object, with the intent20 to sexually torture, sexually abuse, or to gratify the sexual21 desire of either party.22(3) Penetrates the vagina, penile opening, anus, or23 mouth of a person who is less than 12 years old of age, with24 an inanimate object, by a person who is 16 years old of age or25 older with the intent to sexually torture, sexually abuse, or26 to gratify the sexual desire of either party.27(4) By inflicting physical injury, including, but not28 limited to, burning, crushing, wounding, mutilating, orPage 1SB318 Enrolled29 assaulting the sex organs or intimate parts of another person,30 with the intent to sexually torture, sexually abuse, or to31 gratify the sexual desire of either party.32(b) The crime of sexual torture is a Class A felony."33Section 2.
